HomeMy WebLinkAboutCCMinutes_2003_02_25 0 �4 $ Brookings City Council February 25, 2003 The Brookings City Council convened on Tuesday, February 25, 2003, in regular session at 5:30 p.m. at City Ha11 with the following members present: Mayor Virgil Herriott, Council Members Tom Bozied, Doris Roden, Zeno W. Wicks III, Scott Munsterman, Sam Artz and Mike McClemans. City Manager Mike Williams, City Attorney Steve Britzman, and Shari Thornes, City Clerk, were also present. Consent Agenda. The public hearings on Ordinances 04-03 and OS-03 were postponed until March 11, 2003. Action on Resolution No. 15-03 was removed from the consent agenda. A motion was made by Wicks, seconded by McClemans, to approve the consent agenda, which includes adoption of the agenda; adoption of the February 10& 11, 2003 minutes; and appointment of Carol Sprenger to the Traffic Safety Committee. All present voted yes; motion carried. Resolution No. 15-03—Budget Amendment. A motion was made by Wicks, seconded by Bozied, to approve Resolution No. 15-03. All present voted yes; motion carried. Passed and approved this 25th day of February, 2003. 049 Ordinance No. 02-03—Off-sale Malt Beverage Sales on Sundavs. Introduction and first reading was held on Ordinance No. 02-03, an ordinance amending Section 6-4 of the revised Ordinances of the City of Brookings pertaining to sales of off-sale malt beverages on Sundays. Motion was made by Roden, seconded by McClemans, to approve the first reading. All present voted yes, except Bozied, Munsterman and Wicks voted no, motion carried. Second reading is scheduled for March 11,2003. Resolution No. 14-03—2003-02STA. A public hearing was held on Resolution No. 14-03, a resolution regarding Street Improvement Project No. 2003-02STA, Western Avenue from 8�' Street South to the Quarter Line. All present were given an opportunity to be heard. Motion was made by McClemans, seconded by Munsterman, to approve Resolution No. 14-03. All present voted yes; motion carried. RESOLUTION NO. 14-03 PROPOSED STREET ASSESSMENT PROJECT 2003-02STA BE IT RESOLVED by the City Council of the City of Brookings, South Dakota, as follows: The City Council of the City of Brookings hereby declares the necessity of construction of the collector streets of the City as follows: Grading, curb and gutter, gravel basecourse and asphalt paving for a total street width of forty one(41) feet on the collector street listed below. A. Western Avenue from 8�`Street South, South to the Qa�rter line(approz.2640 feet). 1. The general nature of the improvement is above set forth and reference for details is hereby made to the drawings and specifications prepared by the City Engineer and on file with the City Clerk. 2. The material to be used is concrete for curb and gutter and the following materials for paving of the street: One and one-half inch(1 '/2") asphalt surface course on a two and one-ha.lf inch (2 '/2")asphalt base course on eight(8)inches of crushed gravel for the forty one (41')foot wide collector street. 3. The improvement is substantiatty uniform. The estimated cost of curb and gutter is $14.00 per linear foot of curb and gutter or$28.00 per linear foot of street. The estimated cost per linear foot of streets for paving with a one and one-half inch bituminous mat on a one and one-half inch asphalt stabilized base course on a six(6) inch crushed gravet base course to be paved to a width of 31 feet back to back of curb is $60.00 or$30.00 per side of street. This is the estimated cost of a regular residential street and is the estimated assessable cost. Therefore, the proposed estimated assessment per foot of property is $44.00. The City will assume and pay, from the general funds, for any e�rtra thickness required in excess of that described for minor streets and for the extra width in excess of 31 feet back to back of the curb. The cast of improvements to street intersections and the long side of comer lots will be assessed to benefited properties. T'he cost of improvements will be apportioned to a.11 assessable lots and tracts of land lying within one-half block or 300 feet of the street being improved, whichever is less. 4. A description of classes of lots to be assessed is as follows: The assessable lots and tracts of land lying within one-half black or three hundred feet of the streets hereinabove described, whichever is less. 5. The method of apportionment of benefits is as follows: The cost thereaf to be assessed against all assessable lots and tracts of land according to the benefits determined by the governing body to accrue to all such lots and tracts from the construction of the improvement. o � o 6. The above-described improvement shall be hereinafter referred to at Street Improvement Project No. 2003-02STA, which shall be deemed a description of the improvement of the streets as hereinabove set forth. Ordinance No. 06-03—Amendment to Section 82-372 of the City Code . A public hearing was held on Ordinance No. 06-03, an ordinance amending Section 82-372 of the City Code of Ordinances pertaining to designated through streets. All persons were given an opportunity to be heard. A motion was made by Wicks, seconded by Munsterman, to approve Ordinance No. 06-03. All present voted yes; motion carried. Ordinance No. 07-03 — Conditional Use Permi� Introduction and first reading was held on Ordinance No. 07-03, an ordinance on an application for a conditional use permit to establish a boazdinghouse on Lot 7, except the N10' of the W25'thereof, Block 3, Hill Park Addition. Motion was made by Artz, seconded by McClemans, to approve the first reading. All presern voted yes; Wicks abstained, motion cairied. Second reading is scheduled for March 11, 2003. Council Members Oaen Discussion. • 125�'Citv Anniversarv. Roden noted that in 2004 Brookings will celebrate its 125�`anniversary. The City Manager was asked to contact key organizations and individuals in the community regarding their interest in a community planning committee. • Research Park Roden also suggested the City Manager facilitate getting interested parties together to assist in moving the Research Park project forward. • Militarv Familv Sunnort. Munsterman asked the City Mana�er to do research an the current needs and support mechanism for military families in this area to see if there are any gaping holes in the support mechanism. He asked Williams to specifically look at what the city can do to help military families and come back with a recommendation to the Council. • Volunteer Emergencv Groua. Munsterman expressed concern regarding the availability of manpower in the community should a crisis occur now that the National Guard has been deployed. He asked the City Manager to research that availability and asked the Council to consider establishing a volunteer manpower group in the interim. A motion was made by Munsterman, seconded by Bozied, to adjourn. All present voted yes; motion carried.
