Brookings City Council
September 10, 2001
The Brookings City Council convened in regular session on Monday, September 10, 2001, at
3:00 p,m. at City Hall with the following members present: Mayor Virgil Herriott, Council
Members Tom Bozied, Doris Roden, Scott Munsterman, Sam Artz, Mike McClemans and Keri
Weems. City Manager Michael Williams was also present.
Bud�et Hearings. A budget work session was held from 3:00 to 5:00 p.m. No action taken.
Consent A�enda. Motion was made by Weems, seconded by Bozied, to approve the consent
agenda which included the August 27, 2001, and September 4, 2001, meeting minutes; adoption
of the agenda; awarding of the bid for the automated garbage trucks to Sanitation Products of
Sioux Fa11s for carts, the truck chassis, and the automated compactor body in the amount of
$96,456 (Other bids received: Northern Truck of Sioux Falls for$98,280). All members voted
YES; motion carried.
House Moving- Grendlers. A public hearing was held on an application from Jenny L. and
Jeffery S. Grendler to move a one-story, two bedroom ranch style home from Howard, South
Dakota, to the property described as Lot 12, Block 5, Esther Heights Addition also known as
Rhonda Road. All were given an opportunity to be heard. No comments were received. Motion
was made by Artz, seconded by Munsterman, approving the application. All members voted
YES; motion carried.
House Moving—Maize Properties. A public hearing was held on an application from Maize
Properties to move a 40' x 56' metal sided storage building from 236 32°d Avenue to the
property described as Lot 2, Block 1, Telkamp Industrial Addition, also known as 115 32nd
Avenue South. All were given an opportunity to be heard. No comments were received. It was
noted that the building has already been moved. Motion was made by Artz, seconded by
Herriott, approving the application. All members voted YES; Bozied abstained, motion carried.
Ordinance No. 12-01 —Amending Ordinance Section 5-21. Introduction and first reading was
held of Ordinance No. 12-01, an ordinance amending Ordinance Section 5-21 and pertaining to
temporary on-sale alcoholic beverage license for use at a convention hall in the City of
Brookings, South Dakota. Motion was made by Artz, seconded by Roden, to approve the first
reading of Ordinance No. 12-01. All members voted YES; motion carried.
Ordinance No. 13-01—Conditional Use. Introduction and first reading was held of Ordinance
No. 13-01, an ordinance pertaining to an application for a conditional use for a major home
occupation(individual counseling) in a Residence R-1B District. Motion was made by
Munsterman, seconded by Artz, to approve the first reading of Ordinance No. 13-01. All
members voted YES; motion carried.
Ordinance No. 14-01 —Aparopriation of Funds. Introduction and flrst reading was held of
Ordinance No. 14-01, an ordinance appropriating monies to fund the necessary expenditures and
liabilities for the City for the 2002 Fiscal Year and providing for the annual tax levy and annual
tax for all funds. Motion was made by Munsterman, seconded by Roden, to approve the first
reading of Ordinance No. 14-01. All members voted no; motion failed.
Resolution No. 40-01 —Animal Control Fines& Fees. Resolution No.40-01, setting forth a
schedule of proposed fines, fees and procedures pertaining to the keeping and controlling of
animals in the City of Brookings. Motion was made by McClemans, seconded by Artz, to
approve Resolution No. 40-01. All members voted YES; motion carried.

A RESOLUTION SETTING FORTH A SCHEDULE OF PROPOSED FINES, FEES
AND PROCEDURES PERTAINING TO THE KEEPING AND CONTROL OF ANIMALS IN
THE CITY OF BROOKIGNS, SOUTH DAKOTA.
BE IT RESOLVED by the City Council of the City of Brookings, South Dakota, that the
following Schedule of Proposed Fines, Fees and Procedures shall be effective as of the date of
this Resolution for a11 violations of Ordinances set forth herein.

Casaer's Alcohol Oaeratin$Agreement. Motion was made by Munsterman, seconded by
Weems, to terminate the alcohol operating agreement between the City of Brookings and
Casper's Restaurant. AlI members voted YES; motion carried.
Subsidv AQreement-Brookings Citv Cab Service. Motion was made by Roden, seconded by
Munsterman, to approve a subsidy agreement with the Brookings City Cab Service. Motion was
made by McClemans, seconded by Bozied, to amend the motion to a11ow them to change the fees
as proposed, a11ow the ta�to increase fares by$0.25 when gas prices exceed $1.50 per gallon, and
wait on action on the subsidy agreement the 2002 budget is completed. On the amendment, a11
present voted yes; motion carried. On the original motion as amended, all present voted yes;
motion carried.
Discussion continued regarding the 2002 budget proposal. No action ta.ken.

Motion was made by Weems, seconded by Bozied, to instruct the City Manager to draft the budget
as directed during this meeting and bring it to the Council next Monday for deliberation. Identified
criteria: reduction of the 3 sources of revenue and a balanced budget with funded contingency.
All voted yes; except Herriott, motion carried.
Motion was made by Weems, seconded by Bozied, to adjourn the meeting. All members voted
YES; motion carried. Meeting was adjourned at 7:00 p.m.
