The Brookings City Council held a planning session on Tuesday, January, 11, 2005 at 3:00 p.m., at City Hall with the following members present: Mayor Scott Munsterman, Council Members Tom Bozied, Tim Reed, 3ulie Whaley,Doris Roden, and Mike McClemans. Tom Bezdichek was absent. City Manager Alan Lanning, City Attorney Steve Britzman, and City Clerk Shari Thornes were also present. Agenda. A inotion was made by Reed, seconded by McClemans,to amend the agenda to add an executive session to consult with legal counsel on contractual matters. All present voted yes; motion carried. Executive Session. A motion was made by Roden, seconded by Reed, to enter executive session for contractual reasons with the council, manager, attorney and clerk present at 3:11 p.m. Bezdichek was absent. All present voted yes; motion carried. A motion was made by Reed, seconded by Roden, to leave executive session at 5:25 p.m. All present voted yes; motion carried. Action Meetine. The Brookings City Council held an action meeting on Tuesday, January, 11, 2005 at 5:30 p.m., at City Hall with the following members present: Mayor Scott Munsterman, Council Members Tom Bozied, Tim Reed, Julie Whaley, Doris Roden, and Mike McClemans. Tom Bezdichek was absent. City Manager Alan Lanning, City Attorney Steve Britzman, and City Clerk Shari Thornes were also present. Consent Agenda. A motion was made by Reed, seconded by McClemans,to amend the agenda to correct the Dec. 21 minutes and to add action to convey land to BEDC to the agenda. All present voted yes, motion carried. A motion was made by Whaley, seconded by Reed, to approve the consent agenda which included: l. Adoption of the agenda as amended; 2. Minutes - Approval of November 16, December 7, December 14, December 21 (as amended), and January 4 minutes; 3. Bids - Action to award bids for a used diesel-fueled 125-gallon Melter Applicator with pump on demand features with no more than 150 hours to Brock White Company, of South Falls, SD, in the amount of$23,500. Bids were opened on Tuesday, December 21, 2004 and no other bids were received; 4. Action on Resolution No. 03-OS - a Resolution Fixing Time and Place for hearing upon Assessment Roll for Street Assessment Project No. 2004-03STA (Alley from 6�' Street to 7th Street between Henry Avenue and 1 St Avenue); RESOLUTION NO.03-OS RESOLUTION FIXING TIME AND PLACE FOR HEARING UPON ASSE5SMENT ROLL FOR STREET ASSESSMENT PROJECT NO.2004-03STA Alley from 6`h Street to 7`h Street between Henry Avenue and 1'�Avenue BE IT RESOLVED by the City Council of the City of Brookings, South Dakota,as follows: 1. The assessment roll for Street Assessment Project No.2004-03STA having been filed in the office of the City Manager on the 4`h day of January,2005,the City Council shall meet in the Council Chambers,City Hall, in said City on Tuesday,the 22°d day of February,2005,at 5:30 o'clock PM,the said date being not less than twenty(20)days from the filing of said assessment roll for hearing thereon. 2. The City Engineer is authorized and directed to prepare a notice describing,in general terms Street Assessment Project No.2004-03STA,the date of filing the assessment roll,the time and place of hearing thereon,stating that the assessment roll will be open for public inspection at the office of the City Engineer and referring to the assessment roll for further particulars. 3. Action on Resolution No. O1-OS - setting the unit financial charge or 2005 storm drainage fees; RESOLUTION NO.Ol-OS Setting The Unit Financial Charge For 2005 Storm Drainage Fees WHEREAS,Chapter 72, Section 72-1 (b),of Code of Ordinances for the City of Brookings, provides for setting the unit financial charge of Storm Drainage,by Resolution. NOW THEREFORE,BE IT RESOLVED that the unit financial charge shall be.00018 for Storm Drainage purposes. 11. Action to cancel the January 25, 2005 City Council meeting. 3l � 12. Action to amend the Governance and Ends Policy,Ends Policy 1: Financial Stability, Guideline C pertaining to reserves. 1) Lowers the General Fund Reserve below a 3-month operational level: a. The 3-month calculation shall be based upon General Fund expenditures, derived from the previous year's Audited Financial Statement. The reserve amount shall reflect the targeted reserve amount, deficiencies below the targeted reserve amount and any discretionary funds available above the targeted reserve amount; b. General Fund reserves may be used at the Council's discretion to address temporary cash-flow shortages, emergencies unanticipated economic downturns, one-time opportunities and capital needs related to buildings, structures and vehicles used specifically in the operation of the General Fund. They provide flexibility to respond to unexpected opportunities that may help the City achieve its goals. Industrial Land. A motion was made by Roden, seconded by Whaley,to convey Lots 5, 9, 10 and 11 consisting of 5.55 acres, in Block 1 of the Telkamp Industrial Addition to the Brookings Economic Development Corporation for economic development purposes at a price of$55,000. All present voted yes; motion carried. Ordinance No. 31-04—Rezonin�. Public hearing was held on Ordinance No. 31-04,to rezone a portion of land in the Timberline Addition in the E '/2 of the NE '/4 of Section 34-T1 lON-RSOW from a Residence R-1B District to a Residence R-2 District. All present were given an opportunity to be heard. A motion was made by Bozied, seconded by Whaley, to approve Ordinance No. 31-04. All present voted yes; motion carried. Ordinance No. 30-04—Zonin� Ordinances. Public hearing was held on Ordinance No. 30-04, an Ordinance Amending Chapter 94, Zoning, of the City of Brookings, South Dakota and pertaining to Wireless Communication Facilities for purposes of Administration of the Zoning Ordinances. All present were given an opportunity to be heard. A motion was made by McClemans, seconded by Whaley,to approve Ordinance No. 30-04. All present voted yes; motion carried. Ordinance No. O1-OS—Code of Ordinances. Introduction and first reading was held on Ordinance No. O 1-05, An Ordinance amending Section 78-32(B) of The Code of Ordinances of the City of Brookings, South Dakota and pertaining to the additional Municipal Sales and Service and Use Tax in the City of Brookings, South Dakota. A motion was made by Whaley, seconded by Reed,to approve first reading of Ordinance No. O 1-05. All present voted yes; motion carried. Second reading will be held on 02/O1/OS. Adiourn. A motion was made by Reed, seconded by Whaley,to adjourn. All present voted yes; motion carried.
