The Brookings City Council held a meeting on Tuesday, June 14, 2022 at 5:00 PM, at the
Brookings City & County Government Center, Chambers, with the following City Council
members present: Mayor Oepke Niemeyer, Council Members Nick Wendell, Joey Collins,
Holly Tilton Byrne, Wayne Avery, Brianna Doran, and Bonny Specker. City Manager Paul
Briseno, City Attorney Steve Britzman, and City Clerk Bonnie Foster were also present.
Agenda. A motion was made by Mayor Niemeyer, seconded by Council Member Avery,
that Item #10E, Public Hearing and Action on Ordinance 22 -022, an Ordinance Establishing a
Moratorium on the Installation of any Electronic Message Display Signs or Issuance of any
Electronic Message Display Sign Permits Pending Further Study, be removed from the
agenda. The motion carried by the following vote: Yes: 6 - Niemeyer, Wendell, Tilton Byrne,
Avery, Doran, and Specker; Absent: 1 – Collins. A motion was made by Council Member
Tilton Byrne, seconded by Council Member Wendell, that the agenda be approved as
amended. The motion carried by the following vote: Yes: 6 - Niemeyer, Wendell, Tilton
Byrne, Avery, Doran, and Specker; Absent: 1 – Collins.
Brookings County Housing Study Presentation. Amy Haase, Consultant with RDG
Planning & Design, presented the Brookings County Housing Study to the City Council, County
Commission, and members of the public. A motion was made by Council Member Tilton
Byrne, seconded by Council Member Doran, that the Brookings County Housing Study be
accepted. The motion carried by the following vote: Yes: 6 - Niemeyer, Wendell, Tilton
Byrne, Avery, Doran, and Specker; Absent: 1 – Collins.

Open Forum. Charlie Richter, City Engineer, provided an update on the Main Avenue South
and 8th Street South Intersection Project to the City Council and members of the public.
Cole Sartell thanked the City Council for the City's involvement in the Brookings Pride event.
Susan and Jeff Struwe expressed their concerns to the City Council regarding the Brookings
Pride event.
Consent Agenda: A motion was made by Council Member Tilton Byrne, seconded by
Council Member Wendell, to approve the Consent Agenda. The motion carried by the
following vote: Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and Specker.
A. Action to approve the May 24, 2022 City Council Minutes.
B. Action on Resolution 22-050, a Resolution declaring surplus property for the City of
Brookings.
Resolution 22-050 - Declaring Surplus Property
Whereas, the City of Brookings is the owner of the following described equipment formerly
used at the City of Brookings:
Brookings Public Library: Pull-down Screen, 3 Computer Stands (broken), Kwikboost
Charging Station (does not work), 2 AWE Tables, 2 AWE Computers (do not work), HP 19”
Monitor, Phillips 19” Monitor, NEC 19” Monitor, small metal storage cart, 4 door handles.
Brookings Police Department: 2002 Oldsmobile, VIN: 1FAHP2MT4JG112359; 9 chairs (do
not work); old law books; 11 folding tables; 1 typewriter; 2 pull-down projector screens; 56
metal folding chairs; 1 smart board; 1 projector with sound equipment (projector does not

