Al Glover, Attorney was present. Motion was made by Davidson, seconded by Bibby to approve the consent agenda which included the November 29, 1999 minutes, agenda, action on Resolution No.'s 111-99 through 116- 99, rai�le request, request to cancel the 12/27/99 meeting. All members voted YES; motion carried. RESOLUTION NO. 111-99 RESOLUTION FIXING TIME AND PLACE FOR HEARING UPON ASSESSMENT ROLL FOR SIDEWALK ASSESSMENT PROJECT NO. 99-01SWR (1999 Sidewalk Repair Sites) BE IT RESOLVED by the City Council of the City of Brookings, South Dakota, as follows: 1. The assessment roll for Sidewalk Assessment Project No. 99-01 SWR ha.ving been filed in the office of the City Manager on the 30�`day of November, 1999, the City Council shall meet in the Council Chambers, City Hall, in said City on Monday, the 20�`day of December, 1999, at 5:00 o'clock PM, the said date being not less than twenty(20) days from the filing of said assessment roll for hearing thereon. 2. The City Engineer is authorized and directed to prepare a notice describing, in general terms Sidewalk Assessment Project No. 99-01 SWR, the date of filing the assessment roll, the time and place of hearing thereon, stating that the assessment roll will be open for public inspection at the of�ice of the City Engineer and referring to the assessment roll for further particulars. 3. The City Clerk is authorized and directed to publish said notice in the official newspaper at least one(1)week prior to the date set for hearing and to mail a copy thereof, by first class mail addressed to the owner or owners of any property to be assessed at his, her or their last mailing address as shown by the records of the Director of Equalization at least one (1) week prior to the date set for said hearing. All members voted YES; motion carried. Review of ordinance regarding Cable TV Review Board. Motion was made by Davidson, seconded by Weems to request the City Attorney prepare documents to repeal the Cable TV Review Board. All members voted YES, except Bozied abstained; motion carried. Review of joint powers agreement with the Brookings County Commission regazding the EQ 11 Council. No change to the agreement. Review of inemorandum of understanding between the City of Brookings and South Dakota State University for the Performing Arts Center. Pubiic hearing was held for Elks Club and VFW, all present were given an flpportunity to be heard. Motion was made by Artz, seconded by Bibby to approve Liquor License Agreements for 2000. All members voted YES; motion carried. Motion was made by McClemans, seconded by Bibby approving Resolution No. 100-99 authorizing the Mayor to execute an Operating Liquor Management Agreement Renewal between the City of Brookings and Donald A. Urquhart. All members voted YES; motion carried. RESOLUTION NO. 100-99 BE IT RESOLVED by the City of Brookings, South Dakota, that the City Council hereby approves a Lease Renewal Agreement for the Operating Liquor Management Agreement between _ the City of Brookings and Donald A. Urquhart for the purpose of a liquor manager to operate the on-sale establishment or business for and on behalf of the City of Brookings at 309 Main Avenue also known as Jim's Tap. BE IT FURTI�R RESOLVED that the Mayor be authorized to execute the Agreement on b�half of the City, which sha11 be for a period of five(5)years. The City Attomey reviewed the City Charter pertaining to the Hospital Board and concluded the City Council does have the power to change the number on the Board. 227 Motion was made by Weems, seconded by Bozied to move into executive session with the City Manager and City Clerk present to discuss contractual matters. All members voted YES; motion carried. Motion was made by Bibby, seconded by Davidson to move out of executive session. All members voted YES; motion carried. Motion was made by Davidson, seconded by Bozied to authorize the City Manager, working with the City Council, to prepare a detailed scope of services and expectations for the City Attorney position. All members voted �ES; motion carried. Motion was made by McClemans, seconded by Weems moving into executive session, Bozied and City Clerk left the room. All members voted YES; motion carried. Motion was made by Artz, seconded by Hemott to pursue an appeal on Bozied vs. City of Brookings to the Supreme Court of the State of South Dakota. Motion was made by Weems, seconded by Bibby to table to a special meeting on December 9t'`at 4,45 PM. All members voted Y�S, except Bozied abstained; motion carried. Council Meeting Adjourned. .
