HomeMy WebLinkAboutBOAMinutes_2009_09_03 1 Board of Adjustment Brookings, South Dakota September 3, 2009 OFFICIAL MINUTES Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, September 3, 2009 at 5:00 PM in the Council Chamber at City Hall. Members present were Jim Pederson, Larry Klingbile, Matt Kurtenbach, and Peterson. Jay Vanduch, David Rusten, and alternate - Mike Keating were absent. Also present were Dave Fiedler, Andy Wagstrom, Wendell and Marlys Thompson, Tom Krogman, Community Development Director Mike Struck, Planning and Zoning Administrator Dan Hanson, and others. Item #1 – (J. Pederson/Kurtenbach) Motion to approve the minutes of the August 20, 2009, meeting. All present voted aye. MOTION CARRIED. Item #2 – (Klingbile/J. Pederson) Motion to approve the agenda. All present voted aye. MOTION CARRIED. Item #3 – The Brookings School District has made a request for a variance on Lot A, Nelson Third Addition, also known as 1401 15th Street South. The request is to erect a four foot (4’) high fence, four feet (4’) from Camelot Drive and from a portion of 15th Street South that abuts a playground area. (Klingbile/Kurtenbach) Motion to approve the variance request. All present voted aye. MOTION CARRIED. Item #4 - The South Dakota Army National Guard has made a request for a variance on Lots A and B of Lot 1 and all of Lot 2, Christensen Addition, also known as 300 5th Street South. The request is to install an additional access drive onto 5th Street South. (J. Pederson/Klingbile) Motion to approve the variance request. All present voted aye. MOTION CARRIED. Item #5 - Wendell and Marlys Thompson have made a request for a variance on Lot 1, Block 1, East Acres Addition, also known as 215 16th Avenue South. The request is to erect a 3½ foot high fence in the front yard of a residential lot. The maximum height permitted is 2½ feet. (J. Pederson/Kurtenbach) Motion to approve the variance request. 2 (Klingbile/Kurtenbach) Amendment to the motion to require a 2 ½ foot high fence 20 feet from the front lot line along the north lot line. Klingbile voted aye. Kurtenbach, J. Pederson, and D. Peterson voted no. All present voted no. MOTIOM FAILED. The motion was voted on. All present voted aye. MOTION CARRIED. Item #6 - Tom and Lori Krogman have made a request for a variance on Lots 7 and 8, Block 1, Esther Heights Addition, also known as 2210 David Cove. The request is to build a porch 11.5 feet from the east front lot line. The required setback is 30 feet in this residential district. (Kurtenbach/J. Pederson) Motion to approve the variance request. All present voted aye. MOTION CARRIED. The meeting was adjourned. ______________________ __________________________ Dan Hanson, Secretary Dick Peterson, Chairperson Planning & Zoning Administrator 3 Board of Adjustment Brookings, South Dakota September 3, 2009 SUMMARY OF DISCUSSION Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, September 3, 2009 at 5:00 PM in the Council Chamber at City Hall. Members present were Jim Pederson, Larry Klingbile, Matt Kurtenbach, and Peterson. Jay Vanduch, David Rusten, and alternate - Mike Keating were absent. Also present were Dave Fiedler, Andy Wagstrom, Wendell and Marlys Thompson, Tom Krogman, Community Development Director Mike Struck, Planning and Zoning Administrator Dan Hanson, and others. Item #3 – Dave Fiedler, representing the school district, stated the fence would keep balls from going into the street. Kurtenbach asked what style of fence was going to be erected. Fiedler replied chain link. Kurtenbach did not feel there would be any vision problems. Item #4 – Andy Wagstrom, representing the National Guard, stated the main entrance to the east was cumbersome for large trucks. The proposed access would be easier for trucks to access the shop building. Klingbile asked what the width would be. Wagstrom replied 37 feet. D. Peterson noted the low traffic in the area. Kurtenbach concurred with D. Peterson and felt the variance was appropriate. Item #5 – Marlys Thompson stated the white shutters on the house and the fence created a certain aesthetic quality. They were simply replacing the fence that had been there for several decades. Klingbile was concerned about the two (2) adjacent driveways on each side of the north lot line. He felt a lower fence height in that area would be safer. Wendell Thompson felt that someone could see over and through the fence based on its design. J. Pederson felt a change on one side would not be attractive. D. Peterson and Kurtenbach felt the open fence design did not obstruct vision like a privacy fence. Item #6 – Krogman stated he was replacing the platform on his existing deck and wanted to add a roof. The deck would not be enclosed or screened. He added 4 that he owned a large parcel of land so the impact would be minimal on his neighbors.
