South Dakota Initiated Measure (IM) 26, Medical Marijuana Initiative was approved by the voters of South Dakota in 2020. IM allows a local government to regulate medical cannabis establishments through zoning and licensing. 38 Insight and Experience Bill Efting, the City’s consultant, will provide insight into the proposed regulation and experience from Colorado. 39 Dispensary Zoning Local governments may regulate Time Place Manner Number of Medical Cannabis Establishments Recommended Zones: B-1, B-2, B-2A, B-3, and B-4 Districts State law prohibits establishments within 1,000 feet from an educational unit. Various cities have limited the quantity of facilities. 40 Testing, Manufacturing and Cultivation Zoning Recommended in I-1 light industrial districts Ordinance 21-027 sets the number of allowable dispensaries, manufacturing, testing and cultivation facilities in Brookings. 41 Number of Medical Cannabis Establishments Local government can set the allowable number to zero for Cultivation Facility Cannabis Testing Facility Cannabis Product Manufacturing Local government may not set allowable number to zero for dispensaries 42 Licensing Ordinance 21-028 establishes procedures for licensing of medical dispensaries in the City. License Permit Registration Local governments may charge a fee for the aforementioned 43 8.
