The Brookings Public Library received a grant from the American Library Association to host Black History Month events and a community conversation. Mikaela Neubauer, Community Services Coordinator at the Brookings Public Library, provided an overview of the Library’s grant- funded Black History Month events and reported on the outcome of the Library’s “More Than a Month” Community Conversation. Ordinance 22-007. A public hearing was held on Ordinance 22-007, an Ordinance to Change the Zoning within the City of Brookings, rezoning Tract 1 Mendel Family Addition from Agricultural A District to Business B-3 Heavy District. A motion was made by Council Member Wendell, seconded by Council Member Tilton Byrne, that Ordinance 22-007 be approved. Summary: This resolution provides the support required to complete a Recreational Trails Fund (RTF) grant application. RTF provides grant funding for recreational trail projects in South Dakota. The Parks, Recreation and Forestry Department desires to utilize Recreational Trail Grant funding at the 80/20 grant match level to replace portions of the damaged asphalt trail at the Dakota Nature Park. The total project budget is anticipated to be $120,000 and would be completed in 2023 if grant funding is approved. Grant match dollars are available in the current Trail Development line item of the 2022 CIP Budget. Recommendation: Staff recommends approval. RTF provides grant funding for recreational trail projects in South Dakota. The Parks, Recreation and Forestry Department desires to utilize Recreational Trail Grant funding at the 80/20 grant match level to replace portions of the damaged asphalt trail at the Dakota Nature Park. The total project budget is anticipated to be $120,000 and would be completed in 2023 if grant funding is approved. Grant match dollars are available in the current Trail Development line item of the 2022 CIP Budget. Background: The Recreational Trails Fund (RTF) is a federal grant program administered through South Dakota Game, Fish and Parks. RTF provides grant funding for recreational trail projects in South Dakota. Eligible projects may include funding for trail maintenance or new trail development. Over time, many areas of the asphalt trail at the Dakota Nature Park have become uneven and heaved due to root growth and present a safety hazard for walkers and bikers. The hazardous trail sections will be replaced with concrete which is not as susceptible to vegetative heaving. Item Details: The Parks, Recreation and Forestry Department desires to utilize Recreational Trail Grant funding at the 80/20 grant match level to replace portions of the damaged asphalt trail at the Dakota Nature Park. The total project budget is anticipated to be $120,000 and would be completed in 2023 if grant funding is approved. Legal Consideration: None. Strategic Plan Consideration: Connected Community – This grant assists in the implementation of the Bike Plan. Financial Consideration: The project would be financed through the Recreational Trails Fund grant program and the City of Brookings. Grant match dollars are available in the current Trail Development line item of the 2022 CIP Budget. Options and Recommendation: The City Council has the following options: 1. Approve as presented 2. Supporting Documentation: Memo Resolution Resolution 22-026 Resolution in Support of a Recreational Trails Fund Grant Application Whereas, the United States of America and the State of South Dakota have authorized the making of grants from the Recreational Trails Fund (RTF) to public bodies to aid in financing the acquisition and/or construction of specific public trail projects; and Whereas, the Parks, Recreation and Forestry Director, is hereby authorized and directed to furnish such information as the above mentioned federal and/or state agencies may reasonably request in connection with the application which is hereby authorized to be filed; and Whereas, the City of Brookings shall provide a minimum of 20% of the total cost of the project; and will assume all responsibility in the operation and maintenance of the project upon completion of construction, for the reasonable life expect ancy of the trail; and Now, Therefore, Be It Resolved that the Parks, Recreation and Forestry Director is hereby authorized to execute and file an application on behalf of the City of Brookings with the National Park Service, U.S. Department of the Interior, through the State of South Dakota Department of Game, Fish and Parks, Division of Parks and Recreation, for an RTF grant to aid in financing the replacement of the damaged asphalt trail sections at the Dakota Nature Park for the City of Brookings, South Dakota and its Environs. Attachments: Proclamation City of Brookings Printed on 3/17/2022Page 1 of 1 powered by Legistar™ MAYORAL PROCLAMATION City of Brookings, South Dakota WHEREAS, child abuse is a serious, significant issue in South Dakota; and WHEREAS, one in four women and one in six men were sexually abused before the age of 18; and WHEREAS, children are vital to our future success, prosperity, and quality of life as well as being our most vulnerable assets; and WHEREAS, all children deserve to have the