Roll Call by Clerk. Consent Agenda Items: Adoption of the agenda. Approval of minutes. Action on Resolution No. 04-04, a resolution waiving the fees of park and recreation programs for military service personnel and their families. Action on bids for police cars. Action on Resolution No. 01-04, a Resolution Directing the Preparation of Assessment Roll, Dividing Assessments into Installments, and Providing for the Collection Thereof for Sidewalk Assessment Project 2003-01SWR (2003 Sidewalk Repairs). Action on Resolution No. 05-04, a resolution approving an Agreement for Purchase of a Wheel Loader for the Solid Waste Fund. Action on Resolution No. 06-04, a resolution declaring Fire Department 32 ISI Self contained breathing apparatus units as surplus. Action on an appointment to the Brookings Historic Preservation Commission. Action on a request for an abatement received from St. Thomas More Catholic Church, for Lot 13, Early Addition, for a portion of the 2003 property taxes in the amount of $2,152.17. The County Assessor recommends approval. Action on a request for an abatement received from St. Thomas More Catholic Church, for Lot 30, Block 5, Hyland Addition, for a portion of the 2003 property taxes in the amount of $2,333.43. The County Assessor recommends approval. Action: Motion to approve the consent agenda - Roll Call Invitation for a citizen to schedule time on the Council agenda for an issue not listed. Public hearing and action on Ordinance No. 48-03 an application for a Conditional Use Permit to establish a boardinghouse on Lot 1, Block 1, Larson’s Addition (915 7th Street). Action: Open and close public hearing, Motion to approve, Roll Call 8. Introduction and first reading on Ordinance No. 03-04, on conditional use permit for a community center for the senior citizen center at the Elks location, 516 4th Street. Action: Motion to approve, Request public comment, Roll Call Second Reading on February 10th 9. Introduction and first reading on Ordinance No. 01-04, on a conditional use permit for a boardinghouse on the west ½ of Lots 1 and 2, Block 3, Saunders Addition, 628 14th Avenue. Action: Motion to approve, Request public comment, Roll Call Second Reading on February 10th Alcohol Applications: 10. Public hearing and action on an on-off sale malt beverage application from Gonz Productions, Inc. (dba Lodo), Garner Hanson, Owner, located at Lot 5, Block 7, Original Plat Addition, also known as 408 Main Avenue. Action: Open and close public hearing, motion to approve, Roll Call Ordinances – Budget/Revenue: 11. Introduction and first reading on Ordinance 04-04, a budget amendment for 2004 on city general critical needs. Action: Motion to approve first reading, Request Public Comment, Roll Call 2nd reading scheduled for February 10th 12. Second reading and action on Ordinance 02-04, an Ordinance amending Section 78-38(A)(2) of the Code of Ordinances of the city of Brookings, South Dakota and pertaining to the use of Municipal Sales and Service and Use Tax Revenue for Public Safety Vehicles and Equipment in the City of Brookings, South Dakota. Action: Motion to approve, Request Public Comment, Roll Call 13. Action to authorize the City Manager signing a purchase agreement for the former Elks Lodge. Action: Motion to approve - Roll Call 14. Action to authorize the City Manager signing a contract with Banner Associates Inc. for Engineering Services for the Senior Citizen Center. Action: Motion to approve - Roll Call 15. Action on Resolution 03-04, a resolution for the use of contingency funds for hiring of the city manager. Action: Motion to approve - Roll Call 16.