Whereas, in the best financial interest, it is the desire of the City of Brookings to dispose of as
surplus property; and
Whereas, the City Manager is hereby authorized to sell or dispose of said surplus property.
Now, Therefore, Be It Resolved by the governing body of the City of Brookings, SD, that this
property be declared surplus property according to SDCL Chapter 6-13.
Proclamation. Mayor Niemeyer read a Proclamation declaring Sunday, June 19th as
Juneteenth Holiday in the City of Brookings.
Mayoral Proclamation
Whereas, the Declaration of Independence, written in 1776, states: “We hold these truths to be
self-evident, that all men are created equal, that they are endowed by their Creator with certain
unalienable Rights, that among these are Life, Liberty and the pursuit of Happiness”; and
Whereas, in 1863, the contradiction between slavery and the Declaration of Independence was
addressed when President Lincoln issued the Emancipation Proclamation, which set in motion
the end of slavery; and
Whereas, slavery ended when the Confederate states surrendered on April 9, 1865; and
Whereas, enslavers in Texas were able to hide their Civil War defeat until June 19, 1865,
when the United States Military arrived to announce that the more than 250,000 enslaved
people in Texas were free.
Now, Therefore, Be It Resolved, that I, Oepke G. Niemeyer, Mayor of the City of Brookings, do
hereby proclaim Sunday, June 19, 2022 as Juneteenth, and encourage all to celebrate this
important anniversary.
Resolution 22-044. A motion was made by Council Member Tilton Byrne, seconded by
Council Member Collins, that Resolution 22-044, a Resolution Awarding Bids on the Swiftel
Center Audio Project, be approved. The motion carried by the following vote: Yes: 7 -
Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and Specker.
Resolution 22-044 - Resolution of the City of Brookings to Enter into a Statement of
Work Agreement for the Swiftel Center’s Arena Audio Project
Whereas, NLFX Professional, a national provider of audio, video, and lighting; and
Whereas, the City of Brookings has investigated and reviewed NLFX Professionals Request
for Proposal (RFP) for Audio systems, Installation, and Service with Related Products and
Supplies; and
Whereas, the City of Brooking staff has put this project up for a competitive RFP; and
Whereas, the City of Brookings is interested in implementing an Audio Equipment
Replacement and a Controls Upgrade to improve the infrastructure and quality of the Swiftel
Center. Moreover, City of Brookings’ staff has reviewed NLFX Professional’s Statement of
Work #SOW 1.1 and found it acceptable.
Now, Therefore, Be It Resolved by the City Council of the City of Brookings, that the City
enter into a Statement of Work Agreement for “Audio Equipment Replacement” with NLFX
Professional and that the City Manager or his designee are authorized to execute the
documents necessary to purchase the Audio Equipment Replacement through NLFX
Professionals Statement of Work #SOW1.1.
Resolution 22-052. A motion was made by Council Member Tilton Byrne, seconded by
Council Member Wendell, that Resolution 22-052, a Resolution awarding the contract for
the purchase of one new John Deere 772G Motor Grader for the City of Brookings Street
Division through Admin Minnesota, be approved. The motion carried by the following vote:
Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and Specker.
Resolution 22-052 - Resolution Awarding a Contract for the purchase of
one new John Deere 772G motor grader for the City of Brookings Street Division
through Admin Minnesota
Whereas, the City of Brookings Street Division requests action to purchase a new 2022 John
Deere 722G motor grader from, RDO Equipment; and
Whereas, the RDO Equipment is Contract No. 201142 for motor graders and related
accessories from Admin Minnesota Contract Release: M-439(5), a Minnesota State Bid
provider; and
Whereas, the City of Brookings will purchase from RDO Equipment, one 2022 John Deere
722G motor grader in the amount of $370,294.00; and
Whereas, the Capital Budget for the purchase of one John Deere 772G motor grader is
$375,000.00.
Now, Therefore, Be It Resolved, that the Contract from RDO Equipment for $370,294.00 be
accepted.
Resolution 22-053. A motion was made by Council Member Doran, seconded by Council
Member Collins, that Resolution 22-053, a Resolution awarding the contract for the purchase
of one new John Deere 624P Articulating Wheeled Loader for the City of Brookings Street
Division through Admin Minnesota, be approved. The motion carried by the following vote:
Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and Specker.
Resolution 22-053 - Resolution Awarding a Contract for the purchase of
one new John Deere 624P articulating wheeled loader for the City of Brookings Street Division
through Admin Minnesota
Whereas, the City of Brookings Street Department requests action to purchase a new 2022
John Deere 624P articulating wheeled loader from, RDO Equipment; and
Whereas, the RDO Equipment is Contract No. 204505 for an Articulating Wheel Loaders and
related accessories from Admin Minnesota Contract Release: L-331(5), a Minnesota State Bid
provider; and
Whereas, the City of Brookings will purchase from RDO Equipment, one 2022 John Deere
624P articulating wheeled loader in the amount of $222,158.00; and
Whereas, the Capital Budget for the purchase of one John Deere 624P articulating wheeled
loader is $230,000.00.
Now, Therefore, Be It Resolved, that the Contract from RDO Equipment for $222,158.00 be
accepted.
Resolution 22-054. A motion was made by Council Member Avery, seconded by Council
Member Doran, that Resolution 22-054, a Resolution awarding the contract for the purchase of
one new Side Dump Trailer for the City of Brookings Street Division through Admin Minnesota,
be approved. The motion carried by the following vote: Yes: 7 - Niemeyer, Wendell, Collins,
Tilton Byrne, Avery, Doran, and Specker.
Resolution 22-054 - Resolution Awarding a Contract for the purchase of
one new Sidump’r 342-49 trailer for the City of Brookings Street Division
through Admin Minnesota
Whereas, the City of Brookings Street Division requests action to purchase a new 2022
Sidump’r 342-49 trailer from, Titan Machinery; and
Whereas, the Titan Machinery is Contract No. 206482 for trailers and miscellaneous parts and
accessories from Admin Minnesota Contract Release: T -603(5), a Minnesota State Bid
provider; and
Whereas, the City of Brookings will purchase from Titan Machinery, one 2022 Sidump’r 342-49
trailer in the amount of $62,972.25; and
Now, Therefore, Be It Resolved, that the Contract from Titan Machinery for $62,972.25 be
