HomeMy WebLinkAbout2024_05_28 CC Minutes 419 BROOKINGS CITY COUNCIL MAY 28, 2024 The Brookings City Council held a meeting on Tuesday, May 28, 2024 at 6:00 PM, at the Brookings City & County Government Center, Chambers, with the following City Council members present: Mayor Oepke Niemeyer, Council Members Wayne Avery, Brianna Doran, Andrew Rasmussen, Bonny Specker, and Holly Tilton Byrne. Absent: Council Member Nick Wendell. City Manager Paul Briseno, City Attorney Steve Britzman and City Clerk Bonnie Foster were also present. Agenda. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, that the agenda be approved. The motion carried by the following vote: Yes: 6 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne; Absent: 1 - Wendell. Open Forum. Jacob Shane encouraged the City Council and public to display the American Flag in rememberance of D-Day. This year is the 80th Anniversary of D-Day (the Invation of Normandy). There were 4 South Dakota soldiers killed on D-Day: Glenn Dow, Anton Elvesaeter, George Trotman, and Philip Stands. Consent Agenda. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, to approve the Consent Agenda. Action to approve the May 7 and May 21, 2024 City Council Minutes. B. Action on City Council Ex-Officio Appointments: Brookings County & City Joint Jurisdictional Committee: Mayor Oepke Niemeyer and Council Member Holly Tilton Byrne; Brookings Health System Board of Trustees: Council Member Brianna Doran and Council Member Andrew Rasmussen: Brookings Municipal Utilities Board: Council Member Wayne Avery and Council Member Bonny Specker; BEDC Board: Council Member Nick Wendell; BEDC Investment Committee: Mayor Oepke Niemeyer, Council Member Wayne Avery, and Council Member Holly Tilton Byrne; Brookings City & County Joint Board of Adjustment: Mayor Oepke Niemeyer, or their designee (Designee: Council Member Wayne Avery), and Alternate: Deputy Mayor Nick Wendell. C. Action on Resolution 24-051, a Resolution authorizing the Brookings Summer Arts Festival Committee to have exclusive use of Pioneer Park from July 8-16, 2024. RESOLUTION 24-051 -A RESOLUTION AUTHORIZING THE BROOKINGS SUMMER ARTS FESTIVAL COMMITTEE TO HAVE EXCLUSIVE USE OF PIONEER PARK WHEREAS, the Brookings Summer Arts Festival will be held in Pioneer Park on July 13-14, 2024; and WHEREAS, the Summer Arts Festival Committee has requested the exclusive use and control of Pioneer Park and its facilities for said festival, plus additional days for preparation and takedown; and WHEREAS, the Summer Arts Festival Committee will provide evidence of liability insurance coverage including the City of Brookings as named insured; and WHEREAS, the Summer Arts Festival Committee has agreed to accept responsibility for the conduct of the Summer Arts Festival on said premises. NOW, THEREFORE, BE IT HEREBY RESOLVED, that the use of Pioneer Park and its facilities as a public park shall terminate for the period of July 8 through July 16, 2024. BE IT FURTHER RESOLVED, that the City Council does hereby grant the exclusive use of Pioneer Park and its facilities during the Brookings Summer Arts Festival to the Summer Arts Festival Committee. 420 FURTHER, IT IS RESOLVED, that the Summer Arts Festival Committee shall be responsible for maintaining said facilities and cleaning them and returning them to the City of Brookings in good condition following the festival. D. Action on Resolution 24-052, a Resolution Amending the Consolidated Fee Schedule. RESOLUTION 24-052 - RESOLUTION AMENDING THE CONSOLIDATED FEE SCHEDULE WHEREAS, the adopted Municipal Code and City Policies make references to fees charged; and WHEREAS, it is prudent that the fees be reviewed for cost effectiveness. NOW, THEREFORE, BE IT RESOLVED, that the City of Brookings hereby adopts the following amendment to the Consolidated Fee Schedule: Police'Department Police or Accident Reports Per Copy of Report Sec. 3-03 $4.00 Brookings Police Department Pinning Ceremony. New Brookings Police Department Officers Devon Isler, Trevor Donbroski, and Kevin Peterson took their Oath of Office, and were pinned as members of the Brookings Police Department by Police Chief Michael Drake. Chief Drake also recognized new Lead Dispatchers: Emily Edstrom and Alyssa del Plaine. Presentation: Brookings Police Department Foundation. Jeff West, Brookings Police Department Foundation President, provided an update on the BPD Foundation's support for the members of the Brookings Police Department. Report: 2024 Ist Quarter Finance Report. Ashley Rentsch, Finance Office Director, provided the 1st Quarter Finance Report to update the City Council and public on year- to-date sales tax revenue, budget status, City Council Priority Projects, and an economic outlook. Resolution 24-053. