OFFICIAL MINUTES
Chairperson David Rusten called the Board of Adjustment to order on
Thursday, July 15, 2010, at 5:08 PM in the Council Chamber at City Hall. Members
present were Larry Klingbile, Dick Peterson, Jay Vanduch, a-Jason Hoffelt, and
Rusten. Matt Kurtenbach, and a- Jim Pederson were absent. Also present were
Kevin Grunewaldt, Ardean Albers, Larry Sax, Ron Brandriet, Dan Neiles, Planning
and Zoning Administrator Dan Hanson and others.
Item #1 – (D. Peterson/Vanduch) Motion to approve the minutes of the July 1,
2010 meeting. All present voted aye. MOTION CARRIED.
Item #2 – (Vanduch/D. Peterson) Motion to approve the agenda. All present
voted aye. MOTION CARRIED.
Item #3 - Kevin Grunewaldt requested a reconsideration of the vote by the Board
regarding the denial of three (3) variances at the July 1, 2010 meeting.
No motion to reconsider was made by a member of the prevailing side.
Item #4 - Ardean Albers has made a request for a variance on the south 60 feet of
Lot 1, the south 66 feet of Lot 2, and the north 15 feet of the east 100 feet of Lot 8,
Block 3, Hill Park Addition, also known as 517 12th Avenue. The request is to build a
deck 17 feet from the front property line. The required setback is 20 feet in this
residential district.
(D. Peterson/Vanduch) Motion to approve the variance request. All present
voted aye. MOTION CARRIED.
Item #5 - Larry and Natalie Sax have made a request for a variance on Lot 9, Block
2, Camelot Square Addition, also known as 1115 12th Street South. The request is to
build an attached garage three feet (3’) from the east side lot line. The required
setback is seven feet (7’) in this residential district.
(Klingbile/Vanduch) Motion to approve the variance request. All present
voted no. MOTION FAILED.

Item #6 - Daniel and Beverly Neiles have made a request for a variance on Lot 3,
Block 11, Brookdale Addition also known as 1918 Victory Street. The request is to
erect a 4.5 foot high, wrought iron style fence up to the front lot line and a six foot
(6’) high privacy fence 28 feet from the front lot line. The required setback is 30
feet in this residential district.
(D. Peterson/Vanduch) Motion to approve the variance request. All present
voted aye. MOTION CARRIED.

SUMMARY OF DISCUSSION
Chairperson David Rusten called the Board of Adjustment to order on
Thursday, July 15, 2010, at 5:08 PM in the Council Chamber at City Hall. Members
present were Larry Klingbile, Dick Peterson, Jay Vanduch, a-Jason Hoffelt, and
Rusten. Matt Kurtenbach, and a- Jim Pederson were absent. Also present were
Kevin Grunewaldt, Ardean Albers, Larry Sax, Ron Brandriet, Dan Neiles, Planning
and Zoning Administrator Dan Hanson and others.
Item #3 – Kevin Grunewaldt stated that he was proposing a 13 unit apartment
building on the site. He would maintain the existing one (1) bedroom units and
would meet the required parking and landscape regulations. He would establish
only one (1) unit in the basement compared to three (3) on the original request.
Vanduch did not feel the modified request resulted in major changes to
the proposal. Klingbile did not find that a hardship existed.
Grunewaldt felt a reduction to 12 units would require modifications to the
internal layout of the building. Vanduch did not feel the modifications were
necessary since the building already contained 12 units above the basement.
He viewed the proposal as no different than building a similar apartment on-site.
Item #4 – Albers stated he was requesting a variance to replace a 5’x 5’ existing
front stoop with 6’x 8’ deck. Rusten asked if the deck would extend one foot
further out toward the front lot line. Albers responded yes. D. Peterson noted that
an adjoining property had a similar deck off the front and also that the
neighborhood was quite old so setbacks varied.
Item #5 – Sax stated he purchased the home about one month ago. He noticed
that several homes in the neighborhood had received variances to the sideyard
setback. He was proposing a 24 foot wide garage with an additional five foot of
width behind the house for storage, entrance steps, and a door. He felt he had
considered the impact on his neighbor to the east by positioning the garage
more toward the rear of his house. He estimated that the proposed 10 feet of
separation between the two houses would only involve an overlap of about five
feet.

Ron Brandriet, a neighbor, felt the addition could be built without a
variance. He remarked that the garage was quite large, and other options such
as building further behind his house were available. Sax did not feel that a 20
foot wide garage was adequate for two vehicles.
Klingbile commented that 20 feet was adequate and that any fencing
installed along the nearby lot line would leave only three (3) feet between Sax’s
proposed garage. This could be a fire safety issue.
Sax remarked that a 22 foot wide garage would be acceptable too. He
noted that the west wall was up against an electric meter and back stoop so
going further west would be difficult. Brandriet stated he had no objection to a
22 foot wide garage.
Item #6 – Neiles stated that his lot shape was very unique. He proposed to install
a fence along his side lot line, and then run it back to the front of his house. The
fence would have a wrought iron design and be 54 inches high. Neiles added
that, because of the design of the cul-de-sac, the fence would still be 48 feet
from the curb.
Klingbile asked about the future location of a sidewalk. Hanson replied
that it would be six (6) inches outside the lot line.
D. Peterson commented that only three (3) homes fronted on the
eyebrow where the fence would be located. Rusten did not see any
obstructions to visibility based on the proposed design.
