HomeMy WebLinkAboutCCMinutes_2002_11_12 o � o , Brookings City Council November 12, 2002 The Brookings City Council convened on Tuesday,November 12, 2002, in regular session at 5:30 p.m. at City Hall with the following members present: Mayor Virgil Herriott, Council Members Sam Artz, Tom Bozied, Doris Roden, Zeno W. Wicks III, Scott Munsterman and Mike McClemans. Acting City Manager Allyn Frerichs, City Attorney Steve Britzman, and Jan Duchscherer, filling in for City Clerk were also present. Resolution No 59-02—Canvassins November 5, 2002 Etection. A motion was made by Roden, seconded by Munsterman, to approve Resolution No. 59-02, canvassing the November 5, 2002 Municipal Election ballot. All present voted yes; motion carried. RESOLUTION No. 59-02 Canvassing the November 5, 2002 Special Municipal Election WHEREAS, on the Sth day of November, 2002, there was held in the City of Brookings, South Dakota, an election for the purpose amending the Brookings City Charter, and WHEREAS, the judges and clerks of said election have returned to the City Council of the City of Brookings the official results for the purpose of the official canvass, and WI�REAS, the City Council on November 12, 2002 has canvassed the results for the purpose of deternuning the official election outcome, and NOW, THEREFORE, BE IT HEREBY RE50LVED By the City Council of the City of Brookings, South Dakota, that the official vote at the special City Election held November 5, 2002 was as follows: For Against Under Over Total Votes Votes Ballots Ca�t, Precinct 1 344 115 64 0 �2�J Precinct 2 640 229 70 0 939 Precinct 3 638 243 114 0 995 Precinct 4 1132 316 135 0 15$3 Precinct 5 1195 354 148 0 1697 Precinct 6 756 213 74 0 1043 Totals 4705 1470 605 0 6780 Dated at Brookings, South Dakota, this 12th day of November 2002. Consent Asenda. Agenda Item# 10, Ordinance No. 26-02, was withdrawn from the agenda. It was deferred until the December 10, 2002 meeting. A motion was made by Artz, seconded by Bozied, to approve the consent agenda, which included; adoption of the agenda as amended; approval of the October 28, 2002 minutes and November 5, 2002 minutes; action on Resolution 56-02, fixing time and place for hearing upon assessment roll for Street Assessment Project No. 2002-02STA; and Resolution 5?-02, fixing time and place for hearing upon assessment roll for 2002-03 STA. All present voted yes; motion carried. RESOLUTION NO. 56-02 RESOLUTION FIXING TIlVIE AND PLACE FOR HEARING UPON ASSESSMENT ROLL FOR STREET ASSESSMENT PROJECT NO. 2002-02STA Alley from 7`" St. to 8`� St. between 2"d Ave. and Main Ave. BE IT RESOLVED by the City Council of the City of Brookings, South Dakota, as follows: 1. The assessment roll for Street Assessment Project No. 2002-025TA having been filed in the office of the City Manager on the 4�' day of November 2002, the City Council sha11 meet in the Council Chambers, City Ha11, in said City on Tuesday, the 26�'day of November, 2002, at 5:30 o'clock PM, the said date being not less than twenty(20) days from the filin�of said assessment roll for hearing thereon. 2. The City Engineer is authorized and directed to prepare a notice describing, in general terms Street Assessment Project No. 2002-OZSTA, the date of filing the assessment roll, the time and place of hearing thereon, stating that the assessment roll will be open for public inspection at the office of the City Engineer and referring to the assessment roll for further particulars. 3. The City Clerk is authorized and directed to publish said notice in the official newspaper at least one (1)week prior to the date set for hearing and to mail a copy thereof, by first class mail addressed to the owner or owners of any property to be assessed at his, her or their last mailin�address as shown by the records of the Director of Equalization at least one(1)week prior to the date set for said hearing. RESOLUTION NO. 57-02 RESOLUTION FIXING TIME AND PLACE FOR HEARING UPON ASSESSMENT ROLL FOR STREET ASSESSMENT PROJECT NO. 2002-03STA Alle from 14�'Ave. to 16�'Ave. between 2nd St. and 3�d St. O � � Y BE IT RESOLVED by the City Council of the City of Brookings, South Dakota, as follows: 1. The assessment roll for Street Assessment Project No. 2002-03 STA having been filed in the office of the City Manager on the 4�'day of November 2002, the City Council shall meet in the Council Chambers, City Hall, in said City on Tuesday, the 26�'day of November, 2002, at 5:30 o'clock PM, the said date being not less than twenty (20) days from the filing of said assessment roll for hearing thereon. 2. Passed and approved this 12�`day of November 2002. PRESENTATIONS: Downtown Brookinss Board Report. Mark Kratochvil, Downtown Brookings Board President, submitted a report of the Board's recent activities. No action was taken. SDSU Representative Report. Mike Whitford, Student Association member, was present and reported of recent activity and upcoming events. No action was taken. Dialvsis Fundin�—Dr. Scottv Roberts & Don Boone. A motion was made by Munsterman, seconded by Wicks to donate $50,000 to the Dialysis Fund. The monies are to be taken out of second penny funds. All present voted yes; motion carried. RDINANCES: rdinance No. 25-02—Ordinance Recodification. A motion was made by Wicks, seconded by Bozied, to pprove the first reading of Ordinance No. 25-02, an ordinance adopting a new code for the City of Brookings, South Dakota; providing for the repeal of certain ordinances not included therein; providing a penalty for the violations thereof; providing for the manner of amending such code; and providing when such code and this ordinance shall become effective. All present voted yes; motion carried. (second reading set for November 26, 2002). Ordinance No. 27-02—Conditional Use—Catholic Church. A motion was made by Munsterman, seconded by Roden, to approve the first reading of Ordinance No. 27-02, an ordinance approving an application for a conditional use pernut to establish a community center, an apartment, and an office on Lots 1-8, Block 5, Skinners Second Addition, also known as the former St. Thomas More Catholic Church. All present voted yes; motion carried. (second reading set for November 26, 2002). Ordinance No. 28-02—Rezone. A motion was made by McClemans, seconded by Munsterman, to approve the first reading of Ordinance No. 28-02, an ordinance approving a rezoning of property described as the E285', S30' of Lot l; the E285' of Lot 2; and the W255', E540', 5200' of Lot 2, Block 5, Bidco Addition from an Industrial I-2 District to a Business B-3 District. AII present voted yes; motion carried. (second reading set for November 26, 2002). Adiournment. A motion was made by Munsterman, seconded by Bozied, to adjourn. All present voted yes; otion carried.
