RESOLUTION 25-036 - WINE ON-SALE ALCOHOLIC BEVERAGE OPERATING AGREEMENT - WAL-MART SUPERCENTER #1538: 5-YEAR MID-TERM RENEWAL BE IT RESOLVED by the City of Brookings, South Dakota, that the City Council hereby approves a Lease Agreement renewal for the On-Sale Wine Alcoholic Beverage Management Agreement between the City of Brookings and the Store Manager for Wal-Mart Supercenter #1538, for the purpose of a manager to operate the on -sale establishment or business for and on behalf of the City of Brookings at 2233 6th Street. Legal Description: Lot 2, Tract A-Z of Blocks 9-10, Telkamp Addition. NOW, THEREFORE, BE IT FURTHER RESOLVED that the City Manager be authorized to execute the Agreement on behalf of the City, which shall be for the remaining 5 years of the 10-year agreement. D. E. Action on Resolution 25-092, a Resolution declaring surplus property for the City of Brookings. RESOLUTION 25-092 – DECLARING SURPLUS PROPERTY WHEREAS, the City of Brookings is the owner of the following described equipment formerly used at the City of Brookings: Park & Recreation Dept.: exterior Christmas Tree Fire Dept.: Truxedo Low-Profile Tonneau Cover (fits 2023 Ford F-150), DeWalt Power Tool Set with 2 batteries and extra charger, Havis Toughbook Mounts, Drone and accessories, Digital Camera with underwater case, Video Tape Recorder, PIAA Auxiliary Lights. WHEREAS, in the best financial interest, it is the desire of the City of Brookings to dispose of as surplus property; and WHEREAS, the City Manager is hereby authorized to sell or dispose of said surplus property. NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Brookings, SD, that this property be declared surplus property according to SDCL Chapter 6-13. Report: SDSU Student Association. Anna Hundt, SDSU Student’s Association Government Affairs Chair, provided an update on SDSU current affairs. Report: City Council Ex-Officio Report. A Brookings Municipal Utility Board report was given by Council Member Specker. A Brookings Health Systems Board of Trustees report was given by Council Member Doran. Update: Downtown Revitalization. Samantha Beckman, Assistant City Manager, and Kirsten Gjesdal, Downtown Brookings Executive Director, presented an update on the progress of the Downtown Brookings Master Plan, downtown fire recovery efforts, and announced the awardees for the 2025 Downtown Incentive Programs. Report: 2025 Bridge Re-Inspection Program. Chris Brozik, Civil Design Inc., presented a report on the bi-annual inspections on three bridges located within the City of Brookings. FIRST READING – Ordinance 25-036. Introduction and First Reading was held on Ordinance 25-036, an Ordinance Authorizing Budget Amendment No. 8 to the 2025 Budget. Second Reading and Action: November 25, 2025. On-Off Sale Wine License Renewal. A public hearing was held on an Wine Alcoholic Beverage License Renewal for Sodexo (McCrory Gardens & Visitors Center, License: RW -28251) which failed an alcohol compliance check within the past 12 months. A motion was made by Council Member Tilton Byrne, seconded by Council Membe r Doran, that the 2026 Wine License renewal be approved. Public Comment: James Quinn, Sodexo Resident District Manager, and Emily O'Connor, Sodexo Catering Director. A public hearing was held on a Special Event / Temporary Alcoholic Beverage Application from St. Thomas More Catholic School, to operate within the City of Brookings, South Dakota, on January 31, 2026, for the annual Winter Gala and Grand Auction to be held at 1700 8th Street South. A motion was made by Council Member Tilton Byrne, seconded by Council Member Specker, that the Special Event Temporary Alcoholic Beverage License be approved. The motion carried by the following vote: Yes: 6 - Avery, Doran, Hager, Specker, Tilton Byrne, and Wendell; Absent: 1 - Niemeyer. Ordinance 25-033. A public hearing was held on Ordinance 25-033, an Ordinance to Change the Zoning within the City of Brookings (Outlot 19 in the NW 1/4 of Sec 23 Excluding Lot H-1 Thereof, T110N, R50W, also known as 213 West Highway 14 Bypass, from Residential R-3 Apartment District to Business B-3 Heavy District). A motion was made by Council Member Tilton Byrne, seconded by Council Member Specker, that Ordinance 25-033 be approved. The motion carried by the following vote: Yes: 6 - Avery, Doran, Hager, Specker, Tilton Byrne, and Wendell; Absent: 1 - Niemeyer. Ordinance 25-035. A public hearing was held on Ordinance 25-035, an Ordinance Pertaining to an Application for a Conditional Use Permit to Establish an Office in a Residence R-2 Two-Family District (717 & 719 Main Avenue). A motion was made by Council Member Tilton Byrne, seconded by Council Member Specker, that Ordinance 25-035 be approved. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, that Ordinance 25-034, the 2026 Appropriations Ordinance, be approved. The motion carried by the following vote: Yes: 6 - Avery, Doran, Hager, Specker, Tilton Byrne, and Wendell; Absent: 1 - Niemeyer. Resolution 25-087. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, that Resolution 25-087, a Resolution Adopting the Consolidated Fee Schedule, be approved. Public Comment: Doug Austreim. The motion carried by the following vote: Yes: 6 - Avery, Doran, Hager, Specker, Tilton Byrne, and Wendell; Absent: 1 - Niemeyer. RESOLUTION 25-087 - RESOLUTION ADOPTING THE CONSOLIDATED FEE SCHEDULE WHEREAS, the adopted Municipal Code and City Policies make references to fees charged; and WHEREAS, it is prudent that the fees be reviewed for cost effectiveness. NOW, THEREFORE, BE IT RESOLVED, that the City of Brookings hereby adopts the following Consolidated Fee Schedule as defined in the attached schedule. Resolution 25-089. A motion was made by Council Member Doran, seconded by Council Member Tilton Byrne, that Resolution 25-089, a Resolution Transferring Capital Improvement Plan Sinking Funds be approved. The motion carried by the following vote: Yes: 6 - Avery, Doran, Hager, Specker, Tilton Byrne, and Wendell; Absent: 1 - Niemeyer. RESOLUTION 25-089 - A RESOLUTION TRANSFERRING CAPITAL IMPROVEMENT PLAN SINKING FUNDS WHEREAS, the City of Brookings hereby transfers CIP Sinking Funds to fund unplanned operational obligations of the municipality. This resolution is for the purpose of completing a transfer of contingency funds to the following accounts: 451 Recreation 101-451-5-422-07 Contracted Services $95,000 Total Transfers $95,000 The Financing Source for this transfer is from the following accounts: 213-405-5-911-00 CIP Sinking Fund $95,000 Total Source of Funding $95,000 WHEREAS, this resolution is deemed necessary for the immediate preservation of the public peace, health, safety and support of the City, and shall become effective upon publication. 