Special Meeting: Canvass of the May 2nd Recount
The City of Brookings is committed to providing a high quality of life for its citizens and fostering a diverse
economic base through innovative thinking, strategic planning, and proactive, fiscally responsible municipal
management.

1. Call to Order / Pledge of Allegiance.
2. Record of Council Attendance.
3. Action to approve the agenda.
4. Open Forum.
At this time, any member of the public may request time on the agenda for an item not
listed or to make a brief announcement or invitation. Items will be scheduled at the end
of the meeting. Individuals are asked to state their name and address for the record.

Canvass of Recount Board findings for the 1-year City Council Seat on the April 12, 2022 Combined
Brookings Municipal / School Board Election.
Summary:
The Brookings City Council will conduct the official canvass of the Recount Board findings for the 1-
year City Council Seat on the April 12, 2022 Combined Brookings Municipal / School Board Election.
Enclosed are the canvassing documents for the Recount Board findings. As the official Election
Canvass Board, the City Council is charged with the following responsibilities:
1.Review the vote center returns to verify they are genuine and not forged.
2.Review and compare each Vote Center Recap Sheet with the corresponding Scanner Report
3.Approve the canvassing and tabulating of the Recount Board and declare the final election
results.
4.Sign and approve the official Canvass Sheet.

We, Oepke Niemeyer, Joey Collins, Patty Bacon, Wayne Avery, Leah Brink, Holly Tilton Byrne, and Nick
Wendell appointed as the Board of Canvassers because of our positions on the governing board in the
jurisdiction of the City of Brookings, hereby certify the foregoing is a true abstract of the Recount
Board findings of the 1-Year City Council Seat on the April 12, 2022 Municipal Election in the
jurisdiction of Brookings at the election as shown by the returns certified to the person in charge of
the election.

Action on Resolution 22-036, a Resolution Canvassing the Recount Boards decision on the April 12,
2022 Municipal Election.
Summary:
The Recount Board convened at 8:00 a.m. on Monday, May 2nd to recount the results of the 1-year
City Council Member race.
Losing Candidate Andrew Rasmussen filed his request for a recount on Thursday, April 21st. There
was less than 10 vote count difference (less than 2%) between the two candidates: Andrew
Rasmussen and Brianna Doran.
Recount Board Proceedings:
The board conducted a test of the 850 Scanner with a preaudited test deck, examined each ballot to
verify the Official Ballot Stamp was on all ballots counted, counted the ballots with the 850 Scanner,
evaluated the findings of the Resolution Board. The Recount Board found 8 ballots which were not
marked with the Official Ballot Stamp; these ballots were not included in the ballot recount. The
Board unanimously approved the April 12, 2022 1-year City Council Member Election results.
Recommendation:
Staff recommends approval.

Canvassing the April 12, 2022 Municipal Election Recount
Whereas, on the 12th day of April, 2022, there was held in the City of Brookings, South
Dakota, an election for the purpose of electing two (2) 3-year term Council Members,
one (1) 2-year term Council Member, and one (1) 1-year Council Member; and
Whereas, the judges and clerks of said election have returned to the City Council of the
City of Brookings the official results for the purpose of the Official Canvass; and
Whereas, 1-Year City Council Candidate Andrew Rasmussen filed a letter requesting a
recount; and
Whereas, on Monday, May 2nd at 8:00 a.m. the Recount Board assembled consisting of
the following representatives: Tim Reed (representing Andrew Rasmussen), Robert
Burns (representing Brianna Doran), and former Supreme Court Justice David
Gilbertson (neutral representative appointed by the City Clerk); and
Whereas, the Recount Board canvassed the results for the purpose of determining the
official election outcome; and
Now, Therefore, Be It Resolved by the City Council of the City of Brookings, South
Dakota that the official vote for the office of City Council at the City Election held April
12, 2022 was as follows:
