AN ORDINANCE ESTABLISHING REVISED GENERAL LIABILITY LIMITS FOR
ALCOHOLIC BEVERAGE OPERATING AGREEMENTS IN THE CITY OF BROOKINGS,
SOUTH DAKOTA.
BE IT ORDAINED AND ENACTED BY THE COUNCIL OF THE CITY OF
BROOKINGS, STATE OF SOUTH DAKOTA, AS FOLLOWS:
Sec. 5-10. Minimum Liability Insurance Limits
I.
All current and future Operating Agreements between the City and parties designated
"Manager" shall be subject to the following revised insurance limits:
General liability insurance protecting both the City and Manager against claims for injury
or damages to persons or property, said policy to have general liability limits of at least Five
Hundred Thousand Dollars ($500,000.00) single limit,and One Million Dollars($1,000,000.00)
aggregate, and a limitation of Fifty Thousand Dollars ($50,000.00) for damage to property. The
general liability insurance limits are subject to change and Manager agrees to change limits of
insurance if required by the City;
II.
The effective date of this ordinance shall be twenty (20) days after publication of this
ordinance. All Operating Agreements shall be subject to the change in general liability insurance
established by this ordinance as of the effective date of this ordinance.
III.
Any or all ordinances in conflict herewith are hereby repealed.
