BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA, AS FOLLOWS, TO-WIT: I. Sec. 74-4 Mailboxes. (a) Definitions. i)Breakaway Mailboxes—Mailboxes which are designed to bend or fall away when struck by a vehicle, such as mailboxes which are constructed with a 4 by 4 wooden gate post, 2 inch tubular steel gate post, one piece plastic mailbox placed upon a 31/2 inch steel sleeve and similar designs which are not constructed of brick and block. ii)Multi-compartment Mailboxes—Mailboxes which typically contain multiple mailboxes for two or more separate residences upon a single post or pedestal. iii)Non-breakaway Mailboxes—Mailboxes which are not designed to bend or fall away when struck by a vehicle. Examples of non- breakaway mailboxes include brick or block mailbox structures and pillar mailbox structures. (b)Permit Required.No person shall construct, use or maintain any non-breakaway mailbox in the City, unless and until permission is granted to construct, use or maintain a non- breakaway mailbox and a written permit has been issued therefor, according to the following procedure. i) Permit exception-Breakaway mailboxes. Mailboxes may be installed without a permit if they are designed to bend or fall away when struck by a vehicle or are Multi-compartment mailboxes serving two or more separate residences. (c)Application. Application for a permit to construct, use or maintain any non- breakaway mailbox shall be made in writing to the City Engineer and accompanied with a complete plan in detail of the proposed non-breakaway mailbox. (d)Approval. i) The City Engineer may, after investigation, approve, modify or reject the application. The City Engineer may require as a condition precedent to the issuance of a permit that the applicant for a non-breakaway mailbox enter into an agreement with the city and agree to hold the city harmless from any damages or expense of any nature sustained by the city or any person or persons by reason of the non-breakaway mailbox for which the permit is issued. ii)Permits for non-breakaway mailboxes may, after investigation, be approved by the City Engineer if it is determined by the City Engineer that the installation does not create a dangerous or hazardous situation. (e)Issuance of permit; records. Upon approval of an application for a non-breakaway mailbox permit by the City Engineer, the City Engineer shall, upon execution of an agreement, collect the payment of the fee for the permit and issue the permit and retain a record thereof. The permit issued shall set forth in detail any requirements imposed by the City Engineer in granting the permit. (f) Revocation. The City Engineer may at any time revoke any permit issued under and by virtue of the terms of this ordinance when the privilege granted thereunder conflicts with the city's use of the streets, alleys or sidewalks, notwithstanding the existence of any contract or agreement to the contrary. II. All ordinances in conflict herewith are hereby repealed.
