HomeMy WebLinkAboutJointBOA Minutes_2024_04_2 April 2, 2024 Meeting Minutes JJBOA – APPROVED 1 BROOKINGS COUNTY/CITY OF BROOKINGS JOINT “JURISDICTION” BOARD OF ADJUSTMENT MINUTES OF APRIL 2, 2024 REGULAR MEETING The Joint Board of Adjustment on Tuesday, April 2, 2024. Joint Board members present were Brookings County Planning & Zoning Commission representatives: Chad Ford, Kyle Vanderwal, Alternate County Commissioner Kelly VanderWal, and alternate board member Spencar Diedrich. City Planning Commission representative Tanner Aiken and City Council alternate Deputy Mayor Nick Wendell and City Planning Commission alternate Scot Leddy. Absent was City Council representative Wayne Avery. Also present were County Development Director Robert W. Hill, County Development Deputy Director Richard Haugen, City Planner Ryan Miller, Community Development Director Mike Struck, and via phone from First District Association of Local Governments Senior Planner Luke Muller. CALL TO ORDER Chair Ford called the meeting to order at 8:20 PM. APPROVAL OF MINUTES. (Aiken/Commissioner Kelly VanderWal) Motion to approve the Jan. 2, 2024 Joint BOA Meeting Minutes. All present voted aye. MOTION CARRIED. ITEMS TO BE ADDED TO AGEDNA BY COMMISSION MEMBERS OR STAFF. None added. INVITATION FOR CITIZENS TO SCHEDULE TIME ON THE COMMISISION AGENDA FOR AN ITEM NOT LISTED. Time limited to 5 minutes per person to address the board. No one scheduled time to address the board. DISCLOSURE OF CONFLICTES OF INTEREST None. APPROVAL OF AGENDA (Kyle Vanderwal/Aiken) Motion to approve the agenda for the April 2, 2024 Meeting. All present voted aye. MOTION CARRIED. CONVENE AS JOINT BOARD OF ADJUSTMENT 2024JJVAR001 Application by Chad Verhoek for a variance. Joint Zoning Ordinance for Brookings County and the City of Brookings: Article III District Regulations: Chapter 3.04 “A” Agricultural Land District: Section 3.04.03. Area Regulations/Easements. 1b. Existing Farmstead Exemption B Single Family Residences - Minimum Front Yard. The property is described as: “N 816’ of E 1/2 SE1/4 in Section 4, T110N, R50W (Brookings Township)”. ~~ located at 4617 16 Ave W, Brookings, SD 57006. April 2, 2024 Meeting Minutes JJBOA – APPROVED 2 (Kyle Vanderwal/Aiken) Motion to approve the Variance request. STAFF REPORT: Chad Verhoek is applying for a variance to build a 40’ x 50’ garage addition on to an existing garage. Request is for addition to be 122’ from the center of 16th Ave W aka – 469th Ave, Brookings Co Hwy #9. The report noted: 1) Required setback is 150’ from the center of the road, request of 122’ from center of the road, amount of variance would be 28’. 2) The existing garage was built in 2014, 182’ from the center of the road. 3) Considerations: lay of the land as it drops off on the south and west side of the existing building with natural drainage in those locations. The proposed site is at the same elevation as the current garage. Public Notices were published in the Brookings Register on March 19 & 26, 2024. Letters were sent to adjoining landowner’s, Brookings Township Chairman and Clerk, and the Brookings County Highway Department. PUBLIC HEARING: Applicant Chad Verhoek informed those present it was the easiest place to locate the proposed structure on the property. Noting the whole yard basically drains to the southwest. If the structure was located to the west a large amount of fill would be needed to the east was a nice flat area. If the issue with the distance to the road the structure could be turned to save about 10 feet. Proponents: None. Opponents: None. DISCUSSION: Board member Aiken noted that the request was extremely reasonable for the applicant to avoid the natural drainage. Findings of Facts reviewed, completed by the board, and placed on file. VOTE: Kyle Vanderwal-aye, Aiken-aye, Wendell-aye, Commissioner Kelly VanderWal- aye, Ford – aye. 5-aye, 0-nay. MOTION CARRIED. ADJOURN (Commissioner Kelly VanderWal/Wendell) Motion to adjourn.
