Resolution for Amendment No. 1 to Agreement No. 713475
Between South Dakota Department of Transportation and City of Brookings
Bike Trail Project POENH(147) PCN 00C2 & EM 8006(49) PCN 010A
WHEREAS, the City of Brookings has identified the need to complete its multi-use trail
system for adequate transportation; and
WHEREAS, it has been determined by the State of South Dakota that the project is eligible
for Transportation Enhancement Funding and High Priority Funds;and
WHEREAS, the City of Brookings is the sponsoring applicant for funds; and
WHEREAS, the City is capable of administering the federal aid project;and
WHEREAS, the funding level for the high priority project EM 8006(49) PCN 010A has
been increased to $90,613.77; and
THEREFORE, BE IT RESOLVED that the City of Brooking duly authorizes the Mayor of
the City of Brookings to sign Amendment No. 1 to Agreement No. 713476 between South Dakota
Department of Transportation and the City of Brookings.
This resolution is effective immediately upon passage.

AMENDMENT NO. 1 TO AGREEMENT NO 713476
BETWEEN
SOUTH DAKOTA DEPARTMENT OF TRANSPORTATION
AND
CITY OF BROOKINGS
WHEREAS, on July 18, 2007, the State of South Dakota, acting by and through its Department of
Transportation, hereinafter referred to as "STATE," and the City of Brookings, South Dakota, hereinafter
referred to as "CITY," entered into a Transportation Enhancement Agreement to construct Transportation
Enhancement project Number P OENH(147) PCN 00C2 and High Priority Project EM 8006(49) PCN 010A
which agreement hereinafter referred to as "AGREEMENT," was signed by representatives of each party
and assigned agreement number 713476 by the STATE; and,
WHEREAS, STATE and CITY wish to amend the AGREEMENT;
NOW, THEREFORE, the parties mutually agree as follows:
Paragraph A.2 shall be revised to read as follows:
2. Reimburse CITY 81.95% for eligible PROJECT costs up to a maximum of Five Hundred Eighty-
nine Thousand, Six Hundred Thirteen Dollars and Seventy-seven Cents ($589,613.77). This
includes Four Hundred Ninety-nine Thousand Dollars ($499,000) in TE Funds and Ninety
Thousand, Six Hundred Thirteen Dollars and Seventy-seven Cents ($90,613.77) in HPP Funds.
The remaining 18.05% and any amount exceeding the maximum amount of TE and HPP funds
shall be paid by the CITY.
CITY and STATE agree that all other terms of the original AGREEMENT shall remain in full force and effect.
The CITY has designated its Mayor as the CITY'S authorized representative and has empowered its Mayor
with the authority to sign this Amendment on behalf of the CITY. A copy of the CITY'S Commission minutes
or resolution authorizing the execution of this Amendment by the Mayor as the CITY'S authorized
representative is attached hereto as Exhibit 2
