AN ORDINANCE AMENDING THE ZONING ORDINANCE OF THE CITY OF
BROOKINGS AND PERTAINING TO DEFINITIONS AND YARD REQUIREMENTS
FOR PURPOSES OF ADMINISTRATION OF THE ZONING ORDINANCE.
BE IT ORDAINED AND ENACTED BY THE COUNCIL OF THE CITY OF
BROOKINGS, STATE OF SOUTH DAKOTA, THAT CHAPTER 94 SHALL BE
AMENDED AS FOLLOWS:
I.
Article 1. Definitions
Outdoor Sales: The use of any building, land area, or their premises which
provides for the display and sale of new or used automobiles, panel trucks or
vans, recreational vehicles, camping trailers, modular, manufactured or mobile
homes, boats, utility trailers and storage sheds.
Article VI. Supplemental Regulations
Division 3. Yard Requirements
Sec. 94-405. The Manner of Ownership of Property.
Condominiums, townhouses, single-family zero (0') side yard structures and all
other forms of property ownership do not affect the application provisions of
the regulations set forth in this ordinance, and all requirements of this
ordinance shall be observed as though the property were under single
ownership.
Exception: If a corner lot is occupied by a zero lot line constructed
single-family attached dwelling containing two or more dwelling
units, it may be replatted into two or more lots for the sole purpose
of transfer of ownership. Such replatting shall not affect the building
setback requirements of the originally defined rear and side yards.
Any or all ordinances in conflict herewith are hereby repealed.
