HomeMy WebLinkAboutOrdinance 27-2004 ORDINANCE NO. 27-04 AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF BROOKINGS AND PERTAINING TO THE FLOODWAY DISTRICT, BUSINESS DISTRICT SETBACK REGULATIONS AND ACCESS DRIVES FOR PURPOSES OF ADMINISTRATION OF THE ZONING ORDINANCE. BE IT ORDAINED AND ENACTED BY THE COUNCIL OF THE CITY OF BROOKINGS, STATE OF SOUTH DAKOTA, THAT ARTICLE IV AND VI, CHAPTER 94 SHALL BE AMENDED AS FOLLOWS: ARTICLE IV, DISTRICT REGULATIONS DIVISION 1, GENERALLY Section 94-121 Floodway FW District d. Permitted Special Uses (4) Telecommunications Tower a, Requires "No-Rise" certificate to be filed with FEMA b. Requires engineering study for determining structural stability in a flood. c. Requires all accessory buildings to be constructed one foot (1') above the base flood elevation II. ARTICLE VI. SUPPLEMENTAL REGULATIONS DIVISION 1. GENERALLY Section 94-343(a)1.c. 6. The maximum permitted flare or radius on each side of an access drive shall not exceed 8 feet at the curb be determined by the city engineer based on standard engineering practices. When these requirements cannot be met due to a lack of frontage, the access drive may be located such that the radius or flare will begin at the farthest property line. Section 94-343(a)3.c. 6. YARD REQUIREMENTS Section 94-402 Adjustment to Front Yard Requirements. Residences in the R-1 B residential district established prior to October 23, 1966, with front yard setbacks, which are less than the front yard setbacks required by this ordinance may have additions erected in line with the existing building. In no case shall the front yard setback be less than twenty-five feet (25'). Residences located in the Residence R-1 B District of the Pheasant Nest Addition established prior to March 7, 2002, that have front yard setbacks that are less than the front yard setbacks required by this ordinance may have additions erected in line with the existing building. In no case shall the front yard setback be less than 20 feet. The minimum building setback from the 1-29 right-of-way for any lot in a business district shall be 20 feet. Any or all ordinances in conflict herewith are hereby repealed.
