HomeMy WebLinkAbout2024_04_23 CC Minutes 404 BROOKINGS CITY COUNCIL APRIL 23, 2024 The Brookings City Council held a meeting on Tuesday, April 23, 2024 at 6:00 PM, at the Brookings City & County Government Center, Chambers, with the following City Council members present: Mayor Oepke Niemeyer, Council Members Wayne Avery, Brianna Doran, Andrew Rasmussen, Bonny Specker, Holly Tilton Byrne, and Nick Wendell. City Manager Paul Briseno, City Attorney Steve Britzman and City Clerk Bonnie Foster were also present. Agenda. A motion was made by Council Member Tilton Byrne, seconded by Council Member Wendell, that the agenda be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. Consent Agenda. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, to approve the Consent Agenda. Action to approve the April 16, 2024 City Council Minutes. B. Action to abate property taxes in the amount of$4,445.73 for Parcel #40501- 00100-000-00. Address: 677 Park Avenue, Brookings. Legal description: Block 1, Reserve Third Addition. C. Action on Volunteer Board, Committee, and Commission appointments: Airport Board: reappoint Dan Krogstad (term expires 5/1/2028); Park & Recreation Board: reappoint Jay Larsen and Doug Smith (terms expire 5/1/2027); Sustainability Council: reappoint Valentyna Stopul (term expires 5/1/2025). D. Action on Temporary Alcohol / Special Event Licenses for existing alcohol license holders with events held on publicly owned property: Sodexo Catering (License Holder RB-28249 and RW-28251): SDSU TL24-034. Brookings Police Department Pinning Ceremony. New Brookings Police Department Officers Easton Thury and Cora Olson took their Oath of Office, and were pinned as members of the Brookings Police Department by Police Chief Michael Drake. Chief Drake also recognized new Community Services Officers: Kyler Mahler, Liv Hanson, Matthew Ridgeway, Isabell Vree, Emmie Dittmar, Hudson Spoonemore, and Aiden Metcalfe. Proclamation: National Volunteer Week. Mayor Niemeyer presented a proclamation recognizing April 21-27, 2024 as National Volunteer Week to Anne Fundburg from the United Way. Mayor Niemeyer expressed a thank you to the many individuals who volunteer in numerous ways within the City of Brookings. MAYORAL PROCLAMATION WHEREAS, the Brookings City Council, the City of Brookings staff, and the Brookings Area United Way recognize the positive impact of volunteers serving throughout Brookings County; and WHEREAS, we are thankful for the dedicated volunteers serving our community in the City of Brookings Volunteer Fire Department, the City of Brookings volunteer boards, and our local nonprofits through the Brookings Area United Way Volunteer United program; and WHEREAS, these passionate volunteers are vital to the current and future success of our community, making Brookings a great place to live, work, and visit; and WHEREAS, our community is able to accomplish goals that might have been unattainable without the effort of these volunteers; and 405 WHEREAS, the giving of one's self and service to another empowers the giver and the recipient. NOW, THEREFORE, BE IT RESOLVED, that I, Oepke G. Niemeyer, Mayor of the City of Brookings, do hereby proclaim April 21-27, 2024 as NATIONAL VOLUNTEER WEEK. Informational Item: 2024 Sidewalk Repair Assistance Pilot Project. Public Works Director, John Thompson, presented a 2024 pilot program that will utilize up to $35,000 in the 2024 Fiscal Year adopted budget, Org. 213 to 1) fund sidewalk repair cost associated with first-time boulevard tree damaged sidewalks, and 2) assist income- qualified property owners with needed sidewalk repair costs. The City will work with Inter-lakes Community Action Partnership to provide screening/qualification services for those in need of financial assurance. Resolution 24-041. A motion was made by Council Member Wendell, seconded by Council Member Doran, that Resolution 24-041, a Resolution Awarding the Bid for the 2024-09STI Concrete Maintenance Project, be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. RESOLUTION 24-041 - RESOLUTION ACCEPTING BIDS ON PROJECT 2024-09STI CONCRETE MAINTENANCE PROJECT WHEREAS, the City of Brookings opened bids for 2024-09STI Concrete Maintenance Project on Tuesday, April 16, 2024 at 1:30 pm at the Brookings City & County Government Center; and WHEREAS, the City of Brookings received the following bids for the 2024-09STI Concrete Maintenance Project: Timmons Construction, Inc, in the amount of $329,688.00; and Clark Drew Construction, Inc. in the amount of$509,255.75; and WHEREAS, the low bid was approximately 22% lower than the Engineer's Estimate. NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the low bid of$329,688.00 for Timmons Construction Inc., be accepted. 