HomeMy WebLinkAboutOrdinance 18-2008 Ordinance No. 18-08 AN ORDINANCE AMENDING SECTION 58-36 OF THE CODE OF ORDINANCES OF THE CITY OF BROOKINGS, SOUTH DAKOTA AND PERTAINING TO FLEEING FROM A POLICE OFFICER IN THE CITY OF BROOKINGS, SOUTH DAKOTA. BE IT ORDAINED BY THE GOVERNING BODY OF THE CITY OF BROOKINGS, SOUTH DAKOTA,AS FOLLOWS,TO-WIT: I. Sec. 58-36. Fleeing from a police officer. (a) It shall be unlawful for any person to willfully fail or refuse to stop, or to otherwise flee when given a visual or audible signal to stop by a police officer. (b) The signal given by the police officer may be by hand,voice, emergency light or siren. (c) The officer giving such signal shall be in uniform,prominently displaying their badge of office. (d) For purposes of this ordinance, the term Police Officer means every officer of the Brookings Police Department, County and State law enforcement officers, and any South Dakota State University law enforcement officer. II. All ordinances in conflict herewith are hereby repealed.