accepted.
Ordinance 22-019. A motion was made by Council Member Wendell, seconded by Council
Member Tilton Byrne, that Ordinance 22-019, an Ordinance Authorizing Budget Amendment
No. 6 to the 2022 Budget, be approved. The motion carried by the following vote: Yes: 7 -
Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and Specker.
Resolution 22-051. A public hearing was held on Resolution 22-051, a Resolution of Intent
to Lease Real Property to a Private Party. A motion was made by Council Member Tilton
Byrne, seconded by Council Member Wendell, that Resolution 22-051 be approved. The
motion carried by the following vote: Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne, Avery,
Doran, and Specker.
Resolution 22-051 - A Resolution of Intent to Lease Real Property to Private Person
Be It Resolved by the governing body of the City of Brookings, South Dakota that the City of
Brookings intends to enter into a Lease Agreement with Red E Charging, LLC, for a term of
five years, with up to two additional periods of five years each, for a total of up to 15 years and
pertaining to the following described property: Four specifically designated parking spaces
located within the Activity Center Parking Lot, which is described as: Lots Four, Five, Six, and
Seven of First Addition to the City of Brookings, County of Brookings, State of South Dakota.
The purpose of this Lease is to provide for the leasing of the above -described property
pursuant to a Charging Station Agreement with Red E Charging, LLC, which will allow Red
E Charging, LLC, to install one 60kW DC Fast Charger and one Level 2 Pedestal (with two
Chargers). The term of the Agreement is initially five years, with up to two additional periods
of five years each, for a total of up to 15 years, beginning upon completion of installation and
inspection of the above-described charging stations. The Lease provides for lease payments
payable by the Tenant as provided in the above-described Charging Station Agreement, and
sets forth the respective obligations of the Lessor and Tenant concerning the above-described
property.
Be It Further Noted, that a Public Hearing on this Resolution was held on this 14 th day of June,
2022 at 6:00 o'clock P.M. at the City Council Chambers and that all persons were given an
opportunity to be heard on the intent to lease the above-described real property.
Ordinance 22-020. A public hearing was held on Ordinance 22-020, an Ordinance to Rezone
a Portion of Wilbert Square Addition from a Planned Development District to a
Residence R-3 Apartment District. A motion was made by Council Member Wendell,
seconded by Council Member Avery, that Ordinance 22-020 be approved. The motion carried
by the following vote: Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and
Specker.
Ordinance 22-021. A public hearing was held on Ordinance 22-021, an Ordinance to Rezone
Lots 1 - 5 in Block 12 of Folsom Addition from Residence R-3 Apartments / Mobile Homes /
Manufactured Housing District to Business B-3 Heavy District. A motion was made
by Council Member Wendell, seconded by Council Member Avery, that Ordinance 22-021 be
approved. The motion carried by the following vote: Yes: 7 - Niemeyer, Wendell, Collins,
Tilton Byrne, Avery, Doran, and Specker.
Commercial Corridor Design Review. A public hearing was held on a Commercial Corridor
Design Review for 600 Main Avenue. A motion was made by Council Member Tilton Byrne,
seconded by Council Member Wendell, that the Commercial Corridor Design be approved.
The motion carried by the following vote: Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne,
Avery, Doran, and Specker.
Temporary Alcohol Application. A public hearing was held on a Temporary Alcohol
Application from Wooden Legs Brewing Co. for a temporary alcohol license to operate within
the City of Brookings, South Dakota for an event to be held on July 14 th for a Comedy at the
Park event at Pioneer Park, 104 6th Street West. A motion was made by Council Member
Tilton Byrne, seconded by Council Member Wendell, that the Temporary Alcohol Application
be approved. The motion carried by the following vote: Yes: 7 - Niemeyer, Wendell, Collins,
Tilton Byrne, Avery, Doran, and Specker.
On-Off Sale Malt License. A public hearing was held on a request for an On-Off Sale Malt
License for Price Partnership, LLC, dba Flavor Indian & Asian Fare, Justin Price, owner.
Location: 501 Main Avenue. Legal Description: East 120 feet of Lots 13-14, Block 14, Second
Addition. A motion was made by Council Member Tilton Byrne, seconded by Council Member
Wendell, that the On-Off Sale Malt License be approved. The motion carried by the following
vote: Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and Specker.
Resolution 22-049. A public hearing was held on Resolution 22-049, a Resolution
authorizing the City Manager to enter into an Operating Agreement for an On -Off Sale Wine
License with Price Partnership, LLC, dba Flavor Indian & Asian Fare, Justin Price, owner.
Location: 501 Main Avenue. Legal Description: East 120 feet of Lots 13-14, Block 14, Second
Addition. A motion was made by Council Member Tilton Byrne, seconded by Council Member
Collins, that the Wine Operating Agreement be approved. The motion carried by the following
vote: Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne, Avery, Doran, and Specker.
Resolution 22-049 - On-Off Sale Wine Operating Agreement - New
Price Partnership, LLC, dba Flavor Indian & Asian Fare
Now, Therefore, Be It Resolved by the City of Brookings, South Dakota, that t he City Council
hereby approves a Lease Agreement for the Operating Management Agreement for Wine
between the City of Brookings and Price Partnership, LLC, dba Flavor Indian & Asian Fare,
Justin Price, owner, for the purpose of a manager to operate the on -sale establishment or
business for and on behalf of the City of Brookings at 501 Main Avenue. Legal description:
East 120 feet of Lots 13-14, Block 14, Second Addition.
Now, Therefore, Be It Further Resolved that the City Manager be authorized to execute the
Agreement on behalf of the City, which shall be for a period of 10 years, with a renewal at the
five-year mid-term.
Council Introduction of Topics for Future Discussion. A motion was made by Council
Member Specker, seconded by Mayor Niemeyer, to schedule a Study Session on July 19th.
The motion carried by the following vote: Yes: 7 - Niemeyer, Wendell, Collins, Tilton Byrne,
Avery, Doran, and Specker.
Adjourn. A motion was made by Council Member Tilton Byrne, seconded by Council
Member Wendell, that this meeting be adjourned at 6:53 p.m. The motion carried by a
unanimous vote.

