OFFICIAL MINUTES
Acting -Chairperson Jeremy Scott called the Board of Adjustment meeting to order on
Thursday, April 1, 2021 at 5:00 PM in the Chamber's Room of the City & County Government
Center. Members present were alternate -Matt Chandler, George Houtman-via telephone,
Dustin Edmison, Nick Schmeichel-via telephone, Justin Borns-via telephone and Scott.
Others present were City Planner Ryan Miller, Teresa Hall, Rodney Petersen, and Jordan
Hilbert.
Item #1 — Roll Call
Item #2 — (Edmison/Schmeichel) Motion to approve the agenda with the removal of item #4a.
(Applicant withdrew their request.) All present voted aye. MOTION CARRIED.
Item #3 — (Schmeichel/Houtman) Motion to approve the March 4, 2021 minutes. All present
voted aye. MOTION CARRIED.
Item #4b — Teresa & Douglas Hall made a request for a variance on Lot 12A, Block 2,
Boulevard Park Addition, also known as 1505 Sequoia Court. The request is for a 32' section
of 8' tall privacy fence in a rear yard. The maximum height allowed for a privacy fence is 6'.
(Houtman/Edmison) Motion to approve the variance request. Edmison, Schmeichel and
Houtman voted nay. Borns and Scott voted aye. MOTION FAILED.
Item #4c — Rodney Petersen made a request for a variance on Lot 1 B, Block 1, Windermere
Point Addition, also known as 1927 Tanbury Lane. The request is for a 32' wide driveway
located partially within the required front yard setback on a corner lot and to establish parking
in the secondary front yard. The maximum allowed width of a driveway is 24' and parking is
not permitted in the secondary front yard on a corner lot.
(Houtman/Borns) Motion to approve the first variance establishing front yard parking.
Edmison, Schmeichel, Borns and Houtman voted nay. Scott voted aye. MOTION FAILED.
Motion to approve the second variance request for a 32' wide driveway located partially within
the required front yard setback. Due to the first variance request failing, the variance for
expanding driveway width could not be heard.
Item #4d — Jordan Hilbert made a request for a variance on Lot 6, Block 2, Arbor Hill
Addition, also known as 2111 Wildwood Circle. The request is for a 6' fence to be installed
within the 20' required setback area on a double frontage lot abutting a local street. Fences
up to 6' in height may be placed in a front yard opposite the street address on a lot abutting a
local street if it meets the minimum required setback. A fence up to 4' in height is allowed
between the front lot line and the principal building.
(Schmeichel/Houtman) Motion to approve the variance request. Edmison, Barns,
Schmeichel, and Scott voted aye. Houtman voted nay. MOTION CARRIED.
The meeting was adjourned at 5:38 p.m.

Acting -Chairperson Jeremy Scott called the Board of Adjustment meeting to order on
Thursday, April 1, 2021 at 5:00 PM in the Chamber's Room of the City & County Government
Center. Members present were alternate -Matt Chandler, George Houtman-via telephone,
Dustin Edmison, Nick Schmeichel-via telephone, Justin Borns-via telephone and Scott.
Others present were City Planner Ryan Miller, Teresa Hall, Rodney Petersen, and Jordan
Hilbert.
Item #4b — The applicant is requesting a 32' long section of fence which will be 8' tall in the
rear yard. 6' tall is allowed. Clearing of the trees in the rear yard has now allowed light from
the neighboring house to shine in to their house. Borns questioned where the lights are
located on the neighboring house. Teresa Hall, homeowner, explained that the lights are
installed on pillars on the deck. There are at least 11 lights total and the lights stay on all
night long. Schmeichel wondered if there was another way she could file a grievance with
the City since there are other neighbors that are affected by this. Miller explained that this is
a potential nuisance issue and a complaint could be made to the city, however, a first step
could be asking the neighbor to consider making an adjustment to their lighting.
Item #4c — The applicant would like to build a driveway at 32' wide along the south side of
their house, this would then be in the front yard. Rodney Petersen explained that he would
like to be able to park his camper on this side of his garage. Parking on the drive -way
doesn't work as it then hangs over the sidewalk. There is a 25' setback requirement on this
side of their house along 20th Street South. Schmeichel asked if the camper could legally be
parked in this location right now? Miller stated no because it is front yard parking. Scott
drove by this location and with the current trees planted along 20th Street South, the camper
is not visible through the trees.
Item #4d — The applicant would like a 6' fence that will be installed within the 20' required
setback area on a double frontage lot. The fence would be installed 4' from the sidewalk
along Grand Arbor Ave.
Houtman asked if the 4' is the minimum that the applicant would like or would he be willing to
adjust to 10' off of the sidewalk? Jordan Hilbert explained that he chose the 4' because there
are other fences in some areas that are only 4' from the property line. He would be willing to
adjust the location of the fence though.
Miller explained the fence requirement differences between a double frontage lot on a local
street and an arterial street. Edmison asked if a 4' tall fence would be sufficient. Hilbert
explained that the 4' would not provide any privacy.
The meeting was adjourned at 5:38 p.m.
