An Ordinance Amending Article H Of Chapter 62 Of The Code Of Ordinances Of The
City Of Brookings, South Dakota To Increase The Number Of Members Of The Park And
Recreation Board To Include A High School And College Student And Make Related
Changes To Terms Of Office, Quorum And Required Affirmative Vote.
BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS,
SOUTH DAKOTA, AS FOLLOWS, TO-WIT:
I.
Sec. 62-31. Established.
There is created in and for the city a board which shall be known as the park and
recreation board.
Sec. 62-32. Composition.
The park and recreation board shall be composed of nine members,with one member who
is a high school student and one member who is a college student.
Sec. 62-33. Appointment.
The members of the park and recreation board shall be appointed by the mayor with the
advice and consent of the city council.
Sec. 62-34. Terms of office.
Members of the park and recreation board shall serve five-year terms, except the high
school and college student members shall be appointed for terms of one year each. The terms of
office for members serving five-year terms shall be established so the term of one member shall
expire each year for three years, and the terms of two members shall expire each year for two
years. All terms shall expire on the date of the first regular meeting of the city council in May.
Sec. 62-35. Filling of vacancies.
If a vacancy occurs on the park and recreation board prior to the expiration of a term, the
mayor, with the advice and consent of the city council, shall appoint a member to fill such
vacancy for the unexpired portion of the term.
Sec. 62-36. Powers and areas of responsibility.
The park and recreation board will provide advice to the director of parks and recreation
to assist in fulfilling the responsibilities of administering the public park system, recreation
programs and city forestry program. The park and recreation board shall also advise the city
council and make recommendations on matters regarding park capital improvements and
planning.
Sec. 62-37. Compensation.
Members of the park and recreation board shall receive no compensation for performing
their duties as members of such board.
Sec. 62-38. Election of officers.
The park and recreation board shall annually, at its regular meeting in June, elect from its
number a president, a vice-president and a secretary, each of whom shall serve for a term of one
year, or until a successor is elected and qualified. The vice-president shall act in the absence or
disability of the president. In case of death or retirement of an officer, a successor shall be
elected immediately.
Sec. 62-39. Duties of the secretary.
The secretary shall maintain a record of the acts and proceedings of the park and
recreation board, which shall be submitted to the city manager.
Sec. 62-40. Meetings.
The regular meeting of the park and recreation board shall be held at least once a month
at a time and place to be determined by resolution of the park and recreation board. Special
meetings may be called at any time by the president of the board upon at least 24 hours'notice to
members of the park and recreation board and the media.
Sec. 62-41. Quorum.
Five members of the park and recreation board shall constitute a quorum for the
transaction of business.
Sec. 62-42. Required affirmative vote.
An affirmative vote of at least five members shall be necessary to authorize any action of
the park and recreation board.
Sec. 62-43. Regulation of proceedings.
Subject to the approval of the city council, the park and recreation board shall make
bylaws, rules and regulations for the orderly transaction and conduct of its business.
Sec. 62-44. Budget.
The director of parks and recreation shall annually submit to the city manager a proposed
budget of expenditures and revenues for the ensuing year.
Sec. 62-45. Authority of board to establish regulations for use and operation of parks and
public facilities.
The park and recreation board shall establish written regulations pertaining to the use,
hours of operation, fees and charges, maintenance and control of public parks and recreation
facilities in the city. The proposed regulation shall be submitted to the city council for review
and approval.
Sec. 62-46. Violation of regulations established pursuant to division 2 of article III and
division 2 and 3 of article IV of this chapter; penalties.
Violation of the regulations concerning the use and operation of the public parks and
facilities, as such regulations are approved by the city council, shall constitute an offense.

All ordinances in conflict herewith are hereby repealed.
