HomeMy WebLinkAbout2024_02_13 CC Minutes 380 BROOKINGS CITY COUNCIL FEBRUARY 13, 2024 The Brookings City Council held a meeting on Tuesday, February 13, 2024 at 6:00 PM, at the Brookings City & County Government Center, Chambers, with the following City Council members present: Mayor Oepke Niemeyer, Council Members Wayne Avery, Brianna Doran, Andrew Rasmussen, Bonny Specker, Holly Tilton Byrne, and Nick Wendell. City Attorney Steve Britzman, and City Clerk Bonnie Foster were also present. Absent: City Manager Paul Briseno. Agenda. A motion was made by Council Member Avery, seconded by Council Member Tilton Byrne, that the agenda be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. Consent Agenda. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, to approve the Consent Agenda. Action to approve the January 23, January 31, and February 2, 2024 City Council Minutes. B. Action on Temporary Alcohol / Special Event Licenses for existing alcohol license holders with events held on publicly owned property. Sodexo Catering (License Holder RB-28249 and RW-28251): SDSU 24-TL022. Report: SDSU Student Association. Michael Garofalo, SDSU Students Association Government Affairs Chair, provided an update on SDSU happenings. Report: City Council Ex-Officio Reports. A Brookings Municipal Utility Board report was given by Council Member Rasmussen. A Brookings Health Systems Board of Trustees report was given by Council Member Specker. 2024 Outside Agency Funding Recommendations. A motion was made by Council Member Tilton Byrne, seconded by Council Member Doran, to approve the 2024 Outside Agency Funding Recommendations. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. Introduction and first reading was held on Ordinance 24-003, an Ordinance Authorizing Amendment No. 11 to the 2023 Budget. Second Reading and Action: February 27, 2024. Ordinance 24-002. A motion was made by Council Member Wendell, seconded by Council Member Specker, that Ordinance 24-002, an Ordinance Authorizing Budget Amendment No. 10 to the 2023 Budget, be approved. The motion carried by the 381 following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. Ordinance 24-001. A public hearing was held on Ordinance 24-001, an Ordinance to Change the Zoning within the City of Brookings (1.63 Acres in Section One from Agriculture A District and Residence R-3 Apartment District to Business B-2A Office District). Public Comment: Rich Uckert and James Drew. A motion was made by Council Member Doran, seconded by Council Member Rasmussen, that Ordinance 24- 001 be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, _ Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. Resolution 24-016. A public hearing was held on Resolution 24-016, a Resolution Determining the Necessity of Repairing or Installing Sidewalks in the City of Brookings at the Expense of Abutting Property Owners; 2023-01 SWR Concrete Maintenance Project. A motion was made by Council Member Tilton Byrne, seconded by Council Member Rasmussen, that Resolution 24-016 be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. RESOLUTION 24-016 - RESOLUTION DETERMINING THE NECESSITY OF REPAIRING OR INSTALLING SIDEWALKS IN THE CITY OF BROOKINGS AT THE EXPENSE OF ABUTTING PROPERTY OWNERS; 2023-01SWR CONCRETE MAINTENANCE PROJECT BE IT RESOLVED by the City Council of the City of Brookings, South Dakota, as follows: 1. It is hereby determined that sidewalk repairs or installation is necessary abutting the parcels and lots of land in the City described in the Notice to Property Owners attached to this Resolution and marked as 2023-01 SWR Concrete Maintenance Project. 2. Such sidewalks shall be installed to the width and of the materials prescribed by Chapter 74, "Streets, Sidewalks and other Public Places" and Article V. "Sidewalks", and to the grade and in accordance with the Plans and Specifications prepared in the office of the City Engineer. 3. The method of apportionment of benefits is as follows: such assessments, unless paid within thirty (30) days after the date of mailing of a statement of account by the City, shall be collected by the City in accordance with the procedure for Plan One in Section 9-43-102, South Dakota Compiled Laws of 1967, as amended, with interest of 7.98% set by the City's Special Assessment Policy on the unpaid balance. Assessments amounting to less than $300.00 shall be paid in one payment. 4. The City has caused a copy of the Resolution and a Notice to Property Owners to be mailed to each property owner by certified mail. Resolution 24-017. A public hearing was held on Resolution 24-017, a Resolution authorizing the City Manager to enter into an On-Off Sale Wine Operating Agreement for MG Oil, dba Corner Pantry #24, Troy Erickson and Marlyn Erickson, owners, 600 6tn Street, Brookings, South Dakota, legal description: Lots 5-7, Block 11, Second Addition. A motion was made by Council Member Wendell, seconded by Council Member Rasmussen, that Resolution 24-017 be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. RESOLUTION 24-017 - WINE OPERATING AGREEMENT— NEW 10-YEAR AGREEMENT; MG OIL, DBA CORNER PANTRY#24 BE IT RESOLVED by the City of Brookings, South Dakota, that the City Council hereby approves an Operating Alcohol Management Agreement for Wine between the City of Brookings and Troy Erickson and Marlyn Erickson, owners, MG Oil, dba Corner Pantry 382 #24, for the purpose of a alcohol manager to operate the On-Sale establishment or business for and on behalf of the City of Brookings at 600 6th Street. BE IT FURTHER RESOLVED that the City Manager be authorized to execute the Agreement on behalf of the City, which shall be for a period of 10 years, with a 5-year mid-term renewal. On-Off Sale Malt License Transfer. A public hearing was held on a request to transfer an On-Off Sale Malt License for El Tapatio Company, Guadalupe Rodriguez to a new location at 1816 6th Street. A motion was made by Council Member Doran, seconded by Council Member Rasmussen, that the On-Off Sale Malt License transfer be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. Special Event Alcoholic Beverage Application. A public hearing was held on a Temporary/ Special Event Alcoholic Beverage Application from Mosaic Wine Bar, to operate within the City of Brookings, South Dakota for a "Galentine's Girls Night" event to be held on February 15th at The Socialight, 420 Main Avenue. Public Comment: Katelyn Britzman. A motion was made by Council Member Specker, seconded by Council Member Doran, that the Special Event Alcoholic Beverage Application be approved. The motion carried by the following vote: Yes: 7 -Avery, Doran, Niemeyer, Rasmussen, Specker, Tilton Byrne, and Wendell. City Council Member Introduction of Topics for Future Discussion. Council Member Doran shared 'Coffee with the Council' will be held on February 15th at the Downtown Cottonwood Coffee location. Adiourn.
