JOINT “JURISDICTION” BOARD OF ADJUSTMENT
MINUTES OF JANUARY 2, 2024 REGULAR MEETING
The Joint Board of Adjustment on Tuesday, January 2, 2024. Joint Board members
present were Brookings County Planning & Zoning Commission representatives: Chad
Ford, Kyle Vanderwal, County Commissioner Mike Bartley. City Council representative
Wayne Avery, City Planning Commission representative Tanner Aiken. Also, present
were County Development Director Robert W. Hill, County Development Deputy Director
Richard Haugen, City Planner Ryan Miller, Community Development Director Mike
Struck, and via phone from First District Association of Local Governments Senior
Planner Luke Muller.
CALL TO ORDER
Chair Ford called the meeting to order at 7:00 PM.
APPROVAL OF MINUTES.
(Vanderwal/Aiken) Motion to approve the October 3, 2023, Meeting Minutes. All present
voted aye. MOTION CARRIED.
ITEMS TO BE ADDED TO AGEDNA BY COMMISSION MEMBERS OR STAFF.

Regulations, Chapter 3.04 “A” Agricultural Land District; Section 3.04.02 Conditional Use
# 17: Sand, gravel, or quarry operations; mineral exploration and extraction; rock
crushers; and concrete and asphalt mixing plants. The property is described as: “SW1/4
Exc H-1 and SE1/4 of Section 5, T109N, R49W (Trenton Township)”.
(Vanderwal/Avery) Motion to approve the Conditional Use.
STAFF REPORT: The applicant is requesting a conditional use permit # 17: Sand,
gravel, or quarry operations; mineral exploration and extraction; rock crushers; and
concrete and asphalt mixing plants; to mine sand and crush sand and gravel mined on
site and to be able to haul in, stockpile and crush used concrete and asphalt and recycle
the used aggregate products. The report noted: 1) The mine site would be on 319.58
acres on two parcels of land located on the east side of 34th Ave S, south and east of
Brookings. The SE1/4 contains 160 acres, and the SW1/4 contains 159.58 acres, both in
Section 5 of Trenton Township. 2) Property is currently being farmed and the mining
would start on the east side of property and work to the west. 3) Plans – Mine 2-4 acres
per year, mining depth of maximum of 60 feet with 40 feet being the average depth with
4:1 backslope from the edge of the mined area. Project timeline would be 100 years or
when the mined material is depleted. Use existing driveway on the southside of the
property along 32nd St S (Trenton township gravel road) to enter and exit the property
with a road agreement to be set up with Trenton Township officials. Hours of operation
to be 6:30 Am – 6:30 PM Monday-Friday with additional hours as needed during the
construction season. Weed and dust control will be done on an as needed basis. Berms
with a 4:1 slope will be located along the road and mining area with a silt fence to be
used to control erosion until the berms are seeded down and grass is established.
The applicant will need to apply for a mining permit from the South Dakota Department
of Agriculture and Natural Resources and a copy of the mining permit will need to be
filed in the Brookings County Development Office. The reclamation plan is to leave the
mined area as open water and the plan will need to meet the South Dakota Department
of Agriculture and Natural Resources requirements. 4) A majority of the 319.58-acre
parcel is in the flood plain, but not the entire parcel. The parcels are in Zone “B” of the
Aquifer Materials Map but are not in Zone “A” Aquifer Critical Impact Zone, (Wellhead
Protection), it is approximately 5,000 feet south of Zone “A”. They will need to follow the
Brookings City-Brookings County Joint Jurisdiction Ordinance-Section 3.06.05 Zone B
Aquifer Secondary Impact Zone, Section 3.06.05.04 Performance Standards in Zone B.
The property is located within the 3-mile joint jurisdiction area and is zoned “Agricultural”.
5) Letter were sent to the adjoining landowners, Trenton Township Chairman and Clerk,
and the Brookings County Highway Department. A staff report was sent to the Brookings
Community Development Office. Public notices were published in the Brookings
Register on December 19 & 26, 2023.
PUBLIC HEARING: Applicant Cole Schneider informed those present that the plan was
to start mining on the east side and work their way to the west and use excavated dirt for
making the berms.

Findings of Facts were reviewed and completed by the board, concurred with by
Vanderwal and placed on file.
VOTE: Bartley-aye, Vanderwal-aye, Aiken-aye, Avery-aye, Ford-aye. 5-aye,0-nay.
MOTION CARRIED.
