HomeMy WebLinkAboutCCMinutes_2004_11_09 2 � � Brookings City Council Tuesday, November 9, 2004 The Brookings City Council held an action meeting on Tuesday,November 9, 2004 at 5:30 p.m., at Ciry Hall with the following members present: Mayor Scott Munsterman, Council Members Tom Bezdichek, Tom Bozied,Tim Reed,3ulie VVhaley,Doris Roden, and Mike McClemans. City Manager Alan Lanning, City Attorney Steve Britzman, and City Clerk Admin. Assistant Bonnie Foster were also present. Consent Atenda. Ordinance No. 23-04 was withdrawn from the agenda. A motion was made by Bozied, seconded by Whaley,to approve the consent agenda which included: 1. Adoption of the agenda as amended; 2. Approval of the October 5, 12, and 26, 2004 minutes; and 3. Approval of Resolution No. 70-04,establishing an application fee for new liquor operating agreements. RESOLUTION NO.70-04 A RESOLUTION ESTABLISHING AN APPLICATION FEE FOR NEW LIQUOR OPERATING AGREEMENTS WHEREAS,the Governing Body for the City of Brookings, South Dakota,has established a process to review and consider applications for any new or unused liquor operating agreements; and WHEREAS,the Office of City Clerk is responsible to process all alcohol applications and,in an effort to recover administrative costs for processing said applications,has established a minimal application fee, NOW THEREFORE,BE IT RESOLVED,by the Governing Body of the City of Brookings, South Dakota,that an application fee of$25.00 is payable with the application by all applicants for new or unused liquor operating agreements. All members present voted yes;motion approved. PlanninE Commission Re�ort. Larry Fjeldos, Commission Chair,reported that the Commission has reviewed the following items since July 2004: 6 final plats, 1 preliminary plat,2 conditional use permits, 4 land use classification changes, 1 annexation, 1 site plan amendment, minor amendment to a PDD. Their goals for 2005 are to continue to planning for annexation,preliminary land uses, local street plans for East side of 34`h Ave.,review the residential density issues around SDSU, and review ordinance and land use policies with Brookings County Planning Commission. Ordinance No.22-04—rezoning. A public hearing was held on Ordinance No. 22-04, a petition to rezone Outlot B in the NW'/4, SW '/4 of Section 22-T110N-R49W from an Agricultural A District to an Industrial I-1 Light District(1124 34"'Ave.). All present were given an opportunity to be heard. A motion was made by Whaley, seconded by Bozied,to approve Ordinance No. 22-04. All present voted yes;motion carried. House Movin�—Matthew R.Johnson. A public hearing was held for a house moving request from Matthew R. Johnson to move a one-story ranch style home from the South Dakota Development Authority to Lot 178, Onaka Village,Indian Hills Addition,also known as 234 Thunder Pass. All present were given an opportunity to be heard. A motion was made by Roden, seconded by Reed,to approve. All present voted yes; motion carried. Ordinance 25-04—Building Code. Introduction and first reading was held on Ordinance No. 25-04,an Ordinance amending Article II of Chapter 22 of the Code of Ordinance of the City of Brookings and pertaining to the adoption of The 2003 International Building Code and the 2003 International Residential Code with certain Amendments thereto. A motion was made by Reed, seconded by Whaley,to approve first reading. All present voted yes; motion carried. Second reading is scheduled for November 23, 2004. Ordinance No.24-04—Code of Ordinances. Introduction and first reading was held on Ordinance No. 25-04, an Ordinance amending Section 74-32 of the Code of Ordinances of the City of Brookings, South Dakota and pertaining to building upon the public right of way in the City of Brookings, South Dakota. A motion was made by McClemans,seconded by Whaley,to approve. Discussion: LeWayne Erickson, attorney for ponna Ramsay, suggested an easement rather than an ordinance could be used to address this issue. Alan Lanning, City Manager, said city statute doesn't allow for an encroachment into the public right-of-way. A change to the ordinance and development of criteria is needed to objectively review requests. All present voted yes; motion carried. Second reading is scheduled for November 23,2004. Ordinance No.26-04—Temporarv On-Sale Alcohol License. Introduction and first reading was held on Ordinance No. 26-04, an Ordinance amending Ordinance Section 6-43 and pertaining to procedure for the issuance of temporary on-sale alcoholic beverage licenses for use at a Convention Hall in the City of 283 Brookings, South Dakota. A motion was made by Reed, seconded by Bozied,to approve first reading of Ordinance No. 26-04. All present voted yes; motion carried. Second reading is scheduled November 23, 2004. Brookin�s Downtown Streetscape Plan presentation. Randy Fisher,DesignWorks architect, presented the final streetscape plan for the Brookings Downtown encompassing Main Avenue from 6`�' Street to Front Street. He noted that this location is ideally suited for a collector loop around the downtown area that would direct local traffic out of the central location to the perimeter, also providing access to different parking districts. Any parking districts could be done over the long term. The biggest change would be to close Front Street in front of the depot. He indicated that traf�c counts would have to be done for the 3rd Street and Main intersection. He recommended installation of turning lanes to accommodate the closure of Front Street. Concern was expressed about truck traffic. A unique feature in the plan is the installation of two roundabouts on Main Avenue would provide a traffic calming mechanism. The outlying districts are seen as being?onger term projects. There are many options to consider in this plan(i.e. extending lights on side streets,bike route and roundabouts). The Depot Park, closing Front St. on the West side of Main and the parking on Front St. on the East side of Main are not part of their proposal. Gordon Ommen, Capitaline, Inc., said his firm purchased the Depot and they will be remodeling and restoring the building this spring. They would like to join in a private/public partnership to make the designed Depot Park part of the plan. The council discussed the infrastructure condition and possible alternatives. More information is needed on the potential costs. The next step will be to secure funding, develop construction drawings and seek bids for the project. Council Members Open Discussion: • Bezdichek requested future discussion of property annexation. • Roden reported of problems with the 6th St. wayfinding signage and requested assistance in working with state officials. • Roden recommended the city communicate with Senator Thune regarding the Sun Grant initiative and other local issues. • Reed asked about follow-up on a citizen request for survey pins. Reed said he wants follow-up for questions made in public for issues such as this. � McClemans agreed that annexation of properties and expansion of the Utilities are very important. The city's growth depends on utilities capabilities. This item will be scheduled for a planning meeting and BMU representatives will be invited. • The sales tax revenue is extremely hard to track. We need to get an actual accounting of more than just general categories. • A motion was made by Bozied, seconded by Reed,to appoint Ann Martin to the Wellness Council. All present voted yes; motion carried. Executive Session. A motion was made by Roden, seconded by Reed,to enter into Executive Session at 8:00 p.m. for consulting with legal counsel or reviewing communications from legal counsel about proposed or pending litigation or contractual matters with the Council, City Manager, City Attorney, and Asst. City Clerk present. A motion was made by Roden, seconded by Reed,to exit Executive Session at 8:28 p.m. All present voted yes; motion carried. Adiourn. A rnotion was made by McClemans, seconded by Bozied,to adjourn. All present voted yes; motion carried.