2. The City Manager is authorized to sign the contract documents for this project and any further contract documents and change orders which may be required. Resolution 24-040. A motion was made by Council Member Specker, seconded by Council Member Doran, that Action on Resolution 24-040, a Resolution Awarding the Bid for the Landfill Equipment Storage Building Project. be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. RESOLUTION 24-040 - RESOLUTION AWARDING BIDS ON THE LANDFILL EQUIPMENT STORAGE BUILDING PROJECT WHEREAS, the City of Brookings opened bids for the Landfill Equipment Storage Building Project on Tuesday, April 2, 2024 at 1:30 pm at the Brookings City and County Government Center; and WHEREAS, sufficient appropriations exist in the Fiscal Year 2024 adopted budget, Org. 625 Solid Waste Disposal; and WHEREAS, the City of Brookings received the following bids for the Landfill Equipment Storage Building Project: BTY Construction $310,669.95 Summit Contracting $349,058.62 APX Construction Group $349,800.00 Clark Drew Construction $386,900.00 406 Allen Construction Company $392,982.54 WS Construction Management $398,700.00 JB Builders $413,448.71 Caliber LLC $427,200.00 NOW, THEREFORE, BE IT RESOLVED as follows: 1. That the low bid of$310,669.95 for BTY Construction, be accepted. 2. The City Manager or his designee is authorized to sign the contract documents for this project and any further contract documents and change orders which may be required. FIRST READING: Ordinance 24-011. Introduction and First Reading was held on Ordinance 24-011, Amendment No. 2 to the 2024 Budget. Second Reading and Action: May 7, 2024. A motion was made by Council Member Rasmussen, seconded by Council Member Tilton Byrne, that the second reading on Ordinance 24-011, Amendment No. 2 to the 2024 Budget, be broken out into 4 individual hearings separated by topic area. Second Reading and Action: May 7, 2024. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. FIRST READING: Ordinance 24-004. Introduction and First Reading was held on Ordinance 24-004, an Ordinance to Rezone Outlots 6, 7, 8, 9 and 14 in the West '/2 of the South Y2 of the Northeast % in Section 11, Township 109, Range 50, Brookings County, South Dakota from a Joint Jurisdiction Agriculture (JJ-A) District and a Joint Jurisdiction Residence (R-3A) Apartments/Mobile Homes and Manufactured Housing District to a Joint Jurisdiction Business (JJ-B3) Heavy District. Public Hearing: May 7, 2024. Liquor License Fees. Discussion was held on the new license fees for On-Sale Liquor and Full-Service Restaurant On-Sale Liquor Licenses. A motion was made by Council Member Specker, seconded by Council Member Rasmussen, to approve the following fees: $25,000 for On-Sale Liquor, and $100,000 for Full-Service Restaurant On-Sale Liquor. A motion was made by Mayor Niemeyer, seconded by Council Member Tilton Byrne, to amend the fees to $75,000 for both licenses and to direct staff to bring a Resolution with these revised fees to the Council for formal action. A friendly amendment was made by Council Member Tilton Byrne, and accepted by Mayor Niemeyer to raise both license fees to $100,000. The motion carried by the following vote: Yes: 4 —Avery, Doran, Niemeyer, and Tilton Byrne; No: 3 — Rasmussen, Specker, and Wendell. On the original motion, as amended, the motion carried by the following vote: Yes: 5 —Avery, Doran, Niemeyer, Tilton Byrne, and Wendell; No: 2 — Rasmussen and Specker. Progress Report. Jacob Meshke, Deputy City Manager, provided a progress report highlighting the City's activities and projects. Executive Session. A motion was made by Council Member Doran, seconded by Council Member Specker, to enter into Executive Session at 7:45 p.m., pursuant to SDCL 1-25-2.3, for the purpose of consulting with legal counsel or reviewing communications from legal counsel about proposed or pending litigation or contractual matters. The motion carried by a unanimous vote. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, to exit Executive Session at 8:19 p.m. The motion carried by a unanimous vote. Adjourn.
