Resolution Rescinding Resolution No. 109-09 and
Pertaining to the Annexation of Property in the City of Brookings.
Be It Resolved by the City Council of the City of Brookings, South Dakota as follows:
Whereas, Resolution No. 109-09 concerns the annexation of property to the City of
Brookings, and
Whereas, it has been determined that the Petition for annexation was not signed by the
owners of at least three-fourths of the value of the territory sought to be annexed, and
Whereas, State law, particularly SDCL 9-4-I, requires that the Petition for annexation
be signed by the owners of at least three-fourths of the value of the territory sought to be
annexed,
Now, Therefore, based upon the foregoing determination, it is appropriate and
necessary to rescind Resolution No. 109-09, and accordingly,
It Is Hereby Resolved by the City Council of the City of Brookings, South Dakota,
that, upon passage and publication of this Resolution, that Resolution No. 109-09 is hereby
rescinded and of no force or effect.
Passed and approved on the 12`h day of January, 2010.
