HomeMy WebLinkAboutCCMinutes_2003_05_13 o � i Brookings City Council Tuesday, May 13,2003 The Brookings City Council held an action meeting on Tuesday, May 13, 2003 at 5:30 p.m. at City Hall with the following members present: Mayor Scott Munsterman, Council Members Doris Roden, Tom Bezdichek, Julie Whaley, Tom Bozied and Mike McClemans. City Manager Mike Williams, City Attorney Steve Britzma.n, and Shari Thornes, City Clerk, were also present. Consent Agenda. A motion was made by Roden, seconded by Bozied, to approve the consent agenda which includes adoption of the agenda, approval of the Apri122, 2003 minutes, action on Resolution No. 28-03, awarding bids for Chip Sea1 and Paving Maintenance Project (2003-06STI)to the following: Schedule A-The Road Guy Construction Co. in the amount of $66,300.00, Schedule B-Jamir Reclamation in the amount of$37,750.00, Schedule C—Bowes Construction, Inc. in the amount of$7,244.00, Schedule D—Bowes Construction, Inc. in the amount of$109,668.20, Schedule E—Bowes Construction, Inc. in the amount of$45,741.00, Schedule F—Bowes Construction, Inc. in the amount of$96,460.00, and Schedule G—Bowes Construction, Inc. in the amount of $27,873.95. Bids were opened on Apri129,2003. The following other bids were received: Schedule A—Topkote in the amount of$66,561.15 and Moorseal in the amount of $67,315.00. Action on Resolution No. 27-03, declaring a police car as surplus property. All members voted yes to approve the agenda. Motion carried. Resolution No. 28-03 Resolution Awarding Bids On Project 2003-06STI Street Maintenance And Overlay Project WHEREAS,.the City ofBrookings has received the followin�bids for Project 2003-06STI Street Maintenance and Overlay Project. Schedule A The Road Guy $ 66,300.00 Schedule A Topkote $ 66,561.15 Schedule A Moorseal $ 67,315.00 Schedule B Jamir Reclamation $ 37,750.00 Schedule C Bowes Construction, Inc. $ 7,244.00 Schedule D Bowes Construction, Inc. $ 109,668.20 Schedule E Bowes Construction, Inc. $ 45,741.00 Schedule F Bowes Construction, Inc. $ 96,460.00 Schedule G Bowes Construction, Inc. $ 27,873.95 NOW THEREFORE, BE IT RESOLVED that the low bid of The Road Guy for Schedule A, Jamir Reclamation for Schedule B, Bowes Construction, Inc. for Schedules C, D, E, F and G, be accepted. Resolution No 27- 03 Declaring Surpius Property—Police Cars WI�REAS, the City of Brookings is the owner of the following described: 1 —2001 Crown Victoria Ford four-door sedan V1N#2FAFP71W21X144742 WHEREAS, this property is no longer necessary or useful for City purposes and it is the desire of the City of Brookings to sell same as surplus property; WHEREAS, the City Manager has appointed three qualified appraisers to appraise the value of the property and obtained three appraisals; NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Brookings, South Dakota, that this property be declared surplus property according to SDCL Chapter 6- 13. Mavor's Awards for Historic Preservation. Mayor Scott Munsterman and the members of the Brookings I-�storic Preservation Commission presented Ma.yor's Awards for H'istoric Preservation to the following property owners for their exemplary efforts in restoring, rehabilitating, and preserving the historic fabric of Brookings: Broolcings County Commission, 314 6`y Averrue, Courthouse Cupola Windows for "Overall Restoration"; Craig & Kathy Kreyger, 821 & 825 9`h Street for "Rehabilitation of Student Housing"; Brian & Lynn � 72 Darnall, 203 Sth Street for `7nfill Design — Garage"; Mike Reisetter, Dakota Abstract & Title Company, 627 Sth Avenue for `7nfidl Design";and Dennis crnd Darla Bielfeldt, 910 4th Street- Old Sanctuary for "Adaptive Reuse". Librarv Board Report. Dave Bordewyk, Library Board Chair updated the Council on recent Library and Board activities including the summer reading program—"Laugh It Up at Your Library", filling of the Children's Librarian position, a public records confidentiality policy, and the 2004 budget. Mavoral Proclamation—Torch Run. Mayor Munsterman presented a proclamation declaring May 12th as Law Enforcement Torch Run Day for the Special Olympics Program. Mavorai Proclamation—Supuort of United States Armed Forces. Mayor Munsterman presented a proclamation declaring the support of the City Council for the United States Armed Forces. House Moving Reauest- Carlson. A public hearin�was held on a house moving request from Ryan Carlson to move a split-foyer single-family dwelling from Madison, SD to Lot 53, Meyer's Subdivision, also known as 134 35�' Street South. All present were given an opportunity to be heard. A motion was made by McClemans, seconded by Bozied, to approve the request. All members voted yes; motion carried. Ordinance No. 13-03 Rezonins- Freeland Addition. A motion was made by Bozied, seconded by Roden, to approve the introduction and first reading of Ordinance No. 13-03, an ordinance rezoning Blocks 7, 8 and 9, Freeland Addition from an Agricultural A District to an Individual I-1 District (Hwy. 14 By-Pass and I-29). Second reading is scheduled for May 27, 2003. Preliminarv Ptat—Moriartv-Edgebrook Addition. A motion was made by Bezdichek, seconded by Bozied, to a�prove a revised preliminary plat of a portion of Moriarty- Edgebrook Addition(15 Street South and 17�'Avenue South). All members voted yes; motion carried. Preliminarv Plat—Telkama Addition. A motion was made by Roden, seconded by Bezdichek, to defer action on a revised preliminary plat of a portion of Telkamp Addition (22"a Avenue and 9'� Street)to the May 27�`City Council meeting after another review by the City Planning Commission at their May 20`"meeting to assure compliance with the 2020 Comprehensive Plan. All present voted yes; motion carried to DEFER to May 27, 2003. Preliminarv Plat—Bluegill Addition. A motion was made by Bezdichek, seconded by Whaley, to approve a portion of the preliminary plat of the Bluegill Addition for Lots 1-8 of Blocks 1 and Z, and Lots 1-4 of Blocks 3 and 4 of the NE '/a of Section 1-T109N-RSOW (20th Street South&22°d Avenue South). All members voted yes; motion carried. Preliminary Plat—McClemans Addition. A motion was made by Bezdichek, seconded by Bozied, to approve a preliminary plat of McClemans Addition(20th Street South& 7�` Avenue South). All members voted yes; McClemans abstained, motion camed. Revisions to 1994 Zonias Ordinances. Dan Hanson, Planning and Zoning Administrator, reviewed proposed Zoning Ordinances Amendments. No action was taken. Council Members Oaen Discussion. Questions were raised regarding city regulations in the three mile joint jurisdictional area. It was clarified that any complaints or violations in that area would not be under city cocrtrol. Only zoning issues are involved. Further research on pre-development agreements for large retail businesses was discussed. The process for the three city appointments on the Research Park Steering Committee was discussed. 073 Egecutive Session. A motion was made by Bozied, seconded by McClemans, to enter into Executive Session at 9:04 p.m. regarding Diane Kriese vs. Brookings Volunteer Firefighters Association with the City Manager, City Attorney and City Clerk present. All members voted yes; motion camed. A motion was rnade by Roden, seconded by Bozied, to return to regular session at 9:42 p.m. All members voted yes; motion carried. No further action was taken. Adiournment, A motion was made by Roden, seconded by Bozied, to adjourn. All present voted yes; motion camed.
