HomeMy WebLinkAboutCCMinutes_2013_03_1947 Brookings City Council March 19, 2013 The Brookings City Council held a study session on Tuesday, March 19, 2013 at 5:00 p.m., at City Hall with the following members present: Mayor Tim Reed, Council Members Jael Thorpe, John Kubal, Mike McClemans, Tom Bezdichek, Ope Niemeyer and Keith Corbett. City Attorney Steve Britzman, City Manager Jeff Weldon, and City Clerk Shari Thornes were also present. Resolution No. 22 -13. A motion was made by Kubal, seconded by Niemeyer, to approve Resolution No. 22 -13, a Resolution authorizing the execution of Real Estate Agreements of Sale in Sections 27 and 28, T110N, R5OW. All present voted yes; motion carried. Resolution No. 22 -13 - Resolution Authorizing the Execution of Real Estate Transaction Documents in Sections 27 and 28, T110N, R5OW Be It Resolved by the City Council of the City of Brookings, South Dakota as follows: Whereas, for the purpose of acquisition of real property and easements for avigation purposes which are necessary for airport realignment improvements of the City of Brookings, South Dakota, and Whereas, the City of Brookings desires to purchase the following described property: Real Property Acquisitions: 1) Sublot "B" One ( "B I ") in Sublot "B" of Outlot One (1) of the Southwest Quarter of the Northwest Quarter (SW1/4NW'/) and Outlot Two (2) of the Northwest Quarter of the Southwest Quarter (NW1/4SW1/4), All of Section Twenty -seven (27), Township One Hundred Ten (1 10) North, Range Fifty (50) West of the 5th P.M., County of Brookings, State of South Dakota, containing 6.70 acres, more or less. Robert J. Lacher and Jean S. Lacher, Owners, and 2) Tract Two "A" (2A) in Tract Two (2) of James' Addition in Section Twenty -eight (28), Township One Hundred Ten (1 10) North, Range Fifty (50) West of the 5th P.M., County of Brookings, State of South Dakota, containing 0.8 acres, more or less. Voss, Owner Avigation Easement Acquisitions: 1) Sublot "B" Two (B2) in the Southwest Quarter of the Northwest Quarter (SW1/4NW1/4) of Section Twenty -seven (27), Township One Hundred Ten (1 10) North, Range Fifty (50) West of the 5`h P.M., County of Brookings, State of South Dakota. Lacher, Owners, 2) Avigation Easement "A" in Tract One (1) in James' Addition in Section Twenty -eight (28), Township One Hundred Ten (1 10) North, Range Fifty (50) West of the 5th P.M., County of Brookings, State of South Dakota. Voss, Owner, and 3) Avigation Easement "B" in Tract Two "B" (2B) in James' Addition in Section Twenty -eight (28), Township One Hundred Ten (1 10) North, Range Fifty (50) West of the 5th P.M., County of Brookings, State of South Dakota. Jason T. Voss, Owner Whereas, the City of Brookings has received proposed Right -of -Way Agreements from the following landowners: Robert J. Lacher and Jean S. Lacher, and from Jason T. Voss, providing for a total purchase price of the above - described real property and avigation easements of $157,500.00, pursuant to the terms of which are satisfactory to the City of Brookings; Now Therefore, It Is Hereby Resolved by the City Council of the City of Brookings, South Dakota, as follows: A) That the City acquire title and avigation easements to the above - described property pursuant to Right -of -Way Agreements and Avigation Easements with Robert J. Lacher and Jean S. Lacher, and with Jason T. Voss for the purpose of acquisition of the above - described real property and avigation easements for necessary airport improvements; and B) That the Mayor, City Clerk, City Manager and City Attorney are authorized to execute the Right -of -Way Agreements and other required documents in accordance with this Resolution. Discussion topics: City of Brookings Annual Financial Report, Brookings Municipal Utilities Quarterly Financial Report, Swiftel Online Directory Demonstration, and updates from the following Subsidy Groups: East Central Behavioral Health, and Research Park at SDSU / Growth Partnership Board, and council reports. 48 Adjourn.
