OFFICIAL MINUTES
Chairperson Dick Peterson called the Board of Adjustment to order
on Thursday, August 16, 2007 at 5:00 PM in the Council Chamber at City
Hall. Voting members present were Larry Klingbile, Matt Kurtenbach,
David Rusten, Jay Vanduch, and D. Peterson. Alternate Jim Pederson was
also present. Alternate Mike Keating was absent. Others present were
Larry Fjeldos, Marvin Bahr, David Jones, Van Fishback, Don Diebert, Mary
Decker, Zoning Administrator Dan Hanson, and others.
Item #1 – (Kurtenbach/Rusten) Motion to approve the minutes of the July,
19, 2007 meeting. All present voted aye. MOTION CARRIED.
Item #2 – (Klingbile/Kurtenbach) Motion to approve the agenda. All
present voted aye. MOTION CARRIED.
Item #3 - Larry and Jan Fjeldos have made a request for a variance on Lots
3A and 3B, Block 9, Moriarty Fourth Addition, also known as 1716 and 1720
Torrey Pines Drive. The request is to establish two lots with 44.2 feet and 46.5
feet, respectively, of frontage width. The minimum width required in the
Residence R-3 District is 50 feet.
(Rusten/Vanduch) Motion to approve the variance request. All
present voted aye. MOTION CARRIED.
Item #4 - Alvin Marvin Bahr Jr. has made a request for a variance on the E50'
of the W100' of the S35' of Lot 6 and the E50' of the W100' of Lots 7 and 8,
Block 1, Sandersons Addition, also known as 1221 6th Street. The request is to
establish front yard parking on a residential lot.
(Rusten/Klingbile) Motion to approve the variance request. All present
voted no. MOTION FAILED.
Item #5 - Counterpart, Inc. has made a request for a variance on Lots 6 and
7, Block 2, Telkamp Industrial Addition, also known as 214 32nd Avenue South.
The request is to establish a sixty foot (60') wide access drive for an industrial
use. The maximum width allowed is forty feet (40').
(Vanduch/Klingbile) Motion to approve the variance. All present
voted aye. MOTION CARRIED.
Item #6 - Mary Decker has made a request for a variance on Lot 4A of Lass
Addition in the NW 1/4 of Section 14-T109N-R50W, also known as 221 Twin
Oaks Lane. The request is to establish front yard parking on a residential lot.
(Kurtenbach/Vanduch) Motion to approve the variance.
(Klingbile/Kurtenbach) Amendment to the motion to approve the
variance as submitted on the site plan with access to the front yard
parking restricted to the Twin Oaks Lane right-of-way. All present voted
aye. AMENDMENT CARRIED.
The motion, as amended, was voted on. All present voted aye.
MOTION CARRIED.

SUMMARY OF DISCUSSION
Chairperson Dick Peterson called the Board of Adjustment to order
on Thursday, August 16, 2007 at 5:00 PM in the Council Chamber at City
Hall. Voting members present were Larry Klingbile, Matt Kurtenbach,
David Rusten, Jay Vanduch, and D. Peterson. Alternate Jim Pederson was
also present. Alternate Mike Keating was absent. Others present were
Larry Fjeldos, Marvin Bahr, David Jones, Van Fishback, Don Diebert, Mary
Decker, Zoning Administrator Dan Hanson, and others.
Item #3 – Fjeldos submitted a plot plan showing how a single-family home
would be located on each lot. Lots 3A and 3B were originally planned to
accommodate one twinhome. Fjeldos remarked that the lots were
irregular in shape.
Kurtenbach stated that the lots were actually larger in area than
adjacent lots that had adequate frontage. For this reason, the density in
the neighborhood would not increase based on the variance request.
Klingbile concurred with Kurtenbach. D. Peterson added that the
circumstances were unique to the land for these lots.
Item #4 – Bahr stated that his long driveway created problems for parking.
The sideyard with the driveway was only about 8 ½ feet wide and larger
vehicles could not access the rear yard.
David Jones, a neighbor, felt the expansion of a driveway in the
front yard would be an aesthetic and pedestrian concern. He favored
better utilization of the rear yard. Van Fishback, another property owner,
did not see a hardship and was also concerned about aesthetics.
Bahr remarked that a large hedge was located along the east lot
line, and the branches would scratch vehicles. D. Peterson noted that the
branches could be trimmed at the lot line. Bahr added that backing up
from the rear yard a distance of 113’ was difficult.
Klingbile asked what the distance was between the house and
garage. Bahr was unsure. Klingbile felt a back-up pad could be installed
in the backyard so vehicles could drive out. Vanduch concurred with
Klingbile.
Item #5 – Don Diebert, President of Counterpart, Inc., stated that a wider
driveway off the south end of their lot would allow a more direct path to
the doors. It would also eliminate turning movements in the street.
Item #6 – Decker stated the extra parking space would keep vehicles on
her lot.
Kurtenbach noted that the property had three front yards which
created a front yard parking issue on most of the property. D. Peterson did
not feel the parking space would create a sight problem at the
intersection. Klingbile supported the request but favored access to the
parking space only from Twin Oaks Lane.