Purpose: The Brookings Disability Awareness Committee (BDAC) strives to advocate for the rights of
people who have disabilities in our community. Throughout the year, specific events are held to bring
awareness and information to our citizens. Technical assistance is provided to the business
community, private individuals, governmental entities and nonprofit organizations. The goals of this
service are to improve the quality of life for people who have disabilities through enhancing the
knowledge base of entities in the community; and to further serve as a community-based advocacy
group enhancing the ability of local entities to comply with Federal Civil Rights legislation.

Specifically, the combined mental health services were detailed. This information and services are
available to all residents of Brookings and area. In an effort to assist in the promotion of these critical
services, staff asked Heidi Gullickson, United Way Executive Director, to demonstrate the 211 App
with the City Council and members of the public.

Summary:
Jack Petersen has submitted a request to rezone a portion of 3707 Main Avenue South
from Joint Jurisdiction B-3 to Joint Jurisdiction R-3A.
Background:
Jack Petersen owns roughly four acres of property near the intersection of South Main
Avenue and 38th Street South. The property includes Outlots 15, 16, 17 and 18. Outlot
15 (3707 Main Avenue) is currently zoned Joint Jurisdiction B-3 and includes a
residential dwelling, which is a nonconforming use in this zoning district. Outlots 16 - 18
are zoned Joint Jurisdiction Ag.
The applicant would like to add a new de tached garage onto the residence, which would
require a variance from the nonconforming clause, which limits expansions for
nonconforming uses; however, staff suggested the applicant seek a rezone as the
appropriate process for correcting the nonconforming use.
Item Details:
The petition would rezone a portion of Outlot 15 from Joint Jurisdiction B-3 to Joint
Jurisdiction R-3A. The applicant has submitted a replat which carves out the residential
portion into the proposed Lot A, a 21,000 square foot lot at the corner of South Main
Avenue and 38th Street South. The remainder of Outlot 15 would remain Joint
Jurisdiction B-3, but replatted as Lots B and C.
Property immediately to the north is zoned Joint Jurisdiction R-3A. Property to the west
and south is zoned Joint Jurisdiction B-3. Property to the east is zoned Joint
Jurisdiction Ag. Additionally, there is a strong presence of R-3A zoned residential
properties along the South Main Avenue corridor between 32nd Street South and the “S”
curve.
The area is classified as Urban Low Intensity according to the 2040 Comprehensive
Plan. This land use class is reserved for lower intensity uses than what is potentially
allowed in the R-3A Zoning District. Existing land use in the vicinity would support the
rezone request based on the zoning precedence of an established R-3A Zoning District
along this corridor.