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, that Resolution 24-053, a Resolution authorizing the City Manager to approve Amendment#3 for the 20th Street South BUILD Project EM 0295(45) 130 and PCN 020V, be approved. The motion carried by the following vote: Yes: 6 -Avery, Doran, Niemeyer, Rasmussen, Specker, and Tilton Byrne; Absent: 1 - Wendell. RESOLUTION 24-053 - RESOLUTION AUTHORIZING THE CITY MANAGER TO APPROVE AMENDMENT#3 FOR THE 20TH STREET SOUTH BUILD PROJECT EM 0295(45) 130 AND PCN 020V WHEREAS, the Brookings City Council desires improvements to be made at the intersection of 20th Street South and 22"d Avenue as part of the new interchange at Interstate 29 and 20th Street South in Brookings, SD; and WHEREAS, there are remaining funds in the grant totaling $1,413,768.67 which are not committed yet; and WHEREAS, the State of South Dakota Department of Transportation (SDDOT) functions as the administrator for the Project along with the Federal Highway Administration (FHWA); and WHEREAS, SDDOT and FHWA have indicated that they are supportive of utilizing the grant funds for the desired improvements; and 421 WHEREAS, the Memorandum of Understanding between the SDDOT and the City of Brookings, South Dakota designates the City Manager as the City's authorized representative. NOW, THEREFORE, BE IT RESOLVED that the City Manager of the City of Brookings is authorized to approve Amendment#3 for professional services and other documents associated with making improvements at the intersection of 20th Street South and 22"d Avenue as part of the 20th Street South BUILD Project EM 0295(45) 130 and PCN 020V. FIRST READING: Ordinance 24-017. Introduction and First Reading was held on Ordinance 24-017, an Ordinance to Rezone 615, 618, 622, 626 and 628 Campanile Avenue and 1310 7th Street from Residence R-2 Two-Family District to Planned Development District with Residence R-3 Apartment underlying district. Public Hearing and Action: June 11, 2024. FIRST READING: Ordinance 24-018. Introduction and First Reading was held on Ordinance 24-018, an Ordinance to permit by Conditional Use an apartment on the East 100-feet of Outlot F, the North 100-feet of Lots 6 & 7, and all of Outlot E, in Block 5 of Parkdale Home Addition, City of Brookings, Brookings County, State of South Dakota, also known as 124 and 130 9th Street. Public Hearing and Action: June 11, 2024. FIRST READING: Ordinance 24-019. Introduction and First Reading was held on Ordinance 24-019, an Ordinance to permit by Conditional Use a Telecommunications Tower on Lots 11 and 12 in Block 1 of Hillcrest Addition, also known as 1461 6th Street. Public Comment: Curt Kabris, Technical & Network Operations Manager, Swiftel Communications. Public Hearing and Action: June 11, 2024. Temporary Alcoholic Beverage Application. A public hearing was held on a Temporary Alcoholic Beverage Application from the Brookings Cubs Baseball Group for a temporary alcoholic beverage license to operate within the City of Brookings, South Dakota for the 2024 Brookings Cubs Baseball Game Season to be held on at Bob Shelden Field, 530A Elm Avenue. A motion was made by Council Member Tilton Byrne, seconded by Council Member Specker, that the Temporary Alcoholic Beverage Application be approved. The motion carried by the following vote: Yes: 6 -Avery, Doran, Niemeyer, Rasmussen, Specker, and Tilton Byrne; Absent: 1 - Wendell. On-Off Sale Malt Beverage License Renewals, for those with Alcohol Compliance Check Failures. A public hearing was held on Annual Malt License Renewals for establishments which have failed an alcohol compliance check within the past 12 months. A motion was made by Council Member Tilton Byrne, seconded by Council Member Rasmussen, that the following On-Off Sale Malt Licenses be approved: Boss's Pizzeria / On In 2 LLC, 2515 61h Street; BP of Brookings, 2420 6th Street; Casey's General Store#1694, 620 8th Street South; Casey's General Store #2198, 122 6th Street West; Casey's General Store #2419, 534 22"d Avenue South; The Depot Casino / MG Oil, Co., 921 20th Street South; Deuces Casino /Common Wealth Gaming & Holdings, Co., 223 6th Street; Guadalajara, 1715 6th Street, Suite F; Hy-Vee Food Store / Hy-Vee Food Stores Inc., 790 22"d Avenue South; Schoon's Pump N Pak North / Schoon's Properties, Inc., 202 South Main Avenue. Samantha Beckman, Assistant to the City Manager, provided a progress report highlighting the City's activities and projects. Adiourn.
