OFFICIAL MINUTES
Chairperson David Rusten called the Board of Adjustment to order on
Thursday, January 21, 2010 at 5:00 PM in the Council Chamber at City Hall. Voting
members present were Larry Klingbile, Jay Vanduch, Dick Peterson, a-Jim Pederson,
Matt Kurtenbach, and Rusten. A-Jason Hoffelt was also present. Others present were
Jon Meendering, Doug Eidsness, Community Development Director Mike Struck, and
Planning and Zoning Administrator Dan Hanson.
Item #1 – (J. Pederson/D. Peterson) Motion to approve the minutes of the January 7,
2010 meeting. All present voted aye. MOTION CARRIED.
Item #2 – (Klingbile/Kurtenbach) Motion to approve the agenda. All present voted
aye. MOTION CARRIED.
Kurtenbach recused himself from the Board. Vanduch replaced Kurtenbach as
a voting member.
Item #3 - Gatzke Family Enterprises has made a request for a variance on Lot 3, Block
1, Astleford Addition, also known as 1804 22nd Avenue. The request is to establish front
yard parking on a residential lot.
(D. Peterson/J. Pederson) Motion to approve the variance.
(D. Peterson/Vanduch) Amendment to the motion to add “provided a white
vinyl style fence is installed around the perimeter of the parking lot.” All present voted
aye. AMENDMENT CARRIED.
The motion, as amended, was voted on. Vanduch, Klingbile, D. Peterson, and J.
Pederson voted aye. Rusten voted no. MOTION CARRIED.
The meeting was adjourned.

SUMMARY OF DISCUSSION
Chairperson David Rusten called the Board of Adjustment to order on
Thursday, January 21, 2010 at 5:00 PM in the Council Chamber at City Hall. Voting
members present were Larry Klingbile, Jay Vanduch, Dick Peterson, a-Jim Pederson,
Matt Kurtenbach, and Rusten. A-Jason Hoffelt was also present. Others present were
Jon Meendering, Doug Eidsness, Community Development Director Mike Struck, and
Planning and Zoning Administrator Dan Hanson.
Item #3 – Jon Meendering, Design Arc, Inc., represented Gatzke Family Enterprises.
He indicated that several design options were explored, but the best option for
developing the property involved parking in the front yard. This allowed the front
doors of the apartment units to face the parking lot and reduced the amount of
traffic that would impact residences along 22nd Avenue.
Meendering spoke to other zoning regulations pertaining to the project. He
noted that the plan involved 12 units, well below the maximum permitted. The
project also complied with minimum parking standards and maximum building
height. He remarked that a landscape berm and coniferous trees would be planted
along the south side to screen the parking lot from Highway 14. The existing trees
along the east side would also be retained.
Vanduch asked about surfacing. Meendering responded that concrete
would be used. D. Peterson asked if the conifers would be Black Hills Spruce.
Meendering replied yes. D. Peterson inquired about parking lot lights. Meendering
answered that the type used would direct the light down. D. Peterson asked about
the fence design. Meendering responded that a white vinyl or aluminum fence
would be installed.
Klingbile asked about other design options for the proposed development.
Meendering stated that the plan could be reversed, but traffic to and from the site
would have a greater impact on neighboring properties. This design would also
have the back of the building facing Highway 14.
Doug Eidsness, a neighbor, felt the two driveways off 22nd Avenue were an
issue. He felt the location of one of the driveways would be across from his house

and cause headlight glare. He favored an access drive off Highway 14. This would
reduce traffic on 22nd Avenue. Rusten concurred with Eidsness.
D. Peterson and Vanduch preferred no additional driveways onto Highway 14
based on safety and proximity to the 22nd Avenue intersection. Hanson remarked
that right-of-way management policies favor access drives off streets with a lower
classification so 22nd Avenue would be preferred in this case.