Be It Ordained by the City of Brookings, South Dakota:
Section 1. That the real estate situated in the City of Brookings, County of Brookings, State
of South Dakota, described as follows, to-wit:
Lot A of Outlot 15 in the W ½ of the S ½ of the NE ¼ of Section 11, Township 109
North, Range 50 West from a Joint Jurisdiction Business B-3 Heavy District to a
Residence R-3A Multiple-Family and Mobile Home District.
In accordance with Section 800 of Article VIII of Appendix C-Joint Jurisdictional Area

Chairperson Greg Fargen called the meeting of the City & County Planning Commission to order on
Tuesday, June 7, 2022, at 8:00 p.m. in the Chambers Room #310 on the third floor of the City &
County Government Center. City members present were James Drew, Jacob Mills, Lee Ann Pierce,
Roger Solum, and Fargen. Absent were Tanner Aiken, Justin Borns, Nick Schmeichel, and Gregg
Jorgenson.
County members present were Chairperson Chad Ford, Mike Bartley, Darrel Kleinjan, Neal Trooien,
Kyle Vanderwal, alternate Dale Storhaug, alternate-Roger Erickson. Absent were Spencar Diedrich,

Summary:
Todd Voss has applied for a Conditional Use Permit to build a mixed business /
residential use in the Business B-3 Heavy District. A mixed business / residential use is
a conditional use in the B-3 District with the following standards:
Such business uses shall be only those uses permitted in the respective zoning
district.
Provisions set forth in section 94-41 shall govern all residential uses.
Background:
The applicant is proposing to demolish and redevelop 129 and 133 South Main Avenue.
Currently, the B-3 Zone lots consist of two single-family residences, which have most
recently been rented. To the north, where 129 South Main Avenue currently sits, a two-
story, 40 x 100 mixed-use building is proposed with 4,000 square feet of retail space on
the ground floor and four 2-bedroom apartments on the second floor.
Item Details:
The Conditional Use Permit is for the mixed-use building which will consist of 4,000
square feet of retail space and four 2-bedroom apartments. The mixed-use
development will be accessed from South Main Avenue using an existing approach.
The access drive will run east-west to the shared parking area in the rear. Required
parking spaces for the mixed-use include 20 spaces for the retail use and twelve spaces
for the apartments. In all, the overall development will include 46 parking spaces.
Standards for approval include requiring business uses shall be only those permitted in
the respective zoning district and requiring all residential uses be subject to Section 94-
41 Nonconforming and nonstandard uses, buildings and structures. In the B-3 District,
a retail or service store is a permitted use. The residential uses will be subject to
Section 94-41 going forward, which limits certain expansions and remodels.

Summary:
CD Properties on behalf of David Kneip and Todd Voss is requesting to rezone Lots 1 –
8 in Block 4 of Hill Park Addition from Residence R-2 Two-Family District to Business B-
2 District. The rezone would include the north half of the 1200 block of 6th Street
between 12th Avenue and 13th Avenue and between 6th Street and the alleyway to the
south.
Background:
Lots 1-8 in Block 4 of Hill Park Addition include eight homes all currently owned and
rented by David Kneip and Todd Voss. This block of homes is located between the
Lofts at Park Hill and the 6th Street Centre. The rezone would include approximately
1.68 acres of land along the historically residential, but transitioning 6th Street corridor.
Item Details:
The property is located along 6th Street between the Lofts at Park Hill and the 6th Street
Centre. The Lofts at Park Hill and 6th Street Centre are located in Planned
Development Districts with underlying B-2 Zoning. BankStar Financial, northeast of the
proposed rezone area across 6th Street, is also zoned Planned Development District
with B-2 underlying zoning. Property to the south, across an alleyway, and north,
across 6th Street, is zoned Residence R-2 Two-Family District. Significant B-2 Districts
are located within close proximity along 6th Street including the 6th Street and Medary
Commercial District and Jackrabbit Avenue – Campanile Avenue corridor. Additional
properties in the vicinity are zoned Business B-2A Office District and Residence R-3
Apartment District.
The 2040 Comprehensive Plan includes strategic development area policies for the 6 th
Street Corridor. This Strategic Development Area extends from 1st Avenue to 22nd
Avenue. Priorities for development along 6th Street based on public visioning for the
Comprehensive Plan includes promoting high-quality development and a mix of
complementary uses which allow the corridor to function as a cohesive business district
rather than a collection of unrelated businesses. The Comprehensive Plan includes a
special policy map for the 6th Street corridor which categorizes the rezone area as
Medium Density Residential / Mixed Use. A Medium Density Residential Land Use
category would not support a rezone to a Business B -2 District; however, the Mixed Use
category allows flexibility for areas which could benefit from additional life and activity
along the corridor.

