Board of Adjustment
Brookings, South Dakota
October 4, 2012
OFFICIAL MINUTES
Vice-chairperson Jim Pederson called the Board of Adjustment meeting to
order on Thursday, October 4, 2012, at 5:00 PM in the Chambers Room at the
City & County Government Center. Members present were Jere Hieb, Jason
Hoffelt, a-Seth Hansen, a-Mary Kidwiler and J. Pederson. Dick Peterson and
David Rusten were absent. Also present were Suzi McKeown, Jim Pickard, John
Mills, Gary Clasen, Community Development Director Mike Struck, Planning and
Zoning Administrator Dan Hanson and others.
Item #1 – (S. Hansen/Kidwiler) Motion to approve the minutes of the August 23,
2012, meeting. All present voted aye. MOTION CARRIED.
Item #2 – (Hoffelt/Hieb) Motion to approve the agenda. All present voted aye.
MOTION CARRIED.
Item #3 – Darrell McKeown has made a request for a variance on Lot 15, Block 11,
Camelot Square Addition , also known as 1212 Breckenridge Lane. The request is
to build five feet (5’) from the rear lot line. The required setback is 25 feet in this
residential district.
(Kidwiler/Hoffelt) Motion to approve the variance. Hoffelt, Hieb, Kidwiler,
and S. Hansen voted aye. J. Pederson voted no. MOTION CARRIED.
Item #4 – South Dakota Outdoor Adventure Center/City of Brookings have made
a request for a variance on the E½ of the SE¼ of Section 1-T109N-R50W , also
known as 2820 22nd Avenue South. The request is to build 47 feet from the front lot
line. The required setback is 100 feet in this Agricultural A District.
(S. Hansen/Hoffelt) Motion to approve the variance. All present voted aye.
MOTION CARRIED.
Item #5 – Heron Cove, LLC has made a request for a variance on Block 13,
excluding the east 10 acres thereof, Parkdale Home Third Addition, also known
as 1050 Western Avenue. The request is to build an accessory building with a
floor elevation of 1,605.5 feet. The required floor elevation in this Special Flood
Hazard Area is 1,607 feet.

(Kidwiler/Hoffelt) Motion to approve the variance. All present voted aye.
MOTION CARRIED.
Item #6 – Gary Clasen has made a request for a variance on Lot 25, Santee
Village, Indian Hills Addition, also known as 121 Santee Trail. The request is to build
22 feet from the rear lot line. The required setback is 25 feet in this residential
district.
(Hoffelt/S. Hansen) Motion to approve the variance. All present voted aye.
MOTION CARRIED.
Item #7 – The City of Brookings has made a request for a variance on Lot 8, Block
6, Bane and Poole Addition, also known as 2128 6th Street. The request is to erect
an area identification sign 86 square feet in size. The maximum size permitted is 16
square feet in a residential district.
(Kidwiler/Hieb) Motion to approve the variance. All present voted aye.
MOTION CARRIED.

SUMMARY OF DISCUSSION
Vice-chairperson Jim Pederson called the Board of Adjustment meeting to
order on Thursday, October 4, 2012, at 5:00 PM in the Chambers Room at the
City & County Government Center. Members present were Jere Hieb, Jason
Hoffelt, a-Seth Hansen, a-Mary Kidwiler and J. Pederson. Dick Peterson and
David Rusten were absent. Also present were Suzi McKeown, Jim Pickard, John
Mills, Gary Clasen, Community Development Director Mike Struck, Planning and
Zoning Administrator Dan Hanson and others.
Item #3 – Suzi McKeown stated that the third stall would provide a space for a
vehicle that was stored outside.
J. Pederson asked if a tree would be removed. McKeown replied yes. J.
Pederson was concerned about the five foot (5’) setback in case of emergency
access to the property. He felt the encroachment into the rear yard was too
great.
Item #4 – Jim Pickard, Chairperson of the SD Outdoor Adventure Center, stated
the proposed building would house the 4-H archery and other shooting sports. It
would be open to the public for classroom instruction too.
S. Hansen inquired about the future addition shown on the plan. Pickard
was unaware of the proposal. D. Hanson noted that the plan was submitted by
the contractor. The requested variance included the future expansion.
J. Pederson asked if the building could be set back further. Pickard was
not sure. D. Hanson remarked that the location of the landfill mound may have
impacted the placement of the building.
Item #5 – John Mills, representing Heron Cove, LLC, stated the project involved
building a storage garage that would serve the apartment complex. He noted
the elevation of Western Avenue was one foot (1’) below the floor elevation of
the garage. An adjacent garage was 3/10ths of a foot below the garage.
Neither the apartments or garages currently on-site had water in them from
previous floods. He added that increasing the elevation would create a severe
slope into the building.

J. Pederson noted the criteria listed for consideration when reviewing a
variance and asked if they were federal in scope. D. Hanson responded that
some of the criteria does not specify the type of flood or floodplain. The Western
Avenue area experienced shallow flooding and sheet flow since the land was
very flat. As a result, flood waters generally had very little force.
Hieb asked if the slopes shown on the diagram were accurate. Mills
replied yes.
Item #6 – Clasen stated that his basement entrance created water problems for
his house so he wanted to eliminate it. He would build an addition with a laundry
room on the main level of the house. He noted that his property was next to a
park in the back.
J. Pederson remarked that the rear lot line angled toward the house so
one corner was closer than the other. He did not see any issues with the request.
Item #7 – Mike Struck, Community Development Director, stated the city was
creating gateway entrance signs at certain locations. Several similar signs were
already constructed around town. The parcel where the sign would be located
was zoned residential and would remain a park through a conservation
easement. The proposed sign would be across from a sign at McCrory Gardens
that was under construction.
Kidwiler asked if the lettering would be the same as it was on the other
signs. Struck replied yes. He added that a planter and landscaping would be
added around the sign. S. Hansen asked if there were any right-of-way issues.
Struck responded that the sign would be about 60 feet from the front lot line.