10-Year Capital Improvement Plan. A motion was made by Council Member Doran, seconded by Council Member Tilton Byrne, that the City of Brookings 10-Year Capital Improvement Plan, be approved. The motion carried by the following vote: Yes: 6 - Avery, Doran, Hager, Specker, Tilton Byrne, and Wendell; Absent: 1 - Niemeyer. Executive Session. A motion was made by Council Member Specker, seconded by Council Member Tilton Byrne, to enter into Executive Session at 7:35 p.m., pursuant to SDCL 1-25-2(6)(a), for the purpose of discussing information pertaining to the protection of public or private property and any person on or within public or private property specific to: a) Any vulnerability assessment or response plan intended to prevent or mitigate criminal acts. Item be approved. The motion carried by a unanimous vote. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, to exit Executive Session at 8:33 p.m. The motion carried by a unanimous vote. Adjourn. Item Details: For several years, the City has used Notify Me to send subscribers email and text notifications about various topics, including upcoming City Council meetings, news releases, landfill and collections holiday schedule changes, mosquito fogging, and snow parking bans. Notify Me is a built-in subscription feature of websites provided by CivicPlus, the City’s website vendor. The City recently launched an additional CivicPlus software product called Mass Notification System. It is a more robust notification and alert system that will allow the City to enhance its outgoing communication with citizens. Citizens are able to sign up and elect to receive emergency alerts, routine notifications and weather alerts. Some of the enhanced features of the Mass Notification System are: 1. Multi-channel Communication. In addition to email and text messages, subscribers also can now choose to receive voicemail messages. 2. Language Translation. Subscribers can select their preferred language for messages. The messages will be automatically translated. 3. ESRI Mapping Capabilities. The system is integrated with Environmental System Research Institute (ESRI) mapping capabilities to allow geo-targeted messaging. 4. Text-to-Join. Subscribers are able to text keywords to a number to receive alerts and notifications about selected topics. 5. Weather Alerts. A new election date must be identified by January 14, 2026. Item Details: The City Council is required to identify a new election date for the City of Brookings annual election. HB1130 identifies two date options:  the 2nd Tuesday after the 1st Monday in June; OR  the 2nd Tuesday after the 1st Monday in November. The historical April election date is no longer an option. The two proposed options align the annual municipal election date with the Primary and General Elections in even- numbered years. Attached is a proposed Ordinance for City Council consideration, setting the annual election date as the second Tuesday after the first Monday in June. Terms for current seated Council members will be extended as per HB1130, Section 12: “each office holder whose term was to expire earlier in the year shall have the t erm extended until the office holder or another candidate for the office is duly elected and qualified.” Based on HB1130, those whose terms would have expired in April 2026, will be extended to the new Election Date identified by the City Council. The City of Brookings and Brookings School District had expressed wanting to combine elections with Brookings County. The Brookings County Finance Officer has stated election ballot items from the City of Brookings and the Brookings School District will not be allowed to be placed on the County’s Primary or General Election Ballots. Staff with the City of Brookings and Brookings School District are working together to identify an election process which will be best for the Brookings County voters who vote in the City of Brookings and Brookings School District Elections. Legal Consideration: None. The contract for this project is expected to be awarded at the November 25, 2025 City Council Meeting. Installation is planned for spring of 2026. As such, the budgeted funds will be carried forward into the next year. This amendment will allow for appropriate fund accounting and ensure capital funds are available within the Parks Facilities budget in alignment with the project’s anticipated timeline. Legal Consideration: Pursuant to SDCL 9-21-7, municipalities may approve supplemental appropriations and interfund transfers when adequate resources are available and when deemed necessary for the execution of authorized programs or projects. Item Details: The Parks, Recreation, and Forestry Department desires to enter into a contract with Ascend Contracting in the amount of $684,000.00, for the building of a splash pad to be completed in the Spring/Summer of 2026. The splash pad at Fishback Soccer Complex was identified to be built in the 2025 fiscal year. A Request for Proposals was posted on January 30, 2025, and closed on April 18, 2025. Proposals were received from the following vendors: Ascend Contracting $1,689,334.83 Commercial Recreation Specialist $1,754,888.91 At the time of the Request for Proposals (RFP), vendors did not stay within the budget limitations, and staff decided not to move forward at the time. Ascend Contracting, the lowest RFP, is a partner company with the vendor chosen for our playground replacements. Ascend Contracting reached out to better understand the needs and constraints and provided a splash pad that fit within the identified budget. Staff has budgeted $650,000.000 for the project. Through the RFP process, it was determined that additional funds were needed to complete a facility that would properly accommodate the community's needs. The City would be authorizing the use of 3B reserves to make up the $34,000.00 shortfall.
