Brookings City Council
January 28, 2014
The Brookings City Council heid a meeting on Tuesday,January 28, 2014 at 6:00 p.m., at City
Hall with the following members present: Mayor Tim Reed, Council Members Mike
McClemans, Ope Niemeyer, Keith Corbett,John Kubal and Tom Bezdichek. Council Member
Jael Thorpe was absent. City Attorney Steve Britzman, City Manager Jeffrey Weldon and City
Clerk Shari Thornes were also present.
6:00 p.m. Regular Council Meeting
Consent A�enda. A motion was made by Kubal, seconded by Niemeyer,to approve the
consent agenda.
A. Action to approve the agenda.
B. Action to approve the January 14 Council Meeting Minutes.
C. Action on Resolution No. 07-14, a Resolution directing preparation of Assessment Roll,
dividing Assessments into Installments, and providing for the collection thereof for
Sidewalk Assessment Project 2013-015WR(2013 Sidewalk Repairs).
Resolution No. 07-14- Resolution directing preparation of Assessment Roll, dividing
Assessments into Installments, and providing for the collection thereof for
Sidewalk Assessment Project 2013-01SWR (2013 Sidewalk Repairs)
Be It Resolved by the City Council of the City of Brookings, South Dakota, as follows:
1. More than twenty days have elapsed since the adoption and publication of
Resolution 79-13, Resolution Determining the Necessity of Repairing or Installing
Sidewalks for Sidewalk Assessment Project No. 2013-01SWR. The referendum has not
been invoked, and no written protests against the making of said improvement have
been filed with the City Manager.
2. A contract for Sidewalk Assessment Project No. 2013-01SWR has been duly executed,
and the City Council is authorized to levy special assessments pursuant to the provisions
of chapter 9-43, SDCL 1967, as amended.
3. The City Engineer has caused an estimate of the expense of the work to be made and
filed in City Hall showing the total cost of said improvement as follows: Contract Price
of$117,950.02; Engineering, inspection,�scal, legal expense, publication expense of
$357.02 for a Total Expense of$118,307.04.
4. The total cost of said improvement shall be paid as follows: Gity Repair Costs of
$112,066.59, and Assessable costs of$5,883.43.
5. There shall be made and filed in the office of the City Clerk an assessment roll for said
improvement. The assessments shall be on the basis of benefits upon each lot or tract
of land contiguous to the sidewalk constituting said improvement.
6. The assessment shall be divided into flve (5) equal annual installments for all
amounts over$300.00. For amounts of$300.00 or less,the entire assessment shall be
due. •
7. Unless paid to the City in advance of maturity,the assessments shall be collected by
the City Manager in accordance with the procedure for Plan One in Chapter 9-43,SDCL
1967, as amended.
8. The interest rate to be borne by the unpaid installments of the special assessment is
ten percent (10%).
D. Action to abate the 2014 Drainage Fees for the following properties owned by SDSU
Foundation: 711 11th Avenue (40500-00200-014-00) in the amount of$33.42, 715 11tn
Avenue (40500-00200-015-00) in the amount of$40.50, 72811th Avenue (40500-00500-
007-00) in the amount of$31.90, 71414th Avenue (40525-00200-005-00) in the amount
of$33.42, and 70014th Avenue (40525-00200-008-00) in the amount of$33.42.
E. Action to abate a portion of the 2014 Drainage Fees for the following property owned
by Mike and Susan Dorn: 173 32"d Avenue South (40597-00100-002-00) in the amount
of$575.97.
F. The Brookings City Council authorizes the City Clerk to proceed with plans to operate
the proposed April 8, 2014,Joint City/School Election as a "Voting Center Election"
rather than a "Voting Precinct Election."
All present voted yes, except Reed abstained, motion carried.

Presentation: 2013 Dr. Martin Luther Kin�,Jr. Day Awards. The theme for the poster contest
was "Be the peace you wish to see in the world." and the theme for the essay contest was "As
we celebrate the 50th Anniversary of the March on Washington, we would like the students to
write a letter to Dr. King describing the impact of that event and what are the continuing civil

Resolution No. 10-14. A motion was made by Niemeyer, seconded by Corbett,to approve
Resolution No. 10-14, a Resolution awarding the contract for Dakota Nature Park
Improvements—Phase VI. No public comment. All present voted yes; motion carried.
Resolution No. 10-14- Resolution Awarding Bid for the Dakota Nature Park Improvements—
Phase VI
Whereas,the City of Brookings held a bid (etting at 1:30 p.m. on Tuesday,January 21, 2014; and
Whereas,the City of Brookings has received the following bid for Dakota Nature Park
Improvements—Phase VI: Clark Drew Construction, Inc. in the amount of$357,250.00.
Now Therefore, Be it Resolved that the bid from Clark Drew Construction, Inc. of Brookings in
the amount of$357,250.00 be accepted.
Resolution No. 08-14. A motion was made by Corbett, seconded by McClemans, to approve
Resolution No. 08-14, a Resolution authorizing Change Order No. 1 (CCO#1 Final)for 2013-
07STI Freight-On-Board Project; Bowes Construction, Inc. No public comment. All present
voted yes; motion carried.
Resolution No. 08-14-A Resolution Authorizing Change Order No. 1 (CCO#1 Final) for
2013-07STI Freight On Board Project; Bowes Construction Inc.
Be It Resolved by the City Council that the following change order be allowed for 2013-07STI
Freight on Board Project: Construction Change Order Number 1 Final
Adjust estimated bid quantities to "as-built" quantities for a total increase of$24,800.47 to
close out the project.
First Readin�—Ordinance No. 01-14. A first reading was held on Ordinance No. 01-14, an
Ordinance amending Article !I of Chapter 22 of the Code of Ordinances of the City of Brookings
and pertaining to the 2009 Building Code with Certain Amendments Thereto. Public Hearing:
February 11, 2014.
Adiourn. A motion was made by Corbett, seconded by McClemans, to adjourn. All present
voted yes; motion carried. Meeting adjourned 7:14 p.m.