safe, stable, nurturing homes and communities they need to foster their healthy growth and development; and WHEREAS, child abuse and neglect is a community responsibility affecting both the current and future quality of life of a community; and WHEREAS, parents provided with the social support, knowledge of parenting and child development and concrete resources they need to cope with stress and nurture their children ensure children grow to their full potential; and WHEREAS, effective child abuse prevention strategies succeed because of partnerships among citizens, human service and law enforcement agencies, schools, faith and civic organizations, health care providers, and businesses. NOW, THEREFORE, BE IT RESOLVED, that I, Oepke G. Niemeyer, Mayor of the City of Brookings, do hereby proclaim April as CHILD ABUSE PREVENTION MONTH And call upon all citizens to increase their participation in efforts to support families, thereby preventing child abuse and strengthening our community. Background: This project is the annual street maintenance project which provides the asphalt patching material the Street Department picks up at the plant to repair asphalt pavement throughout the City. The Street Department staff also uses the materials to overlay small street areas, which are usually one block long or shorter. A bid letting was held on Tuesday, March 8, 2022 and the City received the following bid: Bowes Construction Co., Inc. $88,850.00 The total low bid is approximately 5% higher than the engineer’s estimate of $84,450.00, which was due to higher than anticipated oil prices. Item Details: This project consists of asphalt material the street department staff picks up at the asphalt plant and is used for patching City streets. The bid is an estimate of the tons of material that may be used by the City; however, the City budget for the asphalt material is $75,482.00. Since the asphalt material is paid for by the ton of mix, City staff will adjust how much material they pick up to stay within the budgeted amount. This year, the way the project was bid was adjusted. Staff included oil in the unit prices for each mix, instead of bidding it separately. This is a common practice in the region, and will simplify billing and pay applications significantly. Legal Consideration: None. Strategic Plan Consideration: Sustainability: The asphalt material purchased will be used for patching along curb and gutter, sidewalk ramps, potholes, and larger asphalt repairs. These asphalt repairs increase the integrity of the street pavement in terms of drainage and structural soundness. By increasing the lifespan of streets through the patching and sealing process, the City is staying on course for sustainable maintenance of the asphalt street network. Financial Consideration: The City will enter into a contract with Bowes Construction, Inc. for the low bid of $88,850.00. Options and Recommendation: The City Council has the following options: 1. The total donation amount is $164,000 and will be split into two phases: 1. $49,200 as the first installment to be paid to the manufacturer to ensure that the equipment is placed in the production schedule. 2. After the installation of the video board system in the Larson Ice Arena is complete, the balance of $114,800 will be paid to Daktronics and will be supported by a second donation from the Brookings Ice Staking Association. The City will act as the purchasing agent for this transaction, as the video board system will be in a City-owned facility. The City’s legal counsel has determined that this purchase qualifies for Sole Source Procurement; thus, it is excluded from competitive bidding requirements. The City Manager recommends the use of the City’s Contingency fund to allocate $2,000 to the Human Rights Commission’s budget to match the purchase of additional diversity signs. Legal Consideration: None. Strategic Plan Consideration: This action supports fiscal responsibility by increasing budget authority for anticipated expenditures and adding transparency regarding the receipt of grants and donations. The second proposed action supports the City’s goals of fostering a safe, inclusive and connected community. WITNESSETH; WHEREAS, the City has been issued an on-sale alcoholic beverage license and is engaged in the sale of alcoholic beverages, and WHEREAS, the City desires to enter into an Operating Agreement on a limited basis with the Manager for the purpose of operating an on-sale establishment or business for and on behalf of the City pursuant to law, and WHEREAS, the Manager has offered to have facilities in which to operate said on -sale establishment solely upon the premises hereinafter described. NOW, THEREFORE IT IS MUTUALLY AGREED AS FOLLOWS: 1. This Agreement is made and entered into on a limited basis between the parties to allow the Manager to operate a retail on-sale premises, pursuant to and in accordance with all of the terms and conditions of this Agreement and in accordance with all State laws and City Ordinances now in effect and as may be enacted in the future. 