Commission Chambers June 15, 1999
City of Brookings
The City Commission convened in regular session at 7:30 PM with the following members
present: Hauschild, Wicks, Murra, and Artz; absent: Klavetter
Alan Glover, Attorney was present.
Minutes of the regular meeting held June S, 1999 were read and approved.
Motion was made by Wicks, seconded by Artz approving the bills and claims.

Motion was made by Murra, seconded by Wicks to approve the agenda.
Presentation ofMayor's Awards for Historic Preservation by Mayor Hauschild and the
Brookings Historic Preservation Commission.
Presentation of the South Dakota Preservationists of the Year Award to George and Evelyn
Norby by the Historic South Dakota Foundation.
Motion was made by Wicks, seconded by Muna tabling action on the bid for finishing area for
laboratory within the Agricultural Research Building for two weeks. All members voted YES; motion
carried.
Public hearing was held on an application for an off-sale malt beverage license for Casey's
General Stores Inc. at 122 West Sixth Street. All present were given an opportunity to be heard.
Motion was made by Artz, seconded by Murra approving the malt beverage license. All members voted
YES; motion carried.

Motion was made by Wicks, seconded by Muna approving Resolution No. 50-99 regarding fair
and adequate mitigation for people impacted along the proposed DM& E by-pass route. All members
voted YES; motion carried.
RESOLUTION NO. 50-99
WHEREAS the Brookings City Commission desires to do what is best for the Community of
Brookings, and
WI�REAS on August 25`�`, 1998 the Brookings City Commission passed Resolution No. 94-98
expressing its concerns regarding how the impact of the proposed Dakota Minnesota&Eastern
Railroad changes could effect the future of Brookings, and
WI�REAS on November 3, 1998 the Brookings City Commission unanimously approved a
motion to support the Dakota Minnesota&Eastern Railroad proposal if they would by-pass the City at
their expense,
NOW THEREFORE, BE IT RESOLVED that the Brookings City Commission still feels the
need for Dakota Minnesota&Eastern Railroad to construct a by-pass around the City of Brookings,
and
FURTHER BE IT RESOLVED that the City of Brookings will take a proactive role with
Dakota Minnesota&Eastern Railroad and Brookings County in promoting fair and adequate mitigation
for people impacted along the proposed by-pass route.
Public hearing was held on Ordinance No. 12-99 rezoning Outlot 5 in the SE '/a of Section 15-
T110N-RSOW from A-Agricultural District to a class Industrial I-1 District(north ofHwy 14 ByPass
on Western Avenue, Joint Jurisdictional Area). All present were given an opportunity to be heard.
Motion was made by Murra, seconded by Artz to table action on Ordinance No. 12-99 for one week.
Murra and Artz voted YES; Wicks and Hauschild voted NO; motion died due to lack of a majority.
Motion was made by Wicks and seconded by Hauschild to approve Ordinance 12-99. All present voted
YES; motion carried.
ORDINANCE NO. 12-99
AN ORDINANCE TO CHANGE THE ZONING WITHIN THE JOINT
JURISDICTIONAL AREA SURROUNDING THE CITY OF BROOKINGS
Public hearing was held on Ordinance No. 13-99 re-zoning the E 200' of Outlot 7 and the E
200' of the N 325' of Block 12, Parkdale Home Third Addition from an Agricultural A District and
Residence R-2 District to a Residence R-3 District (SW corner of First Avenue and Harvey Dunn St.)
All present were given an opportunity to be heard. Motion was made by Muna, seconded by Artz
approving Ordinance No. 13-99. All members voted NO; motion denied.
ORDINANCE NO. 13-99
AN ORDINANCE TO CHANGE THE ZONING WITHIN THE CITY OF BROOKINGS
Public hearing was held on Ordinance No. 14-99 approving a Conditional Use to establish a
major home occupation (Professional Office)in Lot 1, Block 1, Esther Heights Addition, also known as
405 Martin Boulevard. All present were given an opportunity to be heard. Motion was made by Wicks,
seconded by Murra approving Ordinance No. 14-99. All members voted YES; motion carried.

AN ORDINANCE PERTAINING TO AN APPLICATION FOR A CONDITIONAL
USE FOR A MAJOR HOME OCCUPATION(PROFESSIONAL OFFICE) IN TI�RESIDENCE R-
1B DISTRICT.

Public hearing was held on Ordinance No. 15-99 re-zoning the N 72', S 305' of Lot B, Sale
Barn Addition from a Residence R-3A District to a Business B-3 District. All present were given an
opportunity to be heard. Motion was made by Wicks, seconded by Artz approving Ordinance No. 15-
99. All members voted YES; motion carried.
ORDINANCE NO. 15-99
AN ORDINANCE TO CHANGE THE ZONING WITHIN THE CITY OF BROOKINGS
Public hearing was held on Ordinance No. 16-99 re-zoning the S 98' of Outlot A; Outlot B
excluding the N 90', W 30'; all of Outlots C, D, and E in the NE '/a of Section 25-110-50 and sublots 4
and 5 of Lot A in Block 1, Bane and Pool Addition from a RB-4 Neighborhood Business District to a
Business B-2 District (located on 6�' Street in the 1700 Block). All present were given an opportunity to
be heard. Motion was made by Wicks, seconded by Artz approving Ordinance No. 16-99. All
members voted YES; motion carried.

AN ORDINANCE TO CHANGE THE ZONING WITHIN TI� CITY OF BROOKINGS
Motion was made by Wicks, seconded by Murra approving authorization for the Mayor to sign
a"Juvenile Accountability Incentives Block Grant" (JAIBG). All members voted YES; motion carried.
Motion was made by Murra, seconded by Wicks to move into executive session for contractual
reasons. All members voted YES; motion carried.
