Voting members present were Larry Klingbile, Matt Kurtenbach, Dick Peterson, Jay Vanduch, a- Jim Pederson, and Rusten. Alternate Jason Hoffelt was also absent. Matt Kurtenbach was absent. Others present were Jack Petersen, Ron Koerner, Community Development Director Mike Struck, and Planning and Zoning Administrator Dan Hanson. Item #1 – (J. Pederson/Vanduch) Motion to approve the minutes of the May 6, 2010 meeting. All present voted aye. MOTION CARRIED. Item #2 – (D. Peterson/Vanduch) Motion to approve the agenda. All present voted aye. MOTION CARRIED. Item #3 - Jennifer Petersen has made a request for a variance on Lot 11, College Addition, also known as 1611 6th Street. The request is to erect a three foot (3’) high fence within two feet of the front lot line and a six foot (6’) high fence within 10 feet of the front lot line. Fences are not permitted within 20 feet of the front lot line in a business district. (D. Peterson/Vanduch) Motion to approve the variance. All present voted aye. MOTION CARRIED. Item #4 - Ron Koerner has made a request for a variance on Lot 10, Block 5, Moriarty-Edgebrook Addition, also known as 1757 Doral Drive. The request is to build a deck 46 inches above grade within the minimum rear yard setback. The maximum height permitted is 30 inches in this residential district. (Vanduch/D. Peterson) Motion to approve the variance. All present voted aye. MOTION CARRIED. Voting members present were Larry Klingbile, Matt Kurtenbach, Dick Peterson, Jay Vanduch, a- Jim Pederson, and Rusten. Alternate Jason Hoffelt was also absent. Matt Kurtenbach was absent. Others present were Jack Petersen, Ron Koerner, Community Development Director Mike Struck, and Planning and Zoning Administrator Dan Hanson. Item #3 – Jack Petersen stated that he removed an existing fence that was in the same location because it was in disrepair. The adjacent neighbor, Duane Sander, worked with him to build the new fence that was shown in the photos. J. Pederson asked if the fence height was the same. Jack Peterson was not sure. He added that he had reconstructed without knowledge of the current regulations. D. Peterson commented that the lower eight foot long section could be removed. Rusten noted that the existing curb for the parking lot would deter a motorist from “cutting the corner”. Vanduch felt the sight lines were maintained with the current proposal. Jack Peterson remarked that his business was the only one on the block so they wanted to create a separation from the residential uses. Item #4 – Ron Koerner stated he built his house a of couple years ago. The lot sloped in the rear, and drainage between his house and his neighbors was an issue. In order to meet the regulations, he would have to build steps from his patio doors down to the deck. Rusten noted that the deck height varied due to the slope of the yard. The elevations indicated 46 inches in the southeast corner and 36 inches in the northeast corner. J. Pederson commented that the rear yard could be filled and a retaining wall installed in order to conform to the regulations. Koerner responded that it would be more difficult to manage the drainage if a wall were built.