Chairperson Greg Fargen called the meeting of the City Planning Commission to order on Tuesday,
June 7, 2022, at 5:30 PM in the Council Chambers Room #310 on the third floor of the City & County
Government Center. Members present were James Drew, Jacob Mills, Lee Ann Pierce, Nick
Schmeichel via telephone, Roger Solum, and Fargen. Absent were Tanner Aiken, Justin Borns, and
Gregg Jorgenson. Also present were Community Development Director Mike Struck, City Planner
Ryan Miller, Jay Larsen, and Ryan Hagedorn,
Drew recused himself.
Item #4a – CD Properties on behalf of David Kneip and Todd Voss submitted a rezone request for
Lots 1 through 8 in Block 4 of Hill Park Addition. The request is to rezone from Residence R-2 Two-
Family District to Business B-2 District.
(Mills/Solum) Motion to approve the rezone request. Pierce and Solum voted no. All others voted
aye. MOTION CARRIED.
OFFICIAL SUMMARY
Item #4a – This is a rezone request of 8 lots along 6th Street between the Lofts at Park Hill and the 6th
Street Centre. This request is to rezone to a Business B-2 District. The adjacent zoning districts of the
area include B-2 underlying and Residential. This is a medium density residential and mixed use area
on our Future Land Use map within our Comprehensive Plan.
Commissioners received a letter from Jay and Kathy Larsen, 1347 5th Street. Larsens believe that city
staff have a responsibility to consider the effects to residential needs and what is the importance to
have more business development on Sixth Street at the loss of affordable housing (rental and home
ownership). The city staff needs to follow-up on the recent 6th Street zoning request approvals and the
builder’s compliance with bufferyards, landscaping, clean-up, lighting, noise, building requirements,
drainage, signage, and being “good neighbors.” Mr. Larsen also spoke to the Commission as he is
concerned about the most recent rezone that took place in the neighborhood. He feels that the
homeowners in these neighborhoods don’t have any opportunity to talk towards a project prior to these
public meetings and there are closed door meetings that these requests are discussed at prior to public
hearing. He hopes that if this is approved, there will be further monitoring of the project.
Drew explained that they plan to relocate these houses and will not be demolishing them.
Pierce asked if mixed use is allowed in a B-2 District. Miller explained that it is by permitted use.
Pierce is concerned with this request. She doesn’t feel that the uses within a B-2 District are the uses
that they had thought would be used, along 6th Street, when they worked on the Comprehensive Plan.
She feels that the vision that the Comp Plan showed for this area of town is not what is being planned
in this request. The Comp Plan has this as mixed residential use and not Business. Pierce feels that
this should be a Planned Development District (PDD) and not a Business B-2 District because there
would then be an opportunity for the commission to apply restrictions. Struck explained that the
intent of the Comp Plan with mixed-use was to apply either vertically or horizontally. In this case this
mixed-use could be the south half of the block being residential and the north half being business.
Also the Commercial Corridor Design Review Overlay District (CCDR) is more restrictive than what a
PDD is. However, the CCDR Overlay District doesn’t restrict uses but a PDD does, and in a CCDR
Overlay District they look at the design. Mills understands where Pierce is coming from, but the PDD
process can also come with many steps after the project is built when a minor modification is needed.
He feels that the CCDR District is a good review. Fargen also understands where Pierce is coming
from but he also feels the CCDR process will cover the review that is needed to have something come
in that will “fit” the area.

