The Brookings City Council he4d an action meeting on Tuesday, May 25, 2004 at 5:30 p.m., afi
City Hall with the following members present: Mayor Scott Munsterman, Council Members Tom
Bezdichek, Tom Bozied, Tim Reed, Julie Whaley, Doris Roden, and Mike McClemans. City
Manager Alan Lanning, City Attorney Steve Britzman, and City Clerk Adm. Assistant Bonnie Foster
were also present.
Consent Agenda: A motion was made by McClemans, seconded by Whaley, to approve the
consent agenda which included adoption of the agenda; approval of the April 6, April 20, April
27, May 1 1, and May 17 meeting minutes; action to approve Resolution No. 29-04: awarding
bids for 2004-06STI Street Maintenance Project; action to approve Resolution No. 30-04:
awarding bids for P3360(00) 8th Street South Asphalt Resurfacing and Pavement Marking
Project; action to approve Resolution No. 31-04: awarding bids for 2004-01 SWR Sidewalk
Replacement Project; and action to approve Harry Forsyth's reappointment to the Airport Board,
term expiring 5�01�09. Al) present voted yes, motion carried.
RESOLUTION NO. 29-04
RESOLUTION AWARDING BIDS ON PROJECT 2004-06ST1
STREET MAINTENANCE PROJECT
WHEREAS, the City of Brookings has received the following bids for Project 2004-06STI Street
Maintenance and Overlay Project.
Schedule A Moorseal, lnc. $ 51,220.00
Schedule A The Road Guy $ 52,040.00
Schedule A Topkote, Inc. $ 53,666.00
Schedule B Bowes Construction, Inc. $ 37,750.00
NOW THEREFORE, BE IT RESOLVED that the low bid of Moorseal, Inc. for Schedule A and Bowes
Construction, Inc. for Schedule 8 be accepted.

WHEREAS, the City of Brookings has received the following bids for Project P3360(00) PCEMS

"Myrl & Roy's Paving, Inc." $333,108.38
NOW THEREFORE, BE IT RESOLVED that the low bid of Bowes Construction, Inc. of Brookings, SD
in the amount of $295,251.60 be accepted contingent upon the concurrence of the South Dakota
Department of Transportation in the award of the bid.

Citizens Who Have Disabilities Report. Kurt Cogswell, Committee Chair, gave an update on
recent Board activities including the ABLE Award and the upcoming ADA Anniversary Event on
luly 25th.
Resolution No. 24-04—Project 2004-03STA. A public hearing was held on Resolution No. 24-
04, necessity of Alley Paving. All present were given an opportunity to be heard. A motian was
made by Whaley, seconded by McClemans, to approve Resolution No. 24-04. All present voted
yes; motion carried.

PROPOSED RESOLUTION OF NECESSITY
STREET ASSESSMENT PROJECT 2004-03STA
SE !T RESOLVED by the City Council of the City of Brookings, South Dakota, as follows:
The City Council of the City of Brookings hereby declares the necessity of paving with a
bituminous wearing surface on an asphalt stabilized base course on an alley as follows: Alley
from 6m Street to 7rh Street between Henry Avenue and l sf Avenue
1. The general nature of the improvement is above set forth and reference for details is hereby
made to the drawings and specifications prepared by the City Engineer and on file with the
City Clerk.
2. The material to be used is asphalt for paving of the alley:
One and one-half inch (1 �/s") bituminous mat on a one and one-half inch (1 �/s")
asphalt stabilized base course on a six inch (6") crushed gravel base course for the
alley.
3. The improvement is substantialty uniform. The estimated cost is $24.00 per linear foot of alley.
The estimated cost per linear foot of alley for paving with one and one-half (1
�/�") bituminous mat on a one and one-half inch asphalt stabilized base course on a
six inch crushed gravel base course to be paved to a width of 1 1 feet is $24.00
or $12.00 per side of alley.
4. A description of classes of lots to be assessed is as follows:
All assessable (ots and tracts of land lying contiguous to the alley hereinabov�
described.
5. The method of apportionment of benefits is as follows:
The cost thereof to be assessed against all assessable lots and tracts of land
according to the benefits determined by the governing body to accrue to all such
lots and tracts from the construction of the improvement.
b. The above described improvement shall be hereinafter referred to as Street Assessment
Project No. 2004-03STA, which shall be deemed a description of the improvement o# the streets
as hereinabove set forth.
SDSU Foundation Easement. Extinguishment of an old easement and adoption of a new
easement is needed for the new SDSU Foundation Enterprise Center located on 8�' Street and
Medary Avenue. A motion was made by Bozied, seconded by Roden, to authorize the Mayor to
sign an Easement for the South Dakota State University Foundation thpt extinguishes Easements
dated November 6, 1972, November 21, 1972, August 2], 1975, July ]4, 1992, and August 14,
1992 pnd adoption of an easement for Lots 5-12, Block 7, Morehouse Addition in the City of
Brookings, County of Brookings, State of South Dakota. All present voted yes, Reed abstained,
motion carried.
Resolution No. 25-04—Project 2004-04STA. A public hearing was held on Resolution No. 25-
04, necessity of Alley Paving. All present were given an opportunity to be heard. A motion was
made by Whaley, seconded by Bozied, to approve Resolution No. 25-04. All present voted yes;
motion carried.

