HomeMy WebLinkAbout2023_03_07 JJBOA Minutes APPROVED March 7, 2023 Meeting Minutes JJBOA – APPROVED 1 BROOKINGS COUNTY/CITY OF BROOKINGS JOINT “JURISDICTION” BOARD OF ADJUSTMENT MINUTES OF MARCH 7, 2023 REGULAR MEETING The Joint Board of Adjustment on Tuesday, March 7, 2023. Joint Board members present were Brookings County Planning & Zoning Commission representatives: Chad Ford, Kyle Vanderwal, County Commissioner Mike Bartley, and alternate board member Spencar Diedrich. City Council representative Wayne Avery, City Planning Commission representative Tanner Aiken. Absent was City Council alternate Deputy Mayor Nick Wendell and City Planning Commission alternate Jacob Mills. Also present were County Development Director Robert W. Hill, County Development Deputy Director Richard Haugen, City Planner Ryan Miller, Community Development Director Mike Struck, and via phone First District Association of Local Governments Senior Planner Luke Muller. CALL TO ORDER Chad Ford called the meeting to order at 7:00 PM. ITEMS TO BE ADDED TO AGENDA BY BOARD MEMBERS OR STAFF. None added. INVITATION FOR CITIZENS TO SCHEDULE TIME ON THE COMMISISION AGENDA FOR AN ITEM NOT LISTED. Time limited to 5 minutes per person to address the board. No one scheduled time to address the board. DISCLOSURE OF CONFLICTS OF INTEREST None. APPROVAL OF AGENDA (Bartley/Vanderwal) Motion approve the agenda. All present voted aye. MOTION CARRIED. ELECTION OF OFFICERS FOR 2023. (Vanderwal/Avery) Motion to appoint Chad Ford as Chairperson for 2023. All present voted aye. MOTION CARRIED. (Bartley/Vanderwal) Motion to appoint Wayne Avery as Vice Chairperson for 2023. All present voted aye. MOTION CARRIED. CONVENE AS JOINT BOARD OF ADJUSTMENT 2023JJCU001 Application for L.G. Everist, Inc by Chris Klein for a condition use permit. Joint Zoning Ordinance for Brookings County and the City of Brookings: Article III District Regulations, Chapter 3.04 “A” Agricultural Land District; Section 3.04.02 Conditional Use #17: Sand, gravel, or quarry operations; mineral exploration and extraction; rock March 7, 2023 Meeting Minutes JJBOA – APPROVED 2 crushers; and concrete and asphalt mixing plants. The property is described as: “N1/2 SW1/4 Exc H-2 of Section 32, T110N, R49W (Aurora Township)”. (Vanderwal/Aiken) Motion to approve the Conditional Use. STAFF REPORT: The applicant is requesting a conditional use permit # 17: Sand, gravel or quarry operations; mineral exploration and extraction; rock crushers; and concrete and asphalt mixing plants; to mine sand and gravel. The report noted: 1) The mine site would be on 79.79 acres adjacent to their existing mining operation. With material transported on existing conveyor belt system to the screening/crushing site for processing. 2) Property in the floodplain and Zone “B” of the Aquifer Materials Map. 3) Plans - Berms would be constructed along the road and mining area. Existing entrance and exit would be along 34th Ave S and 214th St and use for access to the mining area. Hours of operation would be the same as the current operation. Applicant has a mining permit from the South Dakota Department of Agriculture and Natural Resources, and this would be an expansion of the existing permit. 4) Letter were sent to the adjoining landowners, Aurora Township Chairman and Clerk, and the Brookings County Highway Department. Public notices were published in the Brookings Register on February 21 and 28, 2023. PUBLIC HEARING: Applicant Chris Klein and Reed Schade informed those present they had nothing to add. Proponents: None. Opponents: None. DISCUSSION: Board members discussed and decided the application would be valid for 25 years, expiring March 7, 2048. Findings of Facts were reviewed and completed by the board, concurred with by Vanderwal and placed on file. VOTE: Bartley-aye, Vanderwal-aye, Aiken-aye, Avery-aye, and Ford-aye. 5-aye, 0-nay. MOTION CARRIED. DEPARTMENT REPORTS None. ADJOURN (Vanderwal/Bartley) Motion to adjourn.
