HomeMy WebLinkAboutCCMinutes_1998_11_10 019 Commission Chambers November 10, 1998 City of Brookings The City Commission convened in regular session at 2:00 PM with the following members present: Mayor Hauschild, Klavetter, Murra, Artz and Plumart Alan Glover, Attorney was present. Motion was made by Plumart, seconded by Murra approving Resolution No. 125-98, canvass ballot. All members voted YES; motion carried. RESOLUTION NO. 125-98 WHEREAS, on the 3`d day of November, 1998,there was held in the City of Brookings, South Dakota, an election for the purpose of adopting or rejecting Ordinance No. 18-98, and WHEREAS,the judges and clerks of said election have returned to the City Commission of the City of Brookings the official results for the purpose of the official canvass; and WHEREAS,the Board of Commissioners on November 10, 1998 has canvassed the results for the purpose of determining if Ordinance No.18-98 should be approved; NOW, THEREFORE, BE IT HEREBY RESOLVED by the City Commission of the City of Brookings, South Dakota,that the official vote at the special City Election held November 3, 1998 in conjunction with the County General Election was as follows: ? Minutes of the regular meeting held November 3, 1998 were read and approved. Motion was made by Artz, seconded by Plumart approving the bills and claims. Motion was made by Murra, seconded by Klavetter acc�pting completion of the amendment to the Notice to Abate on the E105',N100' of Lots 3 and 4, Block 7 of Peterson Addition, also known as 829 7"'Avenue, contingent upon the front door being installed. All members voted YES; motion carried. Introduction and first reading of Ordinance No. 23-98 amending the 1994 Revised Zoning Ordinance regarding sign regulations. Motion was made by Klavetter, seconded by Plumart approving the first reading of Ordinance No. 23-98. All members voted YES; motion carried. ORDINANCE NO. 23-98 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BROOKINGS BY ESTABLISHING SIGN REGULATIONS. Introduction and first reading of Ordinance No. 24-98 amending the 1994 Revised Zoning Ordinance pertaining to recreational vehicles and mobile home parks. Motion was made by Klavetter, seconded by Plumart approving the first reading of Ordinance No., 24-98. All members voted YES; motion carried. ORDINANCE NO. 24-98 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BROOKINGS PERTAINING TO MOBILE HOME PARK. 021 Motion was made by Klavetter, seconded by Artz approving Resolution No. 126-98 approving a final plat of Lots 4 and 5, Christie Addition in the NW '/4,NE '/4 of Section 11-T109N-RSOW. All members voted YES; motion carried. RESOLUTION NO. 126-98 BE IT RESOLVED BY THE CITY OF BROOKINGS, SOUTH DAKOTA: WHEREAS, Richard F. Parsons, owner of the hereinafter described real property, has submitted to the governing board a proposed plat of the follow�ng described real estate located in the County of Brookings in the State of South Dakota to wit: Plat of lots 4 and 5 of Christie Addition in the NW '/4 of the NE '/4 of Section 11, T109N, RSOW of the 5`"P.M., Brookings County, South Dakota, and the Board of City Commissioners of said City having examined the proposed plat and it appearing that all municipal taxes and special assessments, if any, upon said plat and survey, have been executed according to law. NOW, THEREFORE, BE IT RESOLVED that said plat and survey be and is hereby in all things accepted and approved. Motion was made by Klavetter, seconded by Murra approving Resolution No. 127-98 approving a final plat of Lots 5 and 6, Block 7, Moriarty Second Addition. All members voted YES; motion carried. RESOLUTION NO. 127-98 WHEREAS, Paul E. Moriarty, owner of the hereinafter described real property has submitted to the governing board a proposed plat of Lots 5 and 6 of Block 7 of Moriarty's Second Addition to the City of Brookings, South Dakota, and the Board of City Comn�issioners of said City having examined the proposed plat and it appearing that all municipal taxes and special assessments, if any,upon said plat and survey, have been executed according to law. Motion was made by Plumart, seconded by Murra approving Resolution 128-98 approving change order no. 22, additional electric panel and wiring, for the Brookings MultiPlex Exhibition ' Building. All members voted YES; motion carried. RESOLUTION NO. 128-98 RESOLUTION APPROVING CHANGE ORDER(CCO#22) FOR BROOKINGS MULTIPLEX CONSTRUCTION PROJECT BE IT RESOLVED by the City Commission that the following change order be allowed for the Brookings MultiPlex Construction Project: Construction Change Order Number 22 Furnish and install electrical components for the exhibition facility as detailed in the attached Change Order No. 22. This work includes furnishing an electrical panel and associated wiring to feed offices on the mezzanine along with feeding roof top units in the office area. Motion was made by Plumart, seconded by Artz approving authorization for the Mayor to sign an amendment to EDA Project no. OS-01-02932 extending completion date of construction for Research Center from November 5, 1998 to February 5, 1999. All members voted YES; motion carried. Motion was made by Klavetter, seconded by Artz approving Resolution No. 129-98 vacating an easement in Moriarty Second Addition. All members voted YES; motion carried. 022 RESOLUTION NO. 129-98 VACATION OF AN EASEMENT IN LOT 4 BLOCK 7, NiORIARTY'S SECOND ADDITION WHEREAS, the City of Brookings has been granted certain utility easements in Lot 4 Block 7, Moriarty's Second Addition to the City of Brookings by virtue of a Final Plat entitled Plat of Lot 4 of Block 7, Moriarty's Second Addition to the City of Brookings, South Dakota and filed in Plat Book 19, Page 120. WHEREAS, Paul Moriarty, owner of the adjoining property has petitioned the City of Brookings to vacate a certain easement previously granted. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Brookings that the present easement along and ten feet(10) south of the north property line of Lot 4, Block 7, Moriarty's Second Addition be vacated. This does not include the ten (10) foot easement around the cul de sac. FURTHERMORE,that a copy of this resolution be filed with the Brookings County Register of Deeds and that said Register of Deeds be requested to mazk upon the above referenced plat in Plat Book 19, Page 120 the vacating of said easement and note reference to the proper miscellaneous record. Motion was made by Murra, seconded by Klavetter approving authorization for City Attorney Alan Glover to represent the City with the Bozied litigation. All members voted YES; motion carried. Motion was made by Artz, seconded by Plumart approving authorization for City Attorney Alan Glover to represent the City with the Peeler's litigation.
