Brookings City Council
Tuesday, June 10, 2003
The Brookings City Council held an action meeting on Tuesday, June 10, 2003 at 5:30 p.m.
at City Ha11 with the following members present: Mayor Scott Munsterman, Council
Members Doris Roden, Tom Bezdichek, Tim Reed, Julie Whaley, Tom Bozied and Mike
McClemans. City Manager Mike Williams, City Attorney Steve Britzman, and Shari
Thornes, City Clerk, were also present.
Oath of OtTice. Mayor Munsterman presentation a Certificate of Appointment and Oath
of Of�ice Tim Reed as a Council Member serving a term until May 1, 2004.
Consent A�enda. A motion was made by Roden, seconded by Bezdichek, to approve the
consent agenda which includes adoption of the agenda; approval of the May 27, 2003
minutes; approval of Resolution No. 32-03 desi�natin� the official newspaper, Resolution
No. 33-03 designating the of�icial depositories for municipal funds, Resolution No. 34-03
authorizing the Summer Arts Festival Committee to have exclusive use of Pioneer Park
from 7uly 8 ta 14, 2003, awarding a bid to sell a Police car to Cheyka Motors for$6,341.00
(other bids received on May 27, 2003 were from Welcome Motors for $b,l l l, Asia Motors
for $5,428, Suburban Auto for $5,277 and Police Car Unlimited for $5,100) and Resolution
No. 36-03 approving a vacation on an easement for Lots 10, 11 & 12, Block 4, Lots 1, 2, 3
& 4 of Block 9, Pheasant's Nest Addition. All members voted yes to approve; motion
carried.
Resolution No. 32-03
Resolution Designating Official Newspaper
PURSUANT to SDCL 9-22-6, the City Council of the City of Brookings, South
Dakota, hereby designates the Brookings Register as the official newspaper for the City of
Brookings for the ensuing year.
Resolution No. 33-03
Resolution Designating Banks As Depository
PURSUANT to SDCL 9-22-6 and 6.1, the City Council of the City of Brookings,
South Dakota, designates the following banks as depositories for Municipal Funds of the
City of Broakings for the ensuing year:

Resolution No. 3403
A Resolution Authorizing the Brookings Summer Festival
Committee to Have Eaclusive Use of Pioneer Park
WHEREAS, the Brookings Summer Festival will be held in Pioneer Park on July 9-
14, 2003, and
WHEREAS, the Summer Festival Committee has requested the exclusive use and
control of Pioneer Park and its facilities for said festival, plus additional days for preparation
and take-down, and �
WHEREAS, the Summer Festival Committee has provided evidence of liability
insurance coverage including the City of Brookings as named insured, and
WHEREAS, the Summer Festival Committee has a�reed to accept responsibility for
the conduct of the Summer Festival on said premises, now therefore,
BE IT HEREBY RESOLVED, that the use of Pioneer Park and its facilities as a
public park shall terminate for the period of July 9�' thru 7uly 14, 2003.
BE IT FURTHER RESOLVED, that the City Council does hereby grant the
exclusive use of Pioneer Park and its facilities during the Brookings Summer Festival to the
Summer Festival Committee.
FiJRTHER, IT IS RESOLVED, that the Summer Festival Committee shall be
responsible for maintaining said facilities and cleaning them and returning them to the City
of Brookings in good condition following the festival.