Summary:
Ryan Hagedorn has submitted a commercial corridor design review application for a
proposed expansion project at 134 South Main Avenue. The proposed expansion is a
storage area adjacent and connected to the rear side of the current building.
Background:
134 South Main Avenue is an existing commercial building located in a Business B-3
Heavy District just south of downtown on Main Avenue. The commercial use has long
been associated with the Rental Depot, which uses 134 South Main Avenue as its retail
store and several adjacent lots as storage space for the business. The applicant is
proposing to add a 2,800 square foot expansion to the rear side of the primary building
at 134 South Main Avenue for storage space with the intention of then removing the old
motel building located at 144 South Main Avenue.
Item Details:
The proposed expansion falls within the Commercial Corridor Design Review Overlay
District due to its proposed renovation of an exterior façade of a building located within
the Overlay District. The proposed expansion will only impact the rear of the building,
where a new storage area will be added with overhead doors facing the alleyway and
side lot located at 140 South Main Avenue. This side lot will need to be combined with
134 South Main Avenue through a replat in order to allow the expansion to proceed
while meeting zoning and building codes.
Due to the location of the expansion in the rear of the facility, staff and the Development
Review Team have recommended exempting the additional standards prescribed for
projects within the overlay district.
The current Rental Depot building is considered a nonstandard use due to zero-foot
side and front yard setbacks. The B-3 district requires five-foot side yard and 20-foot
front yard and rear yard setbacks. Through a replat adding 140 South Main Avenue to
the property, the south setback will become conforming by adding an additional 37 feet
to the side yard. The front yard setback and north side yard setback will remain
nonconforming. An expansion of a nonstandard use is allowed under certain conditions
such as the changes complying with the yard, height and parking requirements for the
zoning district. The new addition will meet side and rear yard setbacks as well as height
maximum.
Parking on the site is insufficient; however, code does allow for parking spaces for the
use to be located within 300 feet of the use. The Rental Depot currently owns adjacent
lots to the south and west where sufficient land is available to meet the parking need.
Currently, 28 parking spaces are required for the retail store. The expansion will not be
adding any additional retail space.
Current landscape standards would require the lot to include a 10-foot landscape area
along the right-of-way, five-foot landscape areas along the side lot lines, three-foot
foundation plantings along right-of-way facing foundations, and tree plantings based on
the impervious surface area of the development. In this case, a portion of the 10-foot
landscape area along Main Avenue and a portion of the five-foot landscape area along
the north lot line are impossible due to the existing building footprint. Foundation
plantings would be difficult to sustain due to the building canopy on the front façade.
Staff is recommending approval of the expansion with the addition of a 10-foot
landscape area along Main Avenue between the building and new replatted southern lot
line, the addition of a five-foot landscape area along the entirety of the new southern lot
line, the addition of a five-foot landscape area along the north lot line from the rear of
the building to the alleyway, and the addition of one tree planting to be located in the 10-
foot landscape area.

Strategic Plan Consideration:
Economic Growth – the proposed project would support future business operations for
the Rental Depot.
Financial Consideration:
None.

OFFICIAL SUMMARY
Item #5a – This review is for a proposed expansion at the Rental Depot, 134 Main Avenue South and
the vacant lot to the south. This will be for a storage area adjacent to the rear side of the current
building. Staff does recommend approval with conditions to replat and add landscape areas and a tree
planting. Hagedorn would like to request some changes to the requirements on the landscaping. The
landscaping along the south (140 Main Ave S) will hinder customers the ability to navigate around the
property. And the landscaping on the north side (134 Main Ave S) will be blocked by a privacy fence
and doesn’t feel this landscaping would be necessary. Mills wondered if there would be another place
on the property where some landscaping could be installed. Schmeichel agrees with Hagedorn but he
would like to find some area that more greenspace could be installed. He feels that the 10-foot strip
would could be sufficient. Drew wondered if additional greenspace could be added to the proposed
10-foot strip to the south on the east side for the additional greenspace. Hagedorn feels that could
work. Struck explained that greenspace isn’t all about aesthetics but also drainage.

This resolution will allow the City to enter into a contract with Joshua Berndt, for the Hay
Land Lease in the E ½ of Aamot Addition 2022 with the option to renew for two (2)

Background:
The City awarded a contract to Joshua Berndt on May 24, 2022 to lease 26 acres of hay
land in the Aamot Addition for the bid price of $95.00 per acre. The City leases the
property for hay which provides for extra income for the City as well as provides for
weed control.
Item Details:
A public hearing is required as per SDCL 9-12-5.2 to lease to a private person:
9-12-5.2. Powers - Lease to private person - Resolution - Notice - Hearing -
Authorization. If the governing body decides to lease any municipally owned
property to any private person for a term exceeding one hundred twenty days
and for an amount exceeding five hundred dollars annual value it shall adopt a
resolution of intent to enter into such lease and fix a time and place for public
hearing on the adoption of the resolution. Notice of the hearing shall be published
in the official newspaper once, at least ten days prior to the hearing. Followi ng
the hearing the governing body may proceed to authorize the lease upon the
terms and conditions it determines.
The Notice of Public Hearing was published as required. Approval of the resolution
authorizes the City Manager to execute a lease agreement with Joshua Berndt.
Legal Consideration:
None.
Strategic Plan Consideration:
The hay lease furthers the strategic initiative of fiscal responsibility, whereby the City
receives revenue from the lease. The person providing the hay lease also provides
weed control, thereby saving City staff and expenses for the weed control operations.
Financial Consideration:
The City will enter into a one-year contract for 2022 with Joshua Berndt for the high bid
of $95.00 per acre for 26 acres resulting in the annual payment of $2,470.00. The
contract may be renewed for two (2) additional one (1) year terms (2023 and 2024).

