AN ORDINANCE AMENDING ORDINANCE SECTION 5-8 AND
PERTAINING TO MARKUP PERCENTAGES ON SALES OF ALCOHOLIC
BEVERAGES IN THE CITY OF BROOKINGS, SOUTH DAKOTA.
BE IT ORDAINED AND ENACTED BY THE COUNCIL OF THE CITY OF
BROOKINGS, STATE OF SOUTH DAKOTA, AS FOLLOWS:
I. Ordinance Section 5-8 is amended as follows:
Sec. 5-8. Markup percentage on sale of alcoholic beverages.
(a) The City shall charge and collect a markup of eleven(11 %)percent above
the municipality's costs of malt beverages, plus freight, for all malt beverages sold
within the city. The markup percentage shall apply to all licensees of the city and
also to all malt beverages, whether purchased for on-sale or off-sale purposes.
(b) The City shall charge and collect a markup of twelve (12 %)percent
above the municipality's costs of distilled spirits and wine, plus freight, for all
distilled spirits and wine sold within the city. The markup percentage shall apply
to all licensees of the city and also to all distilled spirits and wine, whether
purchased for on-sale or off-sale purposes.
II. The effective date of this ordinance shall be twenty (20) days after
publication of this ordinance. All Operating Agreements shall be subject to the
change in markup percentages established by this ordinance as of the effective
date of this ordinance. Any or all ordinances in conflict herewith are hereby
repealed.