Resolution No. 36-03
Vacation Of Easement In Lot 4, Block 9,Pheasant's Nest Addition
BE IT RESOLVED BY THE CI1'Y OF BROOKINGS, SOUTH DAKOTA
WHEREAS, The City of Brookings has been granted a certain drainage/utility
easement in Lot 4, Block 9, Pheasant's Nest Addition to the City of Brookings by virtue of a
Final Plat entitled Plat of Lots 10, 11, and 12 of Block 4, and Lots 1, 2, 3 and 4 af Block 9 of
Pheasant's Nest Addition to the City of Brookin�s, South Dakota, and filed in Plat Book 20,
Page 98, and
WHEREAS, The owner of the west 137' of Lot 4, Block 9, Pheasant's Nest
Addition has petitioned the City of Brookings to vacate the drainage/utility easement
previously granted along the west lot line of Lot 4, Block 9, Pheasant's Nest Addition.
WHEREAS, A replacement easement has been granted, more distinctively
described as the West Twenty-eight feet (W28') of Lot 4, Block 9, Pheasant's Nest
Addition, which was recorded at the Brookings County Register of Deeds oi�ice on May 23,
2003 on Miscellaneous Book 169, Pages 164-165.
NOW, THEREFORE, BE IT RESOLVED By the Governing Body of the City of
Brookings that the easement shown on the above referenced plat on the west lot line of Lot
4, Block 9, Pheasant's Nest Addition be vacated.
FURTHERMORE, That a copy of this resolution be filed with the Brookings
County Register of Deeds and that said Register of Deeds be requested to mark upon the
above referenced plat in Plat Book 20, Page 98, the vacating of said easement and note
reference to the proper miscellaneous record.
Airnort Board Renort. Robb Sexauer, Chairman of the Airport Board, reported that the
Municipal Airport is hosting the annual car club this weekend. The Aviation School
continues to grow at a rapid pace and they are doing an excellent job. The School
continues to request a control tower due to the high air traffic. Brookings is now the busiest
airport in the state of SD on a commercial basis. The Board is researching the possibility of
getting a control tower. The Federal govemment has received four Essential Air Service
bids from three airlines: Great Lakes (cunent provider), Mesa Air, and Westward Airways.
Bids ranged from 1%to 83% above cunent subsidy.
Ordinance No. 11-03 —Disalav of Flags on Right-of-Wavs. A public hearing was held on
Ordinance No. 11-03, an ordinance amending the zoning regulations to allow for flags to be
displayed on the public right-of-way. All present were given an opportunity to be heard. A
motion was made by Bozied, seconded by Whaley, to approve Ordinance No. 11-03. All
members voted yes; motion carried.
Ordinance No. 14-03 — B-5 Amendment to Zoning Ordinance. A public hearing was
held on Ordinance No. 14-03, an ordinance amending the zoning ordinance pertaining to a
Business B-5 Planned Commercial District. All present were given an opportunity to be
heard. A motion was made by McClemans, seconded by Whaley, to approve Ordinance No.
14-03. All members voted yes; motion carried.
Malt Bevera�e Renewals for 2003/2004. A public hearing was held on the renewal of malt
beverage licenses for 2003/2004. All present were given an opportunity to be heard. A
motion was made by McClemans, seconded by Whaley, to approve the renewals. All
members voted yes; motion carried. On-Off Sale Beer license were granted to
Guadalajara, Village Square Mall #1; Skinner's, 302 Main Avenue; King's Wok, 1819 6�`
Street; Jackalope, 311 3'� Street; Cafe Ruby, 1441 Sixth Street; Godfather's Pizza, 610

Ordinance No. 17-03 — Suvalemental Apnroariation. Introduction and flrst reading was
held on Ordinance No. 17-03, an ordinance entitled "An Ordinance Authorizing a
Supplemental Appropriation to the 2003 Budget for the purpose of purchasing a Fire
Department Heavy Rescue Truck for the City of Brookings. A motion was made by Bozied,
seconded by Bezdichek, to approve the introduction and first reading Ordinance No. 17-03.
All members voted yes on first reading; motion carried.
Ordinance No. 16-03—Rezone— 1-T109N-RSOW. Introduction and first reading was held
on Ordinance No. 16-03, an ordinance rezoning the W312', N1320' in the NE '/4 of Section
1-T109N-RSOW from an Agricultural A District to a Residence R-1B District (17�' Avenue
South and 20'�' Street South). A motion was made by McClemans, seconded by Bozied, to
approve the introduction and first reading Ordinance No. 16-03. All members voted yes on
first reading; motion carried. Public hearing is scheduled for June 24�'.
Ordinance No. 15-03 — Rezone — 36-T110N-R50W. Introduction and first reading was
held on Ordinance No. 15-03, an ordinance rezoning a portion of McClemans Addition in
the SW '/a of Section 36-T110N-RSOW from a Residence R-3A District to a Residence R-1B
District and Business B-2 District (7�' Avenue South and 20'� Street South). A motion was
made by Bezdichek, seconded by Bozied, to approve the introduction and first reading
Ordinance No. 15-03. All members voted yes on first reading; McClemans abstained;
motion carried. Public hearing is scheduled for 7une 24�`.
Deputv Mavor. A motion was made by McClemans, seconded by Roden, to appoint Tom
Bozied as Deputy Mayor for a term of June 2003 to June 2004. A motion was made by
McClemans, seconded by Bezdichek, that nominations cease. All members voted yes;
Bozied abstained; motion carried.
Research Park Steering Committee. A motion was made by Bozied, seconded by
McClemans, to appoint Van Fishback as a city representative on the Research Park Steering
Committee. All members voted yes; motion carried.
Ordinance 18-03 - Cable TV Franchise Agreement. Introduction and first reading on
Ordinance No. 18-03, an Ordinance granting a franchise to Mediacom Minnesota LLC, to
construct, operate, and maintain a Cable Television System in the City of Brookings, South
Dakota, setting forth conditions accompanying the grant of the franchise; providing for
regulation and use of the system; and prescribing penalties for the violation of its provisions.
A motion was made by Bezdichek, seconded by Reed, to approve the introduction and first
reading Ordinance No. 18-03. All members voted yes on first reading; motion carried.
Public hearing is scheduled for June 24�'.
Council Members Open Discussion.
Adiournment. A motion was made by McClemans, seconded by Munsterman, to adjourn.
All present voted yes; motion carried. Meeting adjourned at 6:30 p.m.
