Board of Adjustment

OFFICIAL MINUTES
Chairperson Dick Peterson called the Board of Adjustment to order on
Thursday, November 5, 2009 at 5:00 PM in the Council Chamber at City Hall. Voting
members present were David Rusten, Matt Kurtenbach, Larry Klingbile, alternate -
Jim Pederson and Peterson. Jay Vanduch was also present. Also present were
Community Development Director Mike Struck, and Planning and Zoning
Administrator Dan Hanson.
Item #1 – (J. Pederson/Rusten) Motion to approve the minutes of the September 17,
2009 meeting. All present voted aye. MOTION CARRIED.
Item #2 – (Klingbile/J. Pederson) Motion to approve the agenda. All present voted
aye. MOTION CARRIED.
Item #3 – John Moriarty has made a request for a variance on the west 140 feet of
the east 428 feet of the south 140 feet of Block 11, Parkdale Home Second Addition,
also known as 224 West 8th Street. The request is to build a fence 45 inches high along
the front lot line. The maximum height allowed is 30 inches in a residential district.
(Rusten/Kurtenbach) Motion to approve the variance. All present voted aye.
MOTION CARRIED.
Item #4 - Micah and Korisa Eidem have made a request for a variance on Lot 1, Block
10, Bane and Poole Addition, also known as 320 20th Avenue. The request is to
construct a porch 22.5 feet from the west front lot line. The required setback is 30 feet
in this residential district
(Rusten/Klingbile) Motion to approve the variance. All present voted aye.
MOTION CARRIED.

SUMMARY OF DISCUSSION
Chairperson Dick Peterson called the Board of Adjustment to order on
Thursday, November 5, 2009 at 5:00 PM in the Council Chamber at City Hall. Voting
members present were David Rusten, Matt Kurtenbach, Larry Klingbile, alternate -
Jim Pederson and Peterson. Jay Vanduch was also present. Also present were
Community Development Director Mike Struck, and Planning and Zoning
Administrator Dan Hanson.
Item #3 – Moriarty stated that he had lived on the block for over 40 years. He had
cattle on the premises in the past and a woven wire fence was erected many
years ago to contain the livestock.
D. Peterson felt the new fence did not obstruct any vision.
Item #4 – Korisa Eidem stated that the existing porch allowed for only a narrow
stairway down to the driveway. Extending the porch would enhance the entrance
onto the elevated porch.
Kurtenbach considered the request to be minimal in nature and did not feel
it negatively impacted adjacent properties.
The meeting was adjourned.
