HomeMy WebLinkAboutOrdinance 22-2000 t , fl ' ORDINANCE NO.22-00 AN ORDINANCE AMENDING CHAPTER 22 OF THE REVISED ORDINANCES OF THE CITY OF BROOKINGS AND PERTAINING TO LICENSES. BE IT ORDAINED AND ENACTED BY THE COUNCIL OF THE CITY OF BROOKINGS,STATE OF SOUTH DAKOTA,AS FOLLOWS: I. ARTICLE I. IN GENERAL Sec.22-1.Required. It shall be unlawful for any person to engage in any trade,business or occupation within the city for which a city license is required by any provision of city ordinance without first having obtained such license. Sec-22-2. Licensed activities,trades,occupations and businesses. The following activities,trades,occupations and businesses are regulated under this chapter: (a)circuses,carnivals (b)commercial garbage haulers (c)housemovers (d)pawnbrokers (e)plumbing contractors (f)vehicles for hire (g)vehicle for hire drivers Set.22-3.Application generally. Except as otherwise provided,an applicant for a city license shall make and file an application in writing with the city clerk on the prescribed form. Such application shall contain such information as required by the licensing authority or as required by city ordinance and shall state that the applicant is eligible for the license for which application is made.If required,the applicant shall sign the application under oath in the presence of a notary public. Sec.22-4.Form of application. Unless otherwise provided,an application for a city license shall state the following: (a) Name and address of applicant. (b) Trade name, if any,of applicant. (c) If a partnership, limited liability partnership or limited liability company,the name and address of each partner or member. (d) If a corporation,the name and address of each officer. • (e) Place of business of applicant. (f) Description of the activity to be performed by the applicant. (g) Such information as required by city ordinance or by the city manager showing the applicant is entitled to the license and the place of business is a proper place for the exercise thereof. (h) Such information as required by city ordinance as may be necessary for determination of the amount of the license fee. Sec.22-5. Payment of license fee,issuance. Except as otherwise provided,an applicant for a city license shall pay the amount of the license fee to the city at the time the application is submitted. The city clerk will present the application to the city manager for approval except as otherwise provided.Upon approval,the city clerk shall issue the license.Unless otherwise provided,all licenses shall be signed by the city manager and shall have affixed thereto the official seal of the city.If the license is refused,the fee shall be refunded. Sec.22-6.Approval of security. Any bond,liability insurance or deposit required as a condition of the issuance of any city license shall be subject to the approval of the city manager,and in the event the city manager deems the security inadequate,new or additional security may be required. Sec.22-7.Term. Unless otherwise provided,all licenses shall take effect when issued and shall terminate on December thirty-first in the year for which issued.Except as otherwise provided,the license fee shall be paid on the basis of a full year. Sec.22-8.Display required. Every person to whom a license is issued by the city shall keep the same posted in a conspicuous place in the licensed place of business or vehicle or if there is no place of business or vehicle,then the licensee shall exhibit the license upon request by a city official,police officer or other authorized representative of the city. Sec.22-9.Displaying license unlawfully. No person shall carry or display any city license or permit which has been terminated or revoked or which has not been lawfully procured and issued. Sec.22-10.Change of name. If a licensee changes the name or form of organization under which it does business,the license may be submitted to the city clerk for amendment without payment of an additional fee except as otherwise provided by law. Sec.22-11.Revocation. The city manager shall have power to revoke and cancel any license issued by the city for failure of the licensee to comply with any provision of city ordinance or other regulation of the city or state law concerning such licensed activity,trade,business or occupation or for other good cause after hearing,upon notice to the licensee. Upon conviction of a violation of any provision of city ordinance relating to the exercise of such license,the court, in addition to other penalties imposed,may enter its judgment canceling such license. Secs.22-12--22-24.Reserved. ARTICLE IL LICENSE FEE SCHEDULE Sec.22-25.Generally. A license fee shall be required for the activities,trades,occupations,businesses and professions listed in Section 22-2 of this chapter and conducted or pursued within this city.The license fee shall be set by Resolution of the City. Secs.22-26--22-34.Reserved. II. Any or all ordinances in conflict herewith are hereby repealed.
