HomeMy WebLinkAboutBOAMinutes_2008_10_23Board of Adjustment Brookings, South Dakota October 23, 2008 OFFICIAL MINUTES Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, October 23, 2008 at 5:00 PM in the Council Chamber at City Hall. Voting members present were Matt Kurtenbach, Larry Klingbile, alternate Jim Pederson, and Peterson. Alternate-Mike Keating, Jay Vanduch, and David Rusten were absent. Also present were Chad Verhoek, Al Kuechenmeister, Craig Kreyger, Mike Bailey, Brenda Larson, City Planner Dan Hanson and others. Item #1 – (J. Pederson/Klingbile) Motion to approve the minutes of the October 2, 2008 meeting. All present voted aye. .MOTION CARRIED. Item #2 – (Klingbile/Kurtenbach) Motion to approve the agenda. All present voted aye. MOTION CARRIED. Item #3 - Chad Verhoek has made a request for a variance on Lots 8 - 11, Block 3, Robert's Second Addition, also known as 305 5th Street South. The request is to establish less landscaping than required by ordinance. (J. Pederson/Kurtenbach) Motion to approve the variance. J. Pederson voted aye. Klingbile, Kurtenbach, and D. Peterson voted no. MOTION FAILED. Item #4 - Al Kuechenmeister has made a request for a variance on Lot 1, Block 4, Sioux Heights Addition, also known as 1702 Olwien Street. The request is to establish front yard parking on a residential lot (Klingbile/Kurtenbach) Motion to approve the variance. Klingbile, J. Pederson, and D. Peterson voted aye. Kurtenbach voted no. MOTION FAILED. Item #5 - Vision Developers has made a request for two variances on Tract A of Lot 3, Southbrook Addition, also known as 1000 22nd Avenue South. The first request is to establish an exit only access drive in the southeast corner of the tract. The second variance is to establish an entrance/exit access drive in the northeast corner of the tract. (J. Pederson/Kurtenbach) Motion to approve the variance. Klingbile, J. Pederson, and D. Peterson voted aye. Kurtenbach voted no. MOTION FAILED. 1 Item #6 - Brenda Larson has made a request for a variance on Lot 1, Block 2, Husen's Addition, also known as 1049 Western Avenue. The request is to build a detached garage in the Special Flood Hazard Area with a floor elevation lower than required by ordinance. (Klingbile/Kurtenbach) Motion to approve the variance. (Kurtenbach/J. Pederson) Motion to amend the motion to “require a 1,605.3 foot elevation for the garage. All present voted aye. MOTION CARRIED. The original motion was voted on. All present voted aye. MOTION CARRIED. The meeting was adjourned. ______________________ __________________________ Dan Hanson, Secretary Dick Peterson, Chairperson Brookings City Planner 2 Board of Adjustment Brookings, South Dakota October 23, 2008 SUMMARY OF DISCUSSION Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, October 23, 2008 at 5:00 PM in the Council Chamber at City Hall. Voting members present were Matt Kurtenbach, Larry Klingbile, alternate Jim Pederson, and Peterson. Alternate-Mike Keating, Jay Vanduch, and David Rusten were absent. Also present were Chad Verhoek, Al Kuechenmeister, Craig Kreyger, Mike Bailey, Brenda Larson, City Planner Dan Hanson and others. Item #3 – Chad Verhoek stated that he planned for his employees to park between the two driveways off 3rd Avenue South. The south driveway would also be the renter’s entrance to the storage building. He added that he had other landscape areas on his lot. Kurtenbach felt the encroachment over the sidewalk was a concern since there would be no buffer if the landscaping were eliminated. Klingbile asked where the employees parked before. Verhoek replied where the new addition was now. Klingbile asked how many parking spaces existed on the lot. Verhoek responded that he had parking along the alley and on the south end of the lot. D. Peterson felt there was ample parking on the lot already so eliminating landscaping to add more parking was not necessary. Item #4 – Kuechenmeister stated that he poured a concrete pad in front of his entrance door about two years ago. He preferred to park off-street since 17th Avenue was a busy street. He added that the existing driveway was only one lane wide so a car must be moved to let another one out. Hanson explained the ordinance language that prohibited front yard parking. He noted that Kuechenmeister could add on to the driveway along the east side. Item #5 – Craig Kreyger of Vision Developers stated that he could eventually replat the property in order to sell it. The south driveway would be an exit only for trucks that would deliver to the backside of the building. Kreyger felt it would be safer than driving back through the parking lot. Mike Bailey, adjacent property owner, stated he was limited in the number of driveways onto 22nd Avenue South too. He felt safety would be an issue if there were 3 4 two driveways so close together. His driveway was only about 20 feet from the proposed exit. J. Pederson asked what the distance was between the two proposed driveways. Kreyger replied about 200 feet. He added that the proposed driveway on the north end of Tract A was over 100 feet from centerline to centerline of an existing driveway. Kreyger felt the south exit would be used mainly during early morning and late night hours and would not conflict with traffic from Bailey’s property. Bailey responded that his service vehicles had the same hours. Kurtenbach saw merit in the exit drive but felt he could not support the uni- directional driveway. Hanson noted that the tracts abutting Lot 3, where the mall was located, had a cross-easement agreement allowing vehicles to cross between properties internally. Item #6 – Jim Caugherty, from JC Construction, stated he was representing Brenda Larson. Hanson stated that the actual proposed elevation of the garage floor would be at 1,605.3 feet according to the 1988 NAVD. The required elevation by city ordinance was 1,606 feet. D. Peterson did not feel the residential garage would be a hazard given the amount of variance requested.