2. The Manager shall be individually responsible for all operating expenses of said on -sale establishment, including but not limited to utilities, taxes, insurance, and license fees, if any. The Manager shall furnish all equipment and fixtures necessary to operate the establishment. 3. The on-sale establishment shall be located upon real property in the City of Brookings, South Dakota, described as: Lot 11, Block 6, Original Plat Addition, City of Brookings, Brookings County, South Dakota 4. The Manager shall dispense only alcoholic beverages supplied by the Municipal off -sale establishment. 5. This Agreement shall be in full force and effect for a period of five (5) years with the Manager having the option and privilege of one five (5) year extension, subject to the approval of the governing body of the City of Brookings. 6. Either the Manager or the City may terminate this Agreement without cause upon ninety (90) days written notice served by either party upon the other. The City reserves the right to immediately suspend or revoke this Agreement without ninety (90) days written notice for alcohol related violations in accordance with the provisions of Resolution No. 25-88 or any amendments thereto or for any late payments for alcoholic beverages supplied by the Municipal off -sale establishment to be sold on the premises of Manager. 7. The Manager shall receive as full compensation for its services rendered, the net profit from the on-sale establishment under its management, and the sole profit to be derived by the City shall be the markup hereinafter set forth on alcoholic beverages furnished by the municipality to the Manager for the purposes of resale on the premises as above described. 8. The Manager shall pay in a timely manner to the City for all alcoholic beverages sold by the City to the Manager for resale on the above-described premises, the actual cost of distilled spirits and wine supplied by the City, plus eleven percent (11%) in excess of such cost; the Manager shall pay to the City for all malt beverages sold by the City to the Manager for resale on the above-described premises, the actual cost of malt beverages, plus ten percent (10%) in excess of such cost. The actual cost shall include cost price and transportation charges. The markup percentages provided in this Agreement are subject to change by the City of Brookings. In the event markup percentages are changed by Ordinance, then the markup percentages provided by City Ordinance shall supercede the markup percentages provided herein. The Manager further agrees that if either of the markup percentages shall be increased at any time by the City, the Manager shall pay the markup as so increased. 9. A complete and detailed record shall be maintained by the City of all alcoholic beverages supplied to the on-sale Manager and such alcoholic beverages so supplied shall be evidenced by pre-numbered invoices prepared in triplicate showing the date, quality, brand, size, and actual cost of such item, and such invoice shall bear the signature of the authorized representative of the on -sale Manager or its authorized representative. One copy thereof shall be retained by the Municipal off -sale establishment, one copy shall be retained by the on-sale establishment, and one copy shall be filed with the City Clerk. All copies shall be kept as permanent records and made available for reference and audit purposes. The Manager also agrees to maintain a complete record of all alcoholic beverages received from the City. 10. In consideration of the covenants herein contained, the Manager agrees to pay the CITY OF BROOKINGS, One Thousand Five Hundred, and no/100 Dollars ($1,500.00), constituting the Annual License Fee on or by the 1st day of November of each year thereafter as long as this agreement shall remain in force and effect. The payment of the Annual Renewal License Fee will not extend the term of this Operating Agreement beyond the term provided therein. The Manager further agrees that if the annual fee shall be increased at any time by the legislature, the Manager shall pay the amount of any such increase. 11. The Manager agrees to keep the premises in a neat, clean and attractive appearance, and Manager further agrees to operate said on-sale establishment only on such days and at such hours as permitted by state law and city ordinances. 12. The Manager shall have the right to return, at any time, alcoholic beverages received from the City which are eligible to be returned, and to receive in return any deposit made for such alcoholic beverages; in the event of termination of the business, all unused alcoholic beverages, which may be resold without discount may be returned to the City and the Manager shall be reimbursed for the cost of such alcoholic beverages. 13. The Manager agrees to abide by the credit policies of the City and acknowledges, by execution of this Agreement, receipt of a copy of the credit policies of the City. The City reserves the right to change or terminate its credit policies at any time, but shall be required to provide written notice to Manager prior to the effective date of the change or termination date of the credit policies. 