04, necessity of Alley Paving. All present were given an opportunity to be heard. A motion was
made by Roden, seconded by Reed, to approve Resolution No. 26-04. All present voted yes;
motion carried.

Resolution No. 27-04— Project 2004-08STA. A public hearing was held on Resolution No. 27-
04, necessity of Alley Paving. All present were given an opportunity to be heard. A motion was
made by Reed, seconded by Bezdichek, to approve Resolution No. 27-04. All present voted yes;
motion carried.

The City Council of the City of Brookings hereby declares the necessity of paving with a
bituminous wearing surface on an asphalt stabilized base course on an alley as follows: Alley
from Medary Avenue to 1 1 th Avenue between 4th Street and 5th Street.
1. The general nature of the improvement is above set forth and reference for details is
hereby made to the drawings and specifications prepared by the City Engineer and on
file with the City Clerk.
2. The material to be used is asphalt for paving of the alley:
One and one-half inch (1 �/s") bituminous mat on a one and one-half inch (1
�/z") asphalt stabilized base course on a six inch (b") crushed gravel base �
course for the alley.
3. The improvement is substantially uniform. The estimated cost is $32.00 per linear foot of
alley.
The estimated cost per linear foot of alley for paving with one and one- ;
half (1 �/s") bituminous mat on a one and one-half inch asphalt stabilized
base course on a six inch crushed gravel base course to be paved to a

04, necessity of Alley Paving. All present were given an opportunity to be heard. A motion was
made by Bezdichek, seconded by McClemans, to approve Resolution No. 28-04. All present
voted yes; motion carried.

BE IT RESOtVED by the City Council of the City of Brookings, South Dakota, as follows:
The City Council of the City of Brookings hereby declares the necessity of paving with a

from 1 St Avenue to 2^d Avenue between 6�h Street and 7�h Street.
1. The general nature of the improvement is above set forth and reference for details is
hereby made to the drawings and specifications prepared by the City Engineer and on

Ordinance No. 11-04 - Outdoor Sales in fhe Industrial 1-1 and I-2 Districts. A public hearing
was held on Ordinance No. 1 1-04, zoning amendment pertaining to outdoor sales in the Industrial
1-1 and t-2 Districts. All present were given an opportunity to be heard. A motion was made by
Whaley, seconded by McClemans, to approve Ordinance No. 1 1-04. All present voted yes;
motion carried.
Tem�orary Liquor License for HxVee. A public hearing was held for Temporary Liquor Licenses
for HyVee on July 10 and July 31 at the American Legion, Convention Hall. All present were
given an opportunity to be heard. A motion was made by McClemans, seconded by Whaley,to
approve Temporary Liquor Licenses for HyVee on July 10 and July 31. All present voted yes;
motion carried.
Countil Members Open Discussion. CM Roden asked on the status of the DBI Street Dance.
CM Whaley requested a review of the 22"d Avenue turning lane by the new Wal-Mart.
Adjournment. A motion was made by McClemans, seconded by Whaley, to adjourn. All present
voted yes; motion carried. Meeting adjourned qt 6:08 p.m.
