HomeMy WebLinkAboutBOAMinutes_2008_11_20Board of Adjustment Brookings, South Dakota November 20, 2008 OFFICIAL MINUTES Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, November 20, 2008 at 5:00 PM in the Council Chamber at City Hall. Voting members present were Larry Klingbile, David Rusten, alternate Jim Pederson, alternate-Mike Keating, and Peterson. Jay Vanduch was also present. Matt Kurtenbach was absent. Also present were Padu and Kristie Krishnan, Justin Skogen, Dusten Hendrichson, City Planner Dan Hanson and others. Item #1 – (Klingbile/Keating) Motion to approve the minutes of the October 23, 2008 meeting. All present voted aye. .MOTION CARRIED. Vanduch was present. Item #2 – (Rusten/Keating) Motion to approve the agenda. All present voted aye. MOTION CARRIED. Item #3 - Padu and Kristie Krishnan have made a request for two variances on Lot 17, Block 13, Brookdale Addition, also known as 1707 Terrace Drive. The first request is to build 26 feet from the south front lot line. The required setback is 30 feet. The second request is to build 26 feet from the west front lot line. The required setback is 30 feet. (Rusten/Keating) Motion to approve the first variance. All present voted aye. MOTION CARRIED. (Rusten/Klingbile) Motion to approve the second variance. All present voted aye. MOTION CARRIED. Item #4 - Forest Holdings LLP has made a request for two variances on Tract A-1, Block 9, Telkamp Addition, also known as 2229 6th Street. The first request is to construct a building 19 feet from the west side lot line. The required setback is 25 feet. The second request is to establish a use on a lot with 125.9 feet of frontage. The minimum required frontage width is 150 feet. (Rusten/Keating) Motion to approve the first variance. All present voted aye. MOTION CARRIED. 1 (Klingbile/Rusten) Motion to approve the second variance. All present voted aye. MOTION CARRIED. Item #5 - Dakota Roofing, Inc./Dusten Hendrichson has made a request for a variance on Lot 1C, Block 11, McClemans Addition, also known as 703 17th Street South. The request is to build a deck 14.5 feet from the west front lot line. The required setback is 20 feet in the Residence R-3A District. (J. Pederson/Rusten) Motion to approve the variance. Rusten, Keating, and J. Pederson voted aye. Klingbile and D. Peterson voted no. MOTION FAILED. The meeting was adjourned. ______________________ __________________________ Dan Hanson, Secretary Dick Peterson, Chairperson Brookings City Planner 2 Board of Adjustment Brookings, South Dakota November 20, 2008 SUMMARY OF DISCUSSION Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, November 20, 2008 at 5:00 PM in the Council Chamber at City Hall. Voting members present were Larry Klingbile, David Rusten, alternate Jim Pederson, alternate-Mike Keating, and Peterson. Jay Vanduch was also present. Matt Kurtenbach was absent. Also present were Padu and Kristie Krishnan, Justin Skogen, Dusten Hendrichson, City Planner Dan Hanson and others. Item #3 – Padu Krishnan stated that his family had run out of living space. The proposed addition would include bedrooms on the second floor over a new and larger garage. Kristie Krishnan remarked that the house had some water problems in the basement so they wanted to relocate the bedrooms. She added that their corner lot limited their options for expansion. Padu Krishnan pointed out that a relocation of the driveway from 17th Avenue South to Terrace Drive would improve safety in the neighborhood. Kristie Krishnan noted that a house across the street had a “bump out” garage design that was similar to their proposal. Klingbile asked for the total size of the addition. Krishnan replied 26’ x 41’. D. Peterson felt the proposed encroachment did not adversely impact the neighborhood. Item #4 – Justin Skogen of Forest Holdings, LLC stated that they wanted to maintain a driving lane and a row of parking stalls on the east side of the building so the building would need to be shifted to the west. He added that only a portion of the west side would encroach into the setback. Rusten asked if the restaurant was a standard size model or custom design. Skogen replied standard. Hanson explained the lot area requirements for lots abutting a frontage road. Skogen stated he was in the process of acquiring more land to reach the 30,000 square foot minimum. Item #5 – Dusten Hendrichson of Dakota Roofing stated the deck was already built. He originally had the deck on the rear of the house but changed his mind later. He 3 4 noted that the deck was not shown on the building plans for the house, and he wasn’t aware that he needed a permit. D. Peterson and Klingbile considered the deck location in the front yard to be unusual compared to other decks in the area. Klingbile noted that other variances had been granted for decks, but none for encroachment into a front yard.