14. The Manager agrees to furnish the City upon demand, evidence of payment of t he following: A. All salaries of on-sale employees; B. Social Security and withholding taxes on said employees; C. Worker’s Compensation insurance premiums covering said employees; D. Unemployment taxes on the payrolls of said employees; E. General liability insurance protecting both the City and the Manager against claims for injury or damages to persons or property, said policy to have general liability limits of at least Five Hundred Thousand Dollars ($500,000.00) single limit, and One Million Dollars ($1,000,000.00) aggregate, and a limitation of Fifty Thousand Dollars ($50,000.00) for damage to property. The general liability insurance limits are subject to change and Manager agrees to change limits of insurance if required by the City; F. Rent and utility bills; and G. Any and all miscellaneous expenses, including taxes. 15. The Manager agrees to observe all Federal and State laws and ordinances of the City of Brookings. 16. Any applicant for a new retail license, except as set forth in § 35-2-1.1, or the transfer of an existing license shall submit an application to the governing body of the municipality in which the applicant intends to operate, or if outside the corporate limits of a municipality, to the governing body of the county in which the applicant intends to operate. The applicant shall submit the required fee with the application. The governing body may approve the application for a new retail license or the transfer of an existing license if the governing body considers the applicant suitable to hold the license and the proposed location is suitable. The governing body may disapprove an application for a new retail license or the transfer of an existing license issued under subdivision 35 -4-2(4), (6), or (13) if: 1) The approval of the application permits a person, corporation, or business entity to possess more than one-third of the licenses available to be issued in the jurisdiction; and 2) The governing body determines that possession of more than one -third of licenses available is not in the public interest. Any application for the reissuance of a retail license may be approved by the municipal or county governing body without a hearing unless in the past year the licensee or one or more of the licensee's employees have been subjected to a criminal penalty for violation of the alcoholic beverage control law or the license has been suspended. The governing body of any incorporated municipality or county being presented applications for retail on-sale or off-sale alcoholic beverage licenses shall fix the time and place for hearing upon all applications that come before the body. The finance officer or county auditor shall publish one notice in the official newspaper of the municipality or county. The notice shall be headed "Notice of Hearing Upon Applications for Sale of Alcoholic Beverages," shall state the time and place when and where the applications will be considered, and shall state that any person interested in the approval or rejection of any application may appear and be heard. The notice shall be published at least one week before the hearing. At the hearing, the body shall consider each application and any objection to the application before making a final decision on an application. Background: The City of Brookings administers a building permit process through the Building Services Division of Community Development. Building permit fees are applied to each building permit and help cover the cost of administering a building permit and inspection program. Exceptions to the building permit fees are approved by resolution of the City Council. Interlake’s Community Action Partnership (ICAP) and Habitat for Humanity are exempt from fees due to their mission of providing affordable housing and past Council resolution waiving fees. A third exemption was provided for a low-income housing project. Item Details: Staff is proposing building permit fees are exempted for public projects and facilities owned and/or operated by the City of Brookings, Brookings County, and Brookings School District. Building permits would still be required, and inspections performed; however, the fees would be waived. The waiving of fees is justified as the entities identified are public, tax-generating entities, and as such need to be good stewards of public tax dollars. Typical building permit fees associated with city, county, and school projects could run into the tens of thousands of dollars, increasing the overall costs to the taxpayers. The proposed resolution would allow the City to waive the b uilding permit fees on projects and facilities owned and/or operated by the City, Brookings County, and Brookings School District. Legal Consideration: City Attorney, Steve Britzman, prepared the resolution for consideration. Strategic Plan Consideration: This resolution is supportive of the City Council’s strategic plan of fiscal responsibility and a safe, inclusive, and connected community by working with our peer governmental entities to be fiscally responsible with public tax dollars. Financial Consideration: Being good stewards of public tax dollars. Options and Recommendation: The City Council has the following options: 1. Approve as presented 2. Amend 3. Deny 4.
