HomeMy WebLinkAboutBOAMinutes_2007_04_19Board of Adjustment Brookings, South Dakota April 19, 2007 OFFICIAL MINUTES Chairperson Dick Peterson called the Board of Adjustment to order on Thursday, April 19, 2007 at 5:00 PM in the Council Chamber at City Hall. Members present were Matt Kurtenbach, David Rusten, a-Mike Keating and Peterson. Jay Vanduch, Larry Klingbile, and alternate Jim Pederson were absent. Others present were Trent Archer, Wes Tschetter, Keith Rounds, Mitch Coburn, Steve Helling, Jeff Jung, Bryan Cronin, Zoning Administrator Dan Hanson and others. Item #1 – The minutes of the April 5, 2007 meeting were approved. Item #2 – The agenda was approved. Item #3 - Trent Archer has made a request for a variance on Lots 7 and 8, Block 3, Parkdale Home Replat Subdivision, also known as 613 Hughes Avenue. The request is to expand a building containing a nonconforming use by 1,610 square feet. The maximum expansion allowed on this lot is 222 square feet. (Rusten/Kurtenbach) Motion to approve the variance. (Kurtenbach/Rusten) Amendment to the motion to add “provided the sidewall height of the addition is 12 feet or less” All present voted aye. AMENDMENT CARRIED. The motion, as amended, was voted on. All present voted aye. MOTION CARRIED. Item #4 - Wesley G. Tschetter has made a request for a variance on Lot 9, Block 5, Bane and Poole Addition, also known as 320 Dakota Avenue. The request is to build an unenclosed porch 17.5 feet from the front lot line. The required setback in this district is 30 feet. (Rusten/Kurtenbach) Motion to approve the variance. All present voted aye. MOTION CARRIED. Item #5 - Brookings Area Habitat for Humanity has made a request for a variance on Lot 5C, a replat of Lots 5A and 6A, Lass Addition in the NW 1/4 of Section 14- T109N-R50W, also known as 137 Twin Oaks Lane. The request is to establish a C:\Documents and Settings\bfoster.CITYOFBROOKINGS\Local Settings\Temporary Internet Files\OLKC\BA- 2007-04-19.doc 1 frontage width of 70 feet for a lot in the Residence R-1B District. The minimum required width is 75 feet. Item #6 - Brookings Area Habitat for Humanity has made a request for a variance on Lot 6B, a replat of Lots 5A and 6A, Lass Addition in the NW 1/4 of Section 14- T109N-R50W, also known as 131 Twin Oaks Lane. The request is to establish a frontage width of 70 feet for a lot in the Residence R-1B District. The minimum required width is 75 feet. (Kurtenbach/Rusten) Motion to approve the variance for Lot 5C and Lot 6B. (Kurtenbach/Rusten) Motion to table. All present voted aye. MOTION CARRIED. Item #7 - Bryan Cronin has made a request for two variances on Lot 149, Onaka Village, Indian Hills Addition, also known as 929 Broken Bow Trail. The first request is to expand an accessory building to 1,053 square feet. The maximum size allowed is 1,000 square feet. The second variance is to build 7.5 feet from the principal structure with an accessory building that is less than seven feet (7') from the side lot line. (Keating/Rusten) Motion to approve the first variance. All present voted aye. MOTION CARRIED. (Rusten/Kurtenbach) Motion to approve the second variance. (Keating/Rusten) Amendment to the motion to add “provided the accessory building is not closer than nine feet (9’) from the principal building. All present voted aye. AMENDMENT CARRIED. The motion, as amended, was voted on. All present voted aye. MOTION CARRIED. Members present were Matt Kurtenbach, David Rusten, a-Mike Keating and Peterson. Jay Vanduch, Larry Klingbile, and a-Jim Pederson were absent. Others present were Trent Archer, Wes Tschetter, Keith Rounds, Mi tch Coburn, Steve Helling, Jeff Jung, Bryan Cronin, Zoning Administrator Dan Hanson, and others. Item #3 – Archer stated he wanted to store more personal items inside. He felt the addition would add value to his lot and improve its appearance. Rusten asked what sidewall height was planned. Archer replied that he was planning on 10 foot high doors. Kurtenbach asked if access to the addition would be from the alley. Archer replied yes. Kurtenbach noted that the property would likely move toward a commercial use in the future. Rusten noted that adjacent properties to the south and west were business oriented. Item #4 – Tschetter stated his plan was to construct a roof over his front steps. He currently had no protection from the ice that formed on the steps in the winter. He explained that the roof would extend eight feet (8’) and did not feel there would be a vision problem. Kurtenbach felt the open porch design was important in his support for the variance. Items #5 and 6 – The Board heard arguments for both requests since the variance requests were identical, and the lots were side by side. Keith Rounds, Past President of Brookings Area Habitat for Humanity, stated the variances would allow Brookings Area Habitat for Humanity to plat an additional lot for another family. He felt the impact would be minimal. He added that the lots were large with over 13,000 square feet of area. C:\Documents and Settings\bfoster.CITYOFBROOKINGS\Local Settings\Temporary Internet Files\OLKC\BA- 2007-04-19.doc 3 Mitch Coburn, a neighbor, stated he was approached initially by Brookings Area Habitat for Humanity to sell a portion of his lot, but Habitat never contacted him again. He had a larger lot and felt that other lots should be of similar size. He opposed the variance. Steve Helling, of Brookings Area Habitat for Humanity, stated he called Coburn two times but received no response. Therefore, he concluded that Coburn did not want to sell a portion of his lot. Keating felt a variance did affect adjacent properties. Rusten noted that the lots in this subdivision were mixed already with some lots 150 feet wide and some lots 75 feet wide. Kurtenbach felt there was adequate separation between the houses if the variances were granted. Keating commented that Brookings Area Habitat for Humanity and Coburn should discuss the issues they had and see if they could find a solution. Item #7- Cronin stated that the addition needed to be 16 feet wide in order to accommodate his woodworking hobby. Kurtenbach indicated that the variance for a larger garage was only a 5% increase, so he did not feel it was an issue. Cronin stated that the original alignment of the detached garage made it difficult to plan an addition. The garage was not parallel with the side lot line or the house. He added that he calculated that the proposed addition would be between 9 and 10 feet from the house.
