OFFICIAL MINUTES
Chairperson Dick Peterson called the Board of Adjustment to order on
Thursday, May 7, 2009 at 5:00 PM in the Council Chamber at City Hall. Members
present were David Rusten, Larry Klingbile, alternate - Jim Pederson, alternate - Mike
Keating, and D. Peterson. Matt Kurtenbach and Jay Vanduch were absent. Also
present were John Gustafson, Joel Edman, Michael Hubbard, Community
Development Director Mike Struck, Planning and Zoning Administrator Dan Hanson
and others.
Item #1 – (Klingbile/Rusten) Motion to approve the minutes of the April 23, 2009,
meeting. All present voted aye. MOTION CARRIED.
Item #2 – (Keating/Pederson) Motion to approve the agenda with the inclusion of
Item 2a. BlairHill Properties, Inc. reconsideration request. All present voted aye.
MOTION CARRIED.
Item #2a – BlairHill Properties, Inc./Robbins Construction have made a request for a
variance on Lot 8 and 8A, Block 1, BlairHill Second Addition, also known as 1424
Sheridan Circle. The request is to build a home 24.66’ from the south front lot line. The
required setback is 30 feet in the Residence R-1B District.
(Pederson/Rusten) Motion to reconsider the vote. All present voted aye. MOTION
CARRIED.
The original motion was voted on. All present voted aye. MOTION CARRIED.
Item #3 - Edman Enterprises, Inc. has made a request for a variance on Outlot 9 in the
NE ¼ of Section 35-T110N-R50W, also known as 1221 Main Avenue South. The request is
to establish two access drives for a lot with 191.8 feet of frontage width. Two hundred
feet is the minimum width required for two access drives.
(Rusten/Pederson) Motion to approve the variance. All present voted aye.
MOTION CARRIED.
Item #4 - Michael Hubbard has made a request for a variance on Lot 22, Block 1, Esther
Heights Addition, also known as 2107 Rhonda Road. The request is to establish two

accessory buildings with a total of 1,060 square feet of floor area. The maximum
allowed is 1,000 square feet on a residential lot.
(Keating/Klingbile) Motion to approve the variance. All present voted aye.
MOTION CARRIED.

SUMMARY OF DISCUSSION
Chairperson Dick Peterson called the Board of Adjustment to order on
Thursday, May 7, 2009 at 5:00 PM in the Council Chamber at City Hall. Members
present were David Rusten, Larry Klingbile, alternate - Jim Pederson, alternate - Mike
Keating and D. Peterson. Matt Kurtenbach and Jay Vanduch were absent. Also
present were John Gustafson, Joel Edman, Michael Hubbard, Community
Development Director Mike Struck, Planning and Zoning Administrator Dan Hanson
and others.
Item #2a – John Gustafson, representing BlairHill, Inc., noted that 15th Street South
was a 70 foot wide right-of-way versus a 60 foot wide right-of-way for a local street.
Therefore, 5 feet was “lost” on both sides of the road. This made the lot 88 feet wide
with only 50 foot of buildable width. The preferred orientation of the house was to
have the garage doors face the cul-de-sac rather than 15th Street South.
Petersen asked if the future corner lot to the west would be platted with an 88
foot width. Gustafson replied that it was unlikely since the preliminary plan showed a
much wider lot. Pederson asked what hardship was involved. Gustafson felt the lot
could not be developed with a similar style home than what existed around the cul-
de-sac. This would negatively impact the neighborhood.
Item #3 – Joel Edman, of Edman Enterprises, stated the property had two existing
driveways onto Main Avenue South. He proposed to use both driveways in the same
location.
Peterson felt the existing two access drives would be appropriate for the lot
given the frontage width.
Item #4 – Hubbard stated that an 18’ x 30’ addition to his garage would put him over
the 1,000 square foot maximum. Keating asked how not having an additional 60
square feet of floor area was a hardship. Hubbard responded that he could remove
a smaller shed on the lot but it had a concrete foundation. He noted that a
neighboring garage was very large and his rear yard was quite large so the buildings
would not cover much of the back yard.
Peterson and Keating concurred that the size of the lot should be considered.
