BROOKINGS CITY COUNCIL
MARCH 26, 2024
The Brookings City Council held a meeting on Tuesday, March 26, 2024 at 6:00 PM, at
the Brookings City & County Government Center, Chambers, with the following City
Council members present: Mayor Oepke Niemeyer, Council Members Wayne Avery,
Brianna Doran, Andrew Rasmussen, Bonny Specker, Holly Tilton Byrne, and Nick
Wendell. City Manager Paul Briseno, City Attorney Steve Britzman and City Clerk
Bonnie Foster were also present.
Agenda. A motion was made by Council Member Specker, seconded by Council
Member Wendell, that the agenda be approved. The motion carried by the following
vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and
Wendell.
Consent Agenda. A motion was made by Council Member Wendell, seconded by
Council Member Doran, to approve the Consent Agenda. The motion carried by the
following vote: The motion carried by the following vote: Yes: 7 - Avery, Doran,
Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell.
A. Action to approve the March 12, 2024 City Council Minutes and the March 21,
2024 Board of Equalization Minutes.
B. Action on Temporary Alcohol / Special Event Licenses for existing alcohol
license holders with events held on publicly owned property: Sodexo Catering
(License Holder RB-28249 and RW-28251): SDSU TL24-033.
C. Action to abate property taxes in the amount of$57,276.42 for Parcel #40582-
00500-000-00. Address: 2215 Ace Avenue, Brookings. Legal description: Block 5,
Southland Addition.
D. Action to abate property taxes in the amount of$5,067.80 for Parcel #40582-
00300-001-00. Address: 2206 Ace Avenue, Brookings. Legal description: Lot 1,
Block 3, Southland Addition.
E. Action to abate property taxes in the amount of$2,748.92 for Parcel #40582-
00300-007-00. Address: 2236 Ace Avenue, Brookings. Legal description: Lot 7,
Block 3, Southland Addition.
F. Action to abate property taxes in the amount of$11,816.39 for Parcel #40501-
00200-000-00. Address: 1714 Christine Avenue, Brookings. Legal description:
Block 2, Reserve Third Addition.
G. Action to abate property taxes in the amount of$5,590.68 for Parcel #40582-
00300-006-00. Address: 2234 Ace Avenue, Brookings. Legal description: Lot 6,
Block 3, Southland Addition.
H. Action to abate property taxes in the amount of$24,357.59 for Parcel #40473-
02000-000-05. Address: 2123 Tall Grass Parkway, Brookings. Legal description:
Block 20A, Prairie Hills Addition.
I. Action to abate property taxes in the amount of$17,395.31 for Parcel #40473-
01900-002-00. Address: 522 Sweetgrass Drive, Brookings. Legal description: Lot
2, Block 19, Prairie Hills Addition.
J. Action on Resolution 24-030, a Resolution declaring surplus property for the
City of Brookings.
RESOLUTION 24-030 - DECLARING SURPLUS PROPERTY
WHEREAS, the City of Brookings is the owner of the following described equipment
formerly used at the City of Brookings:
Public Works — Engineering Division: 3/8 Quartzite Chips (unwashed) — approx.
490 cubic yards; Pea Gravel (unwashed) — approx.580 cubic yards.
Public Works —Airport Division: 1992 12-foot plow, Model PR1234, Serial
#R954T92; 2006 Buhler Farm King Finish Mower Model 4T 750, Serial
#28000296; 2007 New Holland Mower Model MC28, Serial #TE20442.
Community Development: 2006 Ford Expedition, VIN #1 FMFU16526LA16954

WHEREAS, in the best financial interest, it is the desire of the City of Brookings to
dispose of as surplus property; and
WHEREAS, the City Manager is hereby authorized to sell or dispose of said surplus
property.
NOW, THEREFORE, BE IT RESOLVED by the governing body of the City of Brookings,
SD, that this property be declared surplus property according to SDCL Chapter 6-13.
FIRST READING: Ordinance 24-008. Introduction and First Reading was held on
Ordinance 24-008, an Ordinance to Amend Chapter 94, Article IV, Division 1, pertaining
to Section 94-133 related to the elimination of drive-thru services for permitted special
uses in the Business B-2A Office District. Public Hearing and Action: April 16, 2024.
Ordinance 24-006. A motion was made by Council Member Tilton Byrne, seconded by
Council Member Doran, that Ordinance 24-006, an Ordinance Authorizing Budget
Amendment No. 1 to the 2024 Budget be approved. The motion carried by the
following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne,
and Wendell.
FIRST READING: Ordinance 24-005. A motion was made by Council Member Tilton
Byrne, seconded by Council Member Doran, that Ordinance 24-005, an Ordinance
Amending Chapter 2 of the Code of Ordinances of the City of Brookings and pertaining
to the Brookings Public Arts Commission be approved. The motion carried by the
following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne,
and Wendell.
FIRST READING: Ordinance 24-007. A public hearing was held on Ordinance 24-
007, an Ordinance to Change the Zoning within the City of Brookings (305 and 307
Main Avenue South from Business B-2A Office District to Business B-3 Heavy District).
A motion was made by Council Member Wendell, seconded by Council Member
Rasmussen, that Ordinance 24-007 be approved. The motion carried by the following
vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and
Wendell.
On-Off Sale Malt License. A public hearing was held on a request for an On-Off Sale
Malt License, for Classic Convenience, Inc., dba Classic Corner, located at 916 6th
Street. A motion was made by Council Member Specker, seconded by Council Member
Wendell, that the On-Off Malt License for Classic Convenience, Inc., be approved. The
motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen,
Specker, Tilton Byrne, and Wendell.
Resolution 24-026. A motion was made by Council Member Tilton Byrne, seconded by
Council Member Doran, that Resolution 24-026, a Resolution of Appreciation at the
Conclusion of Work of the Traffic Safety Committee be approved. The motion carried
by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton
Byrne, and Wendell.
RESOLUTION 24-026 -A RESOLUTION OF APPRECIATION AT THE CONCLUSION
OF THE WORK OF THE TRAFFIC SAFETY COMMITTEE OF THE CITY OF
BROOKINGS, SOUTH DAKOTA
WHEREAS, from time to time, the City Council has appointed Committees to address
specific community issues; and
WHEREAS, because the work of the Traffic Safety Committee has met its useful life, it
is appropriate to recognize their efforts and bring the Traffic Safety Committee to
conclusion; and
WHEREAS, the Committee Members deserve thanks and appreciation of the City
Council and the Brookings Community.

NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Brookings
that the Traffic Safety Committee has met its useful life and is hereby dissolved, and
their Members are discharged from their duties.
Progress Report. Samantha Beckman, Assistant to the City Manager, provided a
progress report highlighting the City's activities and projects.
Adiourn. A motion was made by Council Member Tilton Byrne, seconded by Council
Member Specker, that this meeting be adjourned at 6:37 p.m. The motion carried by a
unanimous vote.
