HomeMy WebLinkAboutBOAMinutes_2008_08_07Board of Adjustment Brookings, South Dakota August 7, 2008 OFFICIAL MINUTES Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, August 7, 2008 at 5:00 PM in the Council Chamber at City Hall. Members present were Larry Klingbile, David Rusten, Jay Vanduch, a-Jim Pederson, and Peterson. Matt Kurtenbach and a-Mike Keating were absent. Also present were Brian Gatzke, Doug Odegaard, Chris Nelson, Zoning Administrator Dan Hanson, and others. Item #1 – (J. Pederson/Vanduch) Motion to approve the minutes of the July 17, 2008 meeting. All present voted aye. MOTION CARRIED. Item #2 – (Vanduch/Rusten) Motion to approve the agenda. All present voted aye. MOTION CARRIED. Item #3 – Gatzke Family Enterprises has made a request for a variance on the north 115 feet of Lots 6 and 7, Block 3, First Addition, also known as 222 5th Avenue. The request is to relocate a storage building on the rear lot line. The required setback is 20 feet in the B-2A Business District. (Klingbile/Vanduch) Motion to approve the variance. All present voted aye. MOTION CARRIED. Item #4 - Judy and Doug Odegaard have made a request for a variance on Lot 11, Fishback Subdivision, also known as 1073 Circle Drive. The request is to build an addition to an accessory building 4.5 feet from the north lot line. The required setback in seven feet (7') in the Residence R-2 District. (Vanduch/Klingbile) Motion to approve the variance. All present voted aye. MOTION CARRIED. Item #5 - Michelle and Christopher Nelson have made a request for a variance on Lot 1, Block 7, East Acres Second Addition, also known as 303 18th Avenue South. The request is to build an accessory building 25 feet from the north front lot line. The required setback is 30 feet in the R-1B Residential District. (Klingbile/Rusten) Motion to approve the variance. Rusten, Klingbile, J. Pederson, and D. Peterson voted aye. Vanduch noted no. MOTION CARRIED. Members present were Larry Klingbile, David Rusten, Jay Vanduch, a-Jim Pederson, and Peterson. Matt Kurtenbach and a-Mike Keating were absent. Also present were Brian Gatzke, Doug Odegaard, Chris Nelson, Zoning Administrator Dan Hanson, and others. Item #3 – Brian Gatzke stated that his plans were to either repair or remove the building. He noted that the building was used for storage. J. Pederson asked what the specific plans were for the rear wall. Gatzke stated that it was attached to the adjacent building now, but there was no common wall agreement. He would likely detach it, and build a firewall. Item #4 – Odegaard stated he had an option to build an accessory building in his rear yard or add on to his existing garage. He proposed the garage since it had electricity. Hanson explained that the separation rule between a house and a garage did not exist when the lot was developed. Today, accessory buildings must have the same setback that is required of the principal building if there is less than 10 feet of separation Item #5 – D. Peterson asked for the zoning background on this subdivision. Hanson responded that this area was developing when the front yard setback was changed from 25 to 30 feet. Therefore, some houses were set at the 25 foot setback line. Building in-line was still permitted by right, but this did not pertain to new accessory buildings. Vanduch noted that the petitioner’s house was two feet (2’) further back than the proposed garage. Rusten remarked that the adjacent house to the east was built 25 feet from the front lot line. Vanduch asked what the hardship was. Nelson replied that setting the garage back would result in removal of a portion of the patio and reduce the rear yard area.
