HomeMy WebLinkAboutOrdinance 47-2003 Ordinance No. 47-03 An Ordinance Amending Section 14-126 Of The Ordinances Of The City Of Brookings, South Dakota And Pertaining To Biting Dogs. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, AS FOLLOWS, TO-WIT: I. Sec. 14-126. Biting dogs. (a) A dog that has bitten any person or domestic animal, or has exhibited a propensity to attack or bite human beings or domestic animals (when this propensity to attack or bite human beings or domestic animals is known to the owner) shall not be allowed off the premises of its owner unless muzzled and on a leash in the control of the owner or a member of the owner's immediate family who is over 16 years of age. Provided, however, no dog that has bitten, or has exhibited a propensity to attack or bite a human being or domestic animal shall be declared to be a biting dog solely because it bites, attacks or menaces a trespasser or a domestic animal running at large on the property of the person who owns, keeps, harbors or possesses the dog. (b) Any dog that has been declared to be a biting dog and is subsequently found off the premises of its owner and not mnz7led and on a leash controlled by an appropriate person may be seized by any person and, upon delivery to the proper authorities, may, upon establishment of the biting character of such dog, be humanely disposed of by an animal control officer or other person authorized by the city manager. (c)A complaint may also be issued for violation of this ankle ordinance. H. All ordinances in conflict herewith are hereby repealed.