Be It Resolved by the governing body of the City of Brookings, South Dakota, that the
City of Brookings intends to enter into a lease with Joshua Berndt, for a period of one
year, commencing on June 14, 2022 and ending December 31, 2022, with the option to
renew this Lease for two additional, one-year terms for 2022 and 2023. This lease
pertains to the following described property:
The designated hay land of twenty six (26) acres more or less in the East ½ of
Aamot Addition, City of Brookings, Brookings County, South Dakota.
The Lease will be an amount of Ninety Five Dollars ($95.00) per acre for hay
land annually, payable first half on July 1 and the remaining half on November 1.
The City of Brookings may terminate this Lease at any time in the event a parcel
of the above described property is to be sold by the City of Brookings. If a
portion of the leased land is sold, the number of acres to be paid for will be
adjusted at the unit price per acre.

The Brookings Area Chamber Downtown Committee, has applied for a Temporary
Alcohol License, to host a series of events for Downtown at Sundown on the 300 Block
of 5th Street and the 400 Block of Main Avenue on July 21 and 28, and August 4, 11,
and 18, 2022.
Background:
The Downtown at Sundown event began in 2015 and ran every Thursday for 7 weeks
with approx. 526 attendees per event, 7 headlining bands, and 4 food / alcohol
vendors. This event has grown to an attendance of 2,000 per event for 5 weeks with 4
food / alcohol vendors: Main Street Pub, Pints & Quarts, Wooden Legs Brewing, and
Eponymous Brewing Co.
Item Details:
All temporary alcohol licenses must be approved by the City Council through use of a
public hearing. All required documents have been filed with the City.
Legal Consideration:
City Attorney Steve Britzman has reviewed the event application.
Strategic Plan Consideration:
Safe, Inclusive, Connected Community – this is a community-wide event for all ages.
Financial Consideration:
Resolution 15-066 established the License Fees for the Issuance of Special Alcoholic
Beverage Licenses in the City of Brookings. There will be a fee assessed at $50 per
event date. Civic, Charitable, Educational, Fraternal, and Veterans Organizations are
exempt from this fee.

NOTICE IS HEREBY GIVEN that the Brookings City Council, Brookings, South Dakota,
will hold a public hearing at 6:00 p.m., Tuesday, June 28, 2022, in the Brookings City &
County Government Center, 520 Third Street, to consider a Temporary Alcohol License
Application from the Brookings Area Chamber Downtown Committee to operate within
the City of Brookings, South Dakota, to host a series of events on the 300 Block of 5th
Street, and the 400 Block of Main Avenue, on July 21 and 28, and August 4, 11, and 18,
2022. At which time and place all persons interested will be given a full, fair and
complete hearing thereon.

Summary:
RGO, Inc., dba Pheasant Restaurant & Lounge, has applied for Temporary Alcohol
License for a Brookings Community Theatre Fundraiser to be held on June 29, 2022 to
be held at Brookings Cinema 8, 219 6th Street.
Background:
All temporary alcohol licenses must be approved by the City Council through use of a
public hearing. All documents have been filed with the City pertaining to insurance and
other licensing requirements.
SDCL 35-4-124.1 35-4-124.1. Donation of beverages to civic, charitable,
educational, fraternal, or veterans organization holding special events license. A civic,
charitable, educational, fraternal, or veterans organization holding a special events
license pursuant to subdivision 35-4-124(5) may only sell wine that has been donated
by members of the public to be sold at the special event. A civic, charitable, educational,
fraternal, or veterans organization holding a special events license pursuant to
subdivision 35-4-124(6) may only sell malt beverages that have b een donated by
members of the public to be sold at the special event. A civic, charitable, educational,
fraternal, or veterans organization holding a special events license pursuant to
subdivision 35-4-124(7) may only sell alcoholic beverages that have been donated by
members of the public to be sold at the special event. The donor shall purchase any
donated alcoholic beverage from a licensed South Dakota retailer.

Dick Peterson, owner, Cinema 8, is hosting a Fundraiser for the Brookings Community
Theatre in partnership with RGO, Inc., dba Pheasant Restaurant & Lounge. This event
will take place on June 29, 2022.